A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, WAIVING, BY
5/7THS VOTE, THE COMPETITIVE BIDDING
REQUIREMENT, AND APPROVING AN EXTENSION OF
THE CURRENT TOWING PERMITS FOR A PERIOD OF
TWO (2) YEARS, TO EXPIRE ON NOVEMBER 30, 1998,
WITH TWO (2) ADDITIONAL ONE (1) YEAR OPTIONS, TO
BE RENEWED AT THE SOLE DISCRETION OF THE CITY.
WHEREAS, pursuant to Ordinance No. 80-2222 the Mayor and City Commission adopted
Article IX of Chapter 44 of the Miami Beach City Code, providing for police vehicle towing permits
for the towing of vehicles identified by the City as requiring removal from public and private
property; and
WHEREAS, pursuant to Request for Proposal No. 1-91/94 for providing police and parking
department towing services in the City of Miami Beach, the Mayor and City Commission select
Beach Towing Service, Inc. and Tremont Towing Service, Inc. as the successful proposers to provide
these services, and
WHEREAS, pursuant to Resolution No. 95-21615 the Mayor and City Commission
extended the towing permits issued for Beach Towing Service, Inc. and Tremont Towing Service,
Inc. for a fifteen (15) month period that commenced on July 1, 1995 and expired on September 30,
1996; and
WHEREAS, the Mayor and City Commission approved a second extension of the permit
for a period of sixty (60) days, from September 30, 1996 to November 30, 1996, to negotiate
additional terms and conditions of the towing permits with Beach Towing Service, Inc. and Tremont
Towing Service, Inc.; and
WHEREAS, the Administration is satisfied with the level of service provided by both Beach
Towing and Tremont Towing to the City and its residents; and
WHEREAS, as Beach Towing and Tremont Towing are the only two service providers
which satisfy all requirements as stipulated in the City's towing permit requirements, including the
ability to provide storage facilities within the City limits, the Administration would recommend that
the Mayor and City Commission, by 5/7ths vote, herein to waive the competitive bidding
requirement, and approve an extension of the current towing permits for a period of two (2) years,
to expire on November 30, 1998, with two (2) additional one (1) year options, to be renewed at
the sole discretion of the City,
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and City Commission, upon
recommendation of the Administration, herein waive, by Sl7ths vote, the competitive bidding
requirement, finding such waiver to be in the best interest of the City, and approve an extension of
the current towing permits with Beach Towing Service, Inc. and Tremont Towing Service, Inc. for
a period of two (2) years, to expire on November 30, 1998, with two (2) additional one (1) year
option terms, to be renewed at the sole discretion of the City. Accordingly, the Mayor and City
Clerk are herein authorized to execute any and all documents memorializing this extension.

SUBJECT:
ADMINISTRATION RECOMMENDATION:
The Administration recommends that the Mayor and City Commission approve a one (1) year
extension with the City having the option, at its sole discretion to thereafter extend the permit for
up to three (3) consecutive one (1) year terms.
BACKGROUND:
On October 9, 1996, the Mayor and City Commission approved a sixty (60) day extension of the
Police and Parking Department Vehicle Towing Permit to allow for contract negotiations with the
service providers.
The towing service providers Tremont Towing located at 1916 Bay Road, Miami Beach, Florida and
Beach Towing, located at 1349 Dade Boulevard, Miami Beach, Florida currently have a permit
issued by the City to provide towing service to the Police and Parking Departments.
ANALYSIS:
The Administration has successfully completed negotiation for the extension of the towing permit
with both Beach Towing and Tremont Towing. Numerous amendments to the towing permit have
been recommended and are scheduled for approval on the current agenda.
Beach Towing and Tremont Towing are the only two service providers which satisfy all
requirements as stipulated in the towing permit, including the ability to provide storage facilities
within the city limits requirement as stated in Section Two of the Towing Permit. Furthermore, the
Administration is satisfied with the level of service provided by both Beach Towing and Tremont
Towing.
