A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, CALLING A
PUBLIC HEARING TO CONSIDER PUBLIC COMMENT, AS
REQUIRED BY ORDINANCE NO. 92-2783, REGARDING
THE SALE OF THE CITY-OWNED PROPERTY LOCATED
AT 1920 WEST AVENUE AND 1923 BAY ROAD, MIAMI
BEACH, FLORIDA, TO PUBLIX SUPERMARKETS, INC.,
PURSUANT TO THE TERMS AND CONDITIONS OF RFP
NO. 139-94/95, FOR THE CONSTRUCTION AND
OPERATION OF A PUBLIX GROCERY SUPERMARKET.
WHEREAS, in response to the need expressed by the Miami Beach community for a new,
first-rate supermarket that would serve the residents of and visitors to the City, the Mayor and City
Commission have deemed that a public purpose exists, and that the public interest would be served
by a public/private joint effort in the development of a new supermarket in the South Beach area;
and
WHEREAS, on November 2, 1994, the Mayor and City Commission approved Resolution
No. 94-21397, authorizing the Mayor and City Clerk to execute a Purchase and Sale Agreement
between the City and Florida Power and Light Company (FPL) for purchase by the City of an FPL-
owned site located at 1920 West Avenue and 1923 Bay Road, Miami Beach, Florida (Subject
Property), in the amount of $1 ,500,000.00, such property to be used for the development of a new
supermarket which would serve the needs of residents and visitors to the City; and
WHEREAS, in conjunction with the City's purchase of the Subject Property, the Mayor and
City Commission also approved Request for Proposals No. 139-94/95 (the RFP), for submittal of
proposals for the purchase or lease of the Subject Property, for the purpose of building and operating
a full service supermarket facility, including required parking; and
WHEREAS, at its regular meeting on November 22, 1995, the Mayor and City Commission
accepted the recommendation of a selection committee convened on November 17, 1995, accepting
the response submitted by Public Supermarkets, Inc.(Publix); and
WHEREAS, pursuant to its proposal, Publix intends to purchase the Subject Property for
the sum of $2,400,000.00 for the construction and operation of a Publix grocery supermarket
containing approximately 47,955 square feet; and
WHEREAS, pursuant to Ordinance No. 92-2783, which establishes procedures for the sale
and/or lease of City property, prior to the sale and/or lease of City property, the Mayor and City
Commission shall hold a public hearing, advertised not less than fifteen days prior to the hearing,
in order to obtain citizen input into the proposed sale and/or lease.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that a public hearing to hear
public comment regarding the sale of the City-owned property located at 1920 West Avenue and
1923 Bay Road, Miami Beach, Florida, to Publix Supermarkets, Inc., pursuant to the terms and
conditions ofRFP No. 139-94/95 for the construction and operation of a Publix grocery supermarket,
is hereby called to be held before the Mayor and City Commission in its chambers on the third floor
of City Hall, 1700 Convention Center Drive, Miami Beach, Florida on Tuesday, February 20, 1996
beginning at 2:30 p.m., and the City Clerk is hereby authorized and directed to publish appropriate
public notice of the said public hearing in a newspaper of general circulation in the City of Miami
Beach, at which time and place all interested parties will be heard.

RESOLUTION ALLING A PUBLIC HEARING TO HEAR PUBLIC
COMMENT REGARDING AN AGREEMENT TO PURCHASE REAL ESTATE
BETWEEN THE CITY AND PUBLlX SUPERMARKETS, INC.
SUBJECT:
On November 22, 1995, the Mayor and City Commission accepted the proposal
received by Publix Supermarkets, Inc. in response to Request for Proposal 139-94/95 for the
development of a new supermarket which would serve the needs of residents and visitors to
the City. Accordingly, the Administration and City Attorney's Office have entered into
negotiations with Publix and are currently in the process of negotiating an Agreement to
Purchase Real Estate (Agreement) wherein Publix proposes to buy the City-owned site at 1920
West Avenue and 1923 Bay Road, for the sum of $2.4 million, to be used for the construction
and operation of a Publix grocery supermarket containing approximately 47,955 square feet.
In conjunction with the submittal of the final Agreement to the Mayor and City
Commission for their consideration, the City must also comply with the procedures set forth
in Ordinance No. 92-2783, governing the sale and/or lease of City-owned property. As the
Ordinance requires that, prior to the sale and/or lease of City property, the City Commission
shall hold a public hearing advertised not less than fifteen (15) days prior to the hearing in
order to obtain citizen input as to the proposed sale and/or lease, the attached resolution
requests that such a public hearing be called for the City Commission meeting of February 7,
1996.
