HomeMy WebLinkAbout2001-3342 ORD Ordinance No. 2001-33/+2 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA AMENDING CHAPTER 14 OF THE MIAMI BEACH CITY CODE BY AMENDING DIVISION 2 THEREOF ENTITLED" PERMIT FEES", BY AMENDING SECTION '14-65 THEREOF ENTITLED "MECHANICAL PERMITS", BY AMENDING APPENDIX A TO SECTION 14-65 ENTITLED "FEE SCHEDULE" TO PROVIDE FOR FEES FOR THE WITNESSING OF PERIODIC INSPECTIONS AND ACCEPTANCE TESTS BY AN ELEVATOR INSPECTOR EMPLOYED BY THE CITY OF MIAMI BEACH ONCE EVERY YEAR AND ONCE EVERY 5 YEARS; PROVIDING FOR REPEALER, SEVERABILITY, CODIFICATION, AND AN EFFECTIVE DATE. Whereas, the City of Miami Beach ("City") has been delegated authority by the State of Florida to issue elevator construction permits, temporary operation permits, certificates of operation, and to provide inspection of elevators, and to enforce all applicable provisions required under Chapter 399 of the Florida Statutes regarding elevator safety; and Whereas, The 2001 Florida Legislature enacted significant changes to Chapter 399, Florida Statutes, regarding elevator safety which shall take effect on January 1, 2002; and Whereas, changes to Chapter 399, Florida Statutes, regarding elevator safety require the witnessing of periodic inspections and tests by an elevator inspector employed by the City; and Whereas, inspections shall take place once every year and once every five years as required under Chapter 61C-5 Florida Elevator Safety Code, ASME A17.1, Part X, Section 1000, Rule 1000.1b, and American National Standard Safety Code for elevators and escalators; and Whereas, the City Administration recommends that the City Commission approve the proposed Ordinance which would amend Appendix A to Section 14-65 of the City Code entitled "Fee Schedule" as it relates to elevators, escalators, and other lifting apparatus inspection fees imposed in the City of Miami Beach by the Building Department; and Whereas, the new fees proposed are projected to generate additional revenues to the City of $148,500 annually; and Whereas, the proposed new fee for the witnessing of periodic inspections and tests will defray the cost of required additional inspection and clerical personnel. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1. AMENDMENT OF APPENDIX A TO SECTION 14-66 OF CITY CODE - CHAPTER 14. If no maintenance agreement is in effect August 1st of every year, the city inspection will be performed every year and above charges for the next fiscal year shall be 150% of the one shown in these tables. Witnessing of 1 -year tests per ASME A17.1, Dart X, section 1000, rule 1000,1b Witnessin<~ of 5-vear tests per ASME A17.1, Dart X, section 1000, rule 1000.1b Any elevator or escalator owner who fails to comply with the order to correct a violation issued within 60 days is subject to an administrative fine up to $500.00 in addition to any other penalty provided by law. Fines can be imposed for every 30 days period the violation remains active. These fines, before or after paid, can be appealed to the department director, whose decision shall be final. No clearance for the use of the elevator shall be given until these fines shall be paid or waived. The department director can delegate this appeal function to the department assistant director, the city building official or the deputy building official. 75.00 150.00 SECTION 2. REPEALER. All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION 3. SEVERABILITY. If any section, subsection, clause or provision of this Ordinance is held invalid, the remainder shall not be affected by such invalidity. SECTION 4. CODIFICATION. It is the intention of the Mayor and City Commission of the City of Miami Beach, and it is hereby ordained that the provisions of this ordinance shall become and be made part of the Miami Beach City Code. The Sections of this ordinance may be numbered or relettered to accomplish such intention, and the word "ordinance" may be changed to "section", "article," or other appropriate word. SECTION 5. EFFECTIVE DATE. This Ordinance shall take effect on the 1st day of January, 2002. ANALYSIS The City Administration recommends that the City Commission approve the proposed Ordinance which would amend Appendix A to Section 14-65 of the City Code entitled "Fee Schedule" as it relates to elevators, escalators and other lifting apparatus inspection fees imposed in the City of Miami Beach by the Building Department. The proposed amendment adds new inspection fees of $75 for witnessing of 1 -year tests and $150 for witnessing of 5-year tests by an elevator inspector employed by the City, as required under the 2001 Florida Statutes. The 2001 Florida Legislature enacted significant changes to Chapter 399, Florida Statutes, regarding elevator safety. The changes take effect on January 1, 2002. One important change that will affect elevator inspections requires the witnessing of periodic inspections and tests that take place once every year and once every five years as required under Chapter 61C-5 Florida Elevator Safety Code and ASME A17.1, Part X, Section 1000, Rule 1000.1 b, American National Standard Safety Code for elevators and escalators. The new fees proposed am projected to generate additional revenues of $148,500.00 during a 12-month period, which will defray the cost of providing for additional elevator inspection personnel for witnessing of periodic inspections and tests, and will meet the need to ensure that the quality of services and added safety to City residents remains high.
