A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, FIXING A
TIME AND PLACE AT WHICH THE OWNERS OF THE
PROPERTIES SPECIALLY BENEFITTED BY THE
CREA TION OF A SPECIAL ASSESSMENT DISTRICT TO BE
KNOWN AS THE LINCOLN ROAD MANAGEMENT
DISTRICT NUMBER 3, FOR THE PURPOSE OF FUNDING
SECURITY, MAINTENANCE, AND RELATED SERVICES IN
THE AREA GENERALLY BOUNDED ALONG LINCOLN
ROAD FROM COLLINS A VENUE TO ALTON ROAD, ALL
LYING WITHIN THE CORPORATE LIMITS OF THE CITY
OF MIAMI BEACH, OR ANY OTHER PERSONS
INTERESTED THEREIN, MAY APPEAR BEFORE THE
CITY COMMISSION OF SAID CITY TO BE HEARD AS TO
THE PROPRIETY, ADVISABILITY AND COST OF
PROVIDING SUCH SERVICES, AGAINST EACH PROPERTY
SO BENEFITTED, SUCH HEARING TO BE HELD IN
. ACCORDANCE WITH SECTIONS 170.07-170.08 OF THE
FLORIDA STATUTES.
WHEREAS, Sections 170.01-170.21, Florida Statutes, allow for "the levy and collection
of special assessments against property benefitted for the purpose of stabilizing and improving retail
or wholesale business districts and/or nationally recognized historic districts for promotion,
management, marketing and other similar services in business districts of the municipality"; and
WHEREAS, by Resolution No. 96-22190 adopted on November 6, 1996, the
Mayor and City Commission determined that it is necessary for the welfare of the citizens of Miami
Beach to provide certain security, maintenance, and related services (Services) and created the
Lincoln Road Management District Number 3 for the purpose of funding the Services in the area
generally bounded along Lincoln Road from Collins Avenue to Alton Road; and
WHEREAS, Section 170.07, Florida Statutes, requires that a public hearing be held to hear
testimony of all property owners to be assessed and any other interested parties pertaining to the
propriety and advisability of providing such Services, the cost thereof, the manner of payment
therefore, and the amount thereof to be assessed against each property so benefitted within the
Lincoln Road Management District Number 3; and
WHEREAS, Section 170.08, Florida Statutes, provides that final consideration of the special
assessment will be given after hearing testimony from the affected property owners as to providing
the Services and funding them with special assessments, and further provides that following
testimony, the Mayor and City Commission of the City of Miami Beach shall make a final decision
on whether to levy the special assessment, and thereafter, the Mayor and City Commission shall
convene as an equalizing board to hear and consider all complaints that may be made as to the
amount of any particular special assessment and shall adjust and equalize the assessment on the basis
of justice and right, and when so equalized and approved, a final assessment roll shall be filed with
the City Clerk's Office and such assessment shall stand confirmed; and
WHEREAS, a preliminary assessment roll has been completed and filed of record with the
Clerk of the City of Miami Beach.
NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA:
Section I.
All findings and recitals contained in this Resolution are hereby adopted and
incorporated herein.
Section 2.
A public hearing is hereby scheduled to take place before the Mayor and City
Commission in the City Commission Chamber, 1700 Convention Center Drive,
Miami Beach, Florida December 4, 1996 at 11: 05 o'clock
a. m . The Mayor and City Commission shall hear testimony of all affected property
owners and those persons interested in the Lincoln Road Management District
Number 3.

CREATION OF HE LINCOLN ROAD MANAGEMENT DISTRICT,
SUBJECT TO M JORITY APPROVAL BY THE AFFECTED PROPERTY
OWNERS
ADMINISTRA TION RECOMMENDATION:
The Administration recommends that the City Commission adopt the attached resolution, creating
a special assessment district to be known as the Lincoln Road Management District Number Three
(District). The District generally encompasses the area along Lincoln Road from Collins A venue
to Alton Road. A more detailed description of the area is enclosed as Exhibit "B" in the resolution
creating the District. A second resolution to set the required public hearing is also included in this
agenda. In compliance with Chapter 170, Florida Statutes, final ratification of the District shall be
subject to majority approval of the property owners within the District, at ~ special election to be
held within the District, prior to the final public hearing.
BACKGROUND:
Property owners in the area have expressed a desire to have additional security, sanitation,
landscaping, and marketing services provided in order to help promote the area. The attached
resolution provides for the creation of the Lincoln Road Management District Number 3 for a one
year period and provide' the services as described below.
1) Security - $142,000
Overseen by the Lincoln Road Partnership, "Ambassador" service will be contracted to the
Washington Avenue Association and provided through private security detail. Coverage is 24 hours,
at least until after construction, and is scheduled to complement the coverage provided by assigned
on-duty police. Amount budgeted includes patrol bicycles.
2) Sanitation - $148,000
Overseen by the Lincoln Road Partnership, and contracted to the Washington A venue Association,
service will include mechanical and hand sweeping, pressure washing of pavements, graffiti and
illegal flyer removal, monitoring, and reporting. Category includes supervision, supplies, and

. 3) Landscaping - $90,000
Overseen by the Lincoln Road Partnership and contracted to the Washington A venue Association,
service will include working with the City of Miami Beach to maintain landscaping and fountains
in the District after the construction period and warranty period.
4) Tram - $65,000
Overseen by the Lincoln Road Partnership and contracted to the Washington A venue Association.
Service will include a minimum of 60 hours/week, free continuous loop operation on pedestrian mall
right of way, stopping at block ends with transfer opportunities at Washington, Lenox, and Meridian
to proposed shuttle and/or Metro-Dade buses. Driver's will be bilingual, uniformed, and
"hospitality" trained. Vehicles are battery powered, owned by the City of Miami Beach, and will be
maintained, cleaned, and insured by the contractor. Service provides better access to businesses for
elderly and disabled, and encourages one-stop parking.
5) Contract Supervision and Administration - $35,000
Paid to the Washington A venue Association for additional administration and supervision.
6) Marketing Activities - $215,000
Marketing Activities will include promotion and advertising projects including print and electronic
cooperative advertising, other print materials, development of a comprehensive marketing plan, and
personnel for implementation of the plan.
7) Supervision - $99,000
Operating expenses including salary and benefits for a lead person and support staff who will be
responsible for administering the operations of the Lincoln Road District.
8) Administration - $46,000
Rent, office supplies, telephones, insurance, audit services for the Lincoln Road District.

CONCLUSION:
The City Commission should adopt the attached resolution, creating a special assessment district to
be known as the Lincoln Road Management District Number Three (District). In compliance with
Chapter 170, Florida Statutes, final ratification of the District shall be subject to majority approval
of the property owners within the District at a special election to be held within the District, prior
to the final public hearing.
