A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, CREATING, SUBJECT TO THE
APPROVAL OF A MAJORITY OF THE AFFECTED PROPERTY OWNERS,
A SPECIAL ASSESSMENT DISTRICT, FOR A PERIOD OF ONE (1) YEAR,
TO BE KNOWN AS THE LINCOLN ROAD MANAGEMENT DISTRICT NO.
3; PROVIDING FOR THE LEVYING OF SPECIAL ASSESSMENTS;
INDICA TING THE LOCATION, NATURE AND ESTIMATED COST OF
THOSE SERVICES WHOSE COST IS TO BE DEFRAYED IN PART BY
THE SPECIAL ASSESSMENTS; PROVIDING THE PORTION OF THE
ESTIMATED COST OF THE SERVICES TO BE PARTIALLY DEFRAYED
BY THE SPECIAL ASSESSMENTS; PROVIDING THE MANNER IN
WHICH SUCH SPECIAL ASSESSMENTS SHALL BE MADE; PROVIDING
WHEN SUCH SPECIAL ASSESSMENTS SHALL BE MADE;
DESIGNATING THE LANDS UPON WHICH THE SPECIAL
ASSESSMENTS SHALL BE LEVIED; PROVIDING FOR PUBLICATION OF
THIS RESOLUTION; AND AUTHORIZING RELATED ACTIONS.
WHEREAS, Chapter 170, Florida Statutes, as amended (the Act), provides that a
municipality in Dade County, may levy and collect special assessments against property benefitted
for the purpose of stabilizing and improving retail and/or wholesale business districts and/or
nationally recognized historic districts through promotion, management, marketing, and other similar
services in business districts in other municipalities; and
WHEREAS, the property owners within the current Lincoln Road Management District
Number 2 have expressed a desire to continue to provide an enhanced level of services as related
to security, sanitation, landscaping, and marketing; and
WHEREAS, accordingly the Mayor and City Commission intend to proceed in accordance
with Chapter 170, Florida Statutes, by creating the special assessment district to be known as the
Lincoln Road Management District Number 3, for the purpose of funding security, maintenance,
marketing, and management services which will stabilize, benefit and improve the tourist and
economic climate of that area generally bounded along Lincoln Road from Collins A venue to Alton
Road.
NOW, THEREFORE, BE IT DULY RESOLVED by the Mayor and City Commission
of the City of Miami Beach, Florida, that:
SECTION 1. All findings and recitals contained in this Resolution are hereby adopted and
incorporated herein.
SECTION 2. Special assessments (Assessments) shall be levied in accordance with the
provisions of the Act, and as described herein, to defray a portion of the cost of the Services.
SECTION 3. In accordance with Ordinance No. 92-2782, adopted by the City on June 17,
1992, it is hereby determined that the provisions of Ordinance No. 92-2782 shall not apply to the
Assessments levied and imposed pursuant to the provision of this Resolution.
SECTION 4. The nature of the Services is set forth in Exhibit "A", attached and
incorporated herein.
SECTION 5. The District upon which the Assessments shall be levied shall incorporate the
total area as set forth in the map attached and incorporated herein as Exhibit "B", and reflecting the
legal description as set forth in Exhibit "C", attached and incorporated herein.
SECTION 6. The estimated cost (Estimated Cost) of the Services IS approximately
$840,000.00.
SECTION 7. The Assessments will defray approximately $267,000.00 of the Estimated
Cost, the balance thereof to be paid by the City from other available funds.
SECTION 8. The Assessments shall be made on the basis of the formula set forth in Exhibit
"D", attached and incorporated herein.
SECTION 9. In the event the actual cost of the Services exceeds the Estimated Cost, such
excess shall be paid from other available funds.
SECTION 10. The Assessments shall be levied on all lots and lands which are specially
benefitted thereby, and further designated on the Assessment plat referenced below within the
boundary of the District.
SECTION 11. At the time of adoption of this Resolution, there is on file with the City
Clerk, an Assessment plat showing the area to be assessed, the Services to be provided, and an
estimate of the costs, which are open to inspection by the public.
SECTION 12. The City Administration is hereby authorized and directed to cause to be
made a preliminary assessment roll, as promptly as possible, which shall show the lots assessed, the
amounts of benefit to and the Assessments against each lot.
SECTION 13. Assessments shall be payable at the Office of the Finance Director of the City
in one (1) installment on such date as shall be contained in a bill to be mailed to each property owner
within the District at least thirty (30) days before its due date. Assessments not paid on the due date
shall become due and payable in accordance with the provisions of the Act.
SECTION 14. Upon completion of the preliminary assessment roll, the Mayor and City
Commission shall adopt a subsequent resolution to fix a time and place at which the owners of the
property to be assessed or any other persons interested therein may appear before the Mayor and City
Commission and be heard as to the propriety and advisability of the Assessments or the provision
of the Services, the costs thereof, the manner of payment therefor, or the amount thereof to be
assessed against each lot so serviced, all in accordance with the Act.
SECTION 15. The City Clerk is hereby directed to cause the Resolution to be published
once in a newspaper of general circulation within the City.
SECTION 16. The City Administration is hereby authorized and directed to take all actions
necessary to carry out the intent of this Resolution, including any actions in connection with
obtaining the approval of the affected property owners.
SECTION 17. This Resolution shall take effect upon its adoption; provided, however, that
if the City does not obtain the approval of the affected property owners in accordance with the Act,
this Resolution shall be null and void.

