A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, FINDING AND DECLARING THE
EXISTENCE OF AN EMERGENCY AND ALLOWING THE POLICE
ATHLETIC LEAGUE (pAL), A NOT FOR PROFIT ENTITY, TO
UTILIZE THE PUBLIC SWALE AREA LOCATED AT DADE
BOULEVARD AND PRAIRIE AVENUE AND THE DADE BOULEVARD
VACANT LOT, LOCATED BETWEEN PRAIRIE AVENUE AND
MERIDIAN AVENUE, FOR A FUND-RAISING EVENT TO PROVIDE
ADDITIONAL PARKING AND OPERATE A FOOD CONCESSION
STAND, FROM FEBRUARY 14 - 19, 2002, FOR THE MIAMI
INTERNATIONAL BOAT SHOW; FURTHER PROVIDING THAT THE
DADE BOULEVARD VACANT LOT AND THE SW ALE BE UTILIZED
EXCLUSIVELY BY PAL SUBJECT TO THE FOLLOWING
CONDITIONS; (1) THAT 100% OF THE PROFITS GENERATED FROM
TillS FUNDRAISER BE RETURNED TO PAL FOR ITS EXCLUSIVE
USE; (2) THAT THE SUBJECT PERMISSION IS GRANTED WITHOUT
ESTABLISillNG A PRECEDENT, SO AS TO SATISFY TillS UNIQUE
EMERGENCY SITUATION; AND (3) THAT PAL RESTORE THE
PROPERTY TO SAME CONDITION AS BEFORE ITS USE BY PAL;
AND (4) THAT PAL PROVIDE A CERTIFICATE OF INSURANCE OR
OTHER PROOF OF INSURANCE TO THE CITY IN A FORM AND
AMOUNT(S) ACCEPT ABLE TO THE CITY'S RISK MANAGER.
WHEREAS, the Administration received a request from the Miami Beach Police
Athletic League (PAL), a not for profit entity, for permission to utilize the Dade Boulevard
Vacant Lot (the Lot) and the public swale area located at Dade Boulevard and Prairie Avenue
(the Swale) for a fund raising event to provide additional parking and for a food concession stand
for the Boat Show, from February 14th to 19th, 2002; and
WHEREAS, the Administration recommends approval of PAL's request subject to the
following conditions:
1. That all profits generated by this fund raising event go exclusively to PAL;
2. That the subject permission is granted without establishing a precedent so as to satisfy
the unique emergency situation created by a severe parking shortage in the City
during the Boat Show; and
3. That PAL restore the property to the same condition as before its use by PAL; and
4. That PAL provides the City with proof of insurance, as determined and accepted by
the City's Risk Manager, as a condition precedent to the City's granting of its
permission herein; and
WHEREAS, the Administration would herein recommend that the Mayor and City
Commission find that an emergency exists with regard to the scarcity of parking during special
events such as the Boat Show, and the need for increased parking during the duration of these
events, and therefore approve PAL's request, subject to the aforestated conditions, on a one time
emergency basis.
NOW THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, herein find and declare the
existence of an emergency and allow the Police Athletic League (PAL), a not for profit entity, to
utilize the public swale area located at Dade Boulevard and Prairie Avenue and the Dade
Boulevard vacant lot, located between Prairie Avenue and Meridian Avenue, for a fund-raising
event to provide additional parking and operate a food concession stand, from February 14 - 19,
2002, for the Miami International Boat Show; further providing that the Dade Boulevard vacant
lot and the swale be utilized exclusively by PAL subject to the following conditions; (1) that
100% of the profits generated from this fundraiser be returned to PAL for its exclusive use; (2)
that the subject permission is granted without establishing precedent so as to satisfy this unique
emergency situation; and (3) that PAL restore the property to the same condition as before its use
by PAL; and (4) that PAL provide a certificate of insurance or other proof of insurance to the
City in a form and amount (s) acceptable to the City's Risk Manager..

International Boat Show?
Item Summary/Recommendation:
The PAL is requesting permission to park cars on the Dade Boulevard vacant lot and operate a food
concession stand during the Miami International Boat Show, February 14-19,2002. The PAL will operate
with the condition that all profits generated by this fund-raising event will go to PAL and Miami Beach Sr.
High School. The PAL will obtain all permits required to operate a food concession stand and provide off-
duty police officers for traffic control. The PAL will also provide a certificate of insurance or proof of
insurance to the City,
The Administration recommends approval of this resolution.

ADMINISTRATION RECOMMENDATION
Adopt the Resolution.
ANALYSIS
The Miami Beach Police Athletic League (PAL) has requested permission to use the
private vacant lot, located at 775 Dade Boulevard, between Prairie Avenue and Meridian
Avenue, for parking of vehicles of persons who will be attending the 2002 Miami
International Boat Show, from February 14-19, 2002, and to use the Dade Boulevard swale
to place and operate a food concession from February 14-19, 2002.
The Miami International Boat Show, like other Special Events, increases the parking
problems that occur in the City. The use of this vacant lot for parking for this event would
ease the parking and create less of an inconvenience for those citizens who live in the.
area.

In addition, the Police Athletic League will:
1. Hire an off-duty police officer to direct traffic for the ingress and egress on Dade
Boulevard.
2. Restore the property in the same condition as it was before the use.
3. Obtain a General Liability Certificate of Insurance naming the City as an additional
named insured.
In addition, PAL requests authorization to operate a food concession stand on the Dade
Boulevard swale from February 14-19, 2002. The PAL will obtain any and all necessary
permits to operate a food concession stand.
It is recommended that the Mayor and City Commission adopt this Resolution to permit
PAL to use the properties which will ease the parking problems caused by the Boat Show
and raise the much needed funds.
