A RESOLUTION OF THE MAYOR AND CITY CONmnSSION OF
mE CITY OF MIAMI BEACH, FLORIDA, GRANTING A
REVOCABLE PERMIT TO GOLDWATER REALTY VII, INC., AS
OWNER OF THE PROPERTY LOCATED AT 1766 BAY ROAD,
FOR THE CONSTRUCTION OF A HANDICAP RAMP, CONCRETE
STEPS, WALKWAY AND RAILINGS ON THE ADJACENT CITY
RIGHT-OF-WAY.
WHEREAS, GoldWater Realty VII, Inc. (the Applicant) owns the property located at
1766 Bay Road (the Property) ; and
WHEREAS, due to remodeling of the Property, which is built to the property line, a
handicap ramp, steps and railings are required by South Florida Building Code; and
WHEREAS, the Applicant is requesting to install such ramp, steps and railings in the City
right-of.way adjacent to the Property, and as such has applied for a Revocable Permit for the use
of said City right-of-way; and
WHEREAS, pursuant to Chapter 82, Article ill, Division 2, Section 82-93 of the City
Code, the Mayor and City Commission held a public hearing on December 19, 2001 to consider the
aforestated request.
NOW, THEREFORE, BE IT DULY RESOLVED BY mE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI B~CH, FLORIDA, that the Mayor and City
Clerk are herein authorized to execute a Revocable Permit in favor of GoldWater Realty VII, Inc.,
as owner of the property located at 1766 Bay Road, to instalI a handicap access ramp, steps and
railings within the City right-of-way abutting the aforementioned property, as shown in the attached
Exhibit "A".

Issue:
Shall the City grant a Revocable Permit to allow the owner of 1766 Bay Rd, to construct a handicap ramp
and walkways with a step and handrail?
Item Summary/Recommendation:
The existing building at 1766 Bay Rd.. which was built in 1957, extends to the lot line, Due to a recent
remodeling of the 1st floor, and in order to meet ADA and fire safety requirements, a landing with a handrail
had to be incorporated at every change in elevation at doors, and a ramp had to be provided for handicap
accessibility. To meet these requirements the owners are requesting the City for use of the parkway area
beyond the sidewalk, to install the ramp, steps, landing and handrails,
The Administration's recommendation Is to orant the requested Revocable Permit.

Adopt the Resolution.
BACKGROUND:
Chapter 82, Article III, Division 2, of the Miami Beach City Code addresses revocable
permits for the use of City right-of-way by adjacent property owners and establishes
guidelines for the Mayor and City Commission to grant or deny a revocable permit,
following a public hearing.
Goldwater Realty VII, Inc., owns the property located at 1766 Bay Road. The first floor of
this existing building is being remodeled to accommodate a neighborhood bar. In order to
meet accessibility and fire protection codes in this building, which was built in 1957 to the
property line, the owners are requesting the use of the adjacent parkway within the city
right-of-way, to install the required handicap ramp and concrete walkways with steps and
railings.
At the City Commission meeting of November 28, 2001 the public hearing was set for
December 19. 2001. Per City Code, notices have been mailed to the adjacent property
owners and advertised in the local newspaper.
ANALYSIS:
Pursuant to the City's Code, Chapter 82, Article III, Division 2, Section 82-94 for
Revocable Permits, the applicant's request, as presented in the application or amended
by the conditions recommended by the Administration, meets the following criteria:
1. The applicant holds title to the abutting property and has substantial need in providing
a handicap access ramp and walkways to the property from the sidewalk.
2. Granting this permit does not have an adverse effect on City futility easements or use
of public property.
3. The revocable permit is sought out of special circumstances and conditions that exist,
peculiar to the property and the need to accommodate Americans with Disabilities Act
(ADA) and safety requirements.
The right-of-way area covered by this Revocable Permit application is approximately 235
square feet as shown in the attached Exhibit "A".
CONCLUSION:
The Mayor and City Commission should adopt the resolution, granting a Revocable Permit
for the handicap access ramp and walkways with steps and railings as shown in Exhibit
"A".