EXHIBIT A
Services to be provided for FY 96/97
Lincoln Road Commercial Business Improvement District
1) Security - $ 142,000
Overseen by the lincoln Road Partnership, N Ambassador I' service will be
contracted to Washington Avenue Association and provided through private
security detail. Coverage is 24 hours, at least until after construction, and is
scheduled to compliment the coverage provided by assigned on-duty police.
Amount budgeted includes patrol bicycles.
2) Sanitation. $ 148,000
Overseen by the Uncoln Road Partnership, and contracted to Washington
Avenue Association, service will include mechanical, hand sweeping, and
pressure washing of pavement, graffiti and illegal flyer removal, monitoring and
reporting of physical conditions, supervision, supplies and materials.
3) Landsc:apiog - S 90,000
Overseen by the Uncoln Road Partnership and contracted to Washington
Avenue AS&OCiatio~ service will include working with the City of Miami
Beach to maintain landscaping and fountains in the District after the
construction period and warranty period.
4) Tram. $ 65,000
Overseen by the Lincoln Road Partnership and contracted to Washington
Avenue Association. Service will include a minimum of 60 hours/week,
free continuous loop operation on pedestrian mall right of way, stopping at
block ends with transfer opportunities at Washington. Lenox, and Meridian to
proposed shuttle and/or Metro-Dade buses. Drivers will be bilingual,
uniformed, and "hospitalitr' trained. Vehicles are battery powered, owned by
the City of Miami Beach and will be maintained, cleaned and insured by the
contractor. Service provides better access to businesses for elderly and disabled,"and encourafJl!s one-stop parking.
5) Contrad Supervision and Administration - 35,000
Paid to Washington Avenue Assodation for additional administrative and
supervision CQSts. ( $15,000 paid to MBOC for rent, supplies, etc.)
6) Marketing Adivities- $ 215,000
Marketing activities will include promotion and advertising projects including
print and electronic cooperative advertising, other print materials, development
of a comprehensive marketing plan and personnel for implementation of the
plan.

7) Supervision - $ 99,000
Operating expenses including salaty and benefits for a lead person and support
staff who will be responsible for administering the operations of the Lincoln
Road District.
8) Administration - $ 46,000
Rent, office supplies, telephones, insurance, audit services for the Uncoln Road

The Administration recommends that the City Commission adopt the attached resolution, creating
a special assessment district to be known as the Lincoln Road Management District Number Three
(District). The District generally encompasses the area along Lincoln Road from Cotlins Avenue
to Alton Road. A more detailed description of the area is enclosed as Exhibit "B" in the resolution
creating the District. A second resolution to set the required public hearing is also included in this
agenda. In compliance with Chapter 170, Florida Statutes, final ratification of the District shall be
subject to majority approval of the property owners within the District, at ~ special election to be
held within the District, prior to the final public hearing.
BACKGROUND:
Property owners in the area have expressed a desire to have additional security, sanitation,

resolution provides for the creation of the Lincoln Road Management District Number 3 for a one

CONCLUSION:
The City Commission should adopt the attached resolution, creating a special assessment district to
be known as the Lincoln Road Management District Number Three (District). In compliance with
Chapter 170, Florida Statutes, final ratification of the District shall be subject to majority approval
of the property owners within the District at a special election to be held within the District, prior
to the final public hearing.
