2001-24691 Reso RESOLUTION NO. 2001-24691 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING AN EASEMENT FROM VENETIAN ASSOCIATES, A FLORIDA GENERAL PARTNERSHIP, AS THE OWNER OF THE PROPERTY LOCATED AT 10 VENETIAN WAY, FOR THE INSTALLATION, MAINTENANCE, CONSTRUCTION AND REPAIR OF WATER METERS AND APPURTENANCES ON SAID PORTION OF THE ABOVE MENTIONED PROPERTY, WHEREAS, Venetian Associates, a Florida general partnership, is the owner of the property located at 10 Venetian Way (The Property), legally described as Tract "E" of Belle Isle Southeast, as recorded in Plat Book 53 Page 24 of the Public Records of Miami-Dade County, Florida, and is developing said Property as the Grand Venetian Condominium; and WHEREAS, the water supply pipes and services to said development are located on Venetian Way, to the north of the Property; and WHEREAS, due to the limited width of the public right-of-way and pedestrian sidewalk on Venetian Way, the Administration has determined that water meters and appurtenances for the water services should preferably be installed on the Property; and WHEREAS, the Owner has agreed to grant the City a non-exclusive 10ft.xlOft. Easement on the Property, as described in the legal description attached hereto as Exhibit "A", for installation, maintenance and repair of said water meters and appurtenances. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission herein accept from Venetian Associates, as the owner of the Property located at 10 Venetian Way, an Easement as described in the attached "Exhibit A", as shall be reviewed and approved by the Administration and the City Attorney's Office. PASSED and ADOPTED this 19th day of 2001. Gonzalez ,~ City Manager ()' ~ U A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING A NEW GRANT OF EASEMENT FROM VENETIAN ASSOCIATES AND BILLDEN REAL TY,L.L.C., AS THE OWNERS OF THE PROPERTY LOCATED AT 10 VENETIAN WAY, FOR THE INSTALLATION, MAINTENANCE, CONSTRUCTION AND REPAIR OF WATER METERS AND APPURTENANCES ON SAID PORTION OF THE ABOVE MENTIONED PROPERTY. Date: December 19, 2001 SubJect: ADMINISTRATION RECOMMENDATION: Adopt the Resolution. BACKGROUND: The Grand Venetian, a condominium building being built at 10 Venetian Way, is located on Tract "E" of BELLE ISLE SOUTHEAST. The City's water main which will be supplying water to this project is located on Venetian Way to the north. Due to the limited width of the right-of-way and the 5 ft. width of the sidewalk abutting this project, installation of the water service valves and large meter box in the sidewalk would constitute a safety hazard. The owners of the development, Venetian Associates and Billden Realty, L.L.C. are providing the City with a 1 Oft.x1 Oft. easement on portion of Tract "E", as described in the attached easement document and legal description in Exhibit "A", for the installation, maintenance and repair of City water meters, meter boxes and appurtenances. ANALYSIS: The granted easement is a non-exclusive easement. The documents have been reviewed by the City Attorney's Office and Public Works Department. The owner will have to execute and record this easement with Miami-Dade County Clerk and transmit a recorded original of the easement document to the City Clerk. CONCLUSION: Recommend the City Commission accept the new grant of a 10ft. x 10ft. easement , granted by Venetian Associates and Billden Realty, L.L.C., as the owners of the property located at 10 Venetian Way, for the installation, maintenance, construction and repair of water meters and appurtenances on said portion of the above mentioned property.
