A RESOLUTION OF THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH,
FLORIDA, PERTAINING TO PAY FOR CITY
EMPLOYEES WHO ARE CALLED TO ACTIVE
MILITARY DUTY IN RESPONSE TO THE SEPTEMBER
11,2001 TERRORIST ATTACK AGAINST THE UNITED
STATES; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, on September 11, 2001, the United States of America was attacked by
terrorists; and
WHEREAS, in response to these acts of terror, George Bush the President of the United
States has called upon the Reserves of the Armed Forces of the United States and members of the
National Guard to protect United States' citizens, this Nation's freedoms and way oflife; and
WHEREAS, Jeb Bush, Governor of the State of Florida has requested that the state and
municipal governmental entities give support to National Guardsmen and Military Reservists; and
WHEREAS, the City of Miami Beach has been authorized by Chapter 115 of the Florida
Statutes to provide continued support to the employees who are called to military service; and
WHEREAS, the City of Miami Beach is proud and honored to support its loyal employees
and their efforts and acts of great courage in defending this Nation;
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that any City employee who
is involuntary called to active duty as an officer or enlisted person in the National Guard or Reserve
component of the Armed Forces of the United States in response to the September 11,2001, terrorist
attack against the United States shall be granted a leave of absence from his or her employment with
the City of Miami Beach. The employee will receive full pay from the City of Miami Beach for the
first thirty (30) days of his or her active military service and thereafter, will receive an amount equal
to the difference between his or her military pay and his or her City base pay, resulting in no loss of
income to the employee. If the employee's military pay is higher than his or her City base pay, the
employee shall not be entitled to any supplemental pay. There shall be no entitlement to overtime
compensatory time or holiday pay from the City while receiving this supplemental pay. Sick and
annual leave will accrue while this supplemental pay provision is in place. During the period of his
or her leave of absence, the employee shall continue to receive his or her medical and dental
coverage subject to the same tenus and conditions that the benefits are made available to similarly
classified employees. The supplemental pay and benefits shall be provided as long as the employee
remains on active duty status involuntarily, not to exceed one (1) year. The supplemental pay and
benefits may be extended beyond one (1) year at the sole and exclusive discretion of the City
Manager.

I Supplemental Military Pay
Issue:
To provide those employees called to active duty as a result of the September 11, 2001 terrorist attack with
supplemental pay, allowing them to receive an amount equal to the difference between his or her City pay,
resulting in no loss of income to the employee. This is in addition to the existing law that requires
employers to give full pay for the first thirty (30) days of active military service. This will be effective for one
year from September 12,2001 and may be extended at the discretion of the City Manager.

ANALYSIS
On September 11, 2001, the United States of America was attacked by terrorists and in
response to these acts of terror, George Bush the President of the United States has called
upon the Reserves of the Armed Forces of the United States and members of the National
