A RESOLUTION AMENDING RESOLUTION NO. 93-20957, A
RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA, CREATING -THE POLICEIPUBLIC
SAFETY COMMITTEE AND PRESCRIBING THE MEMBERSHIP, THE
QUALIFICATIONS OF THE MEMBERS, THE TERMS OF OFFICE, THE
ORGANIZATION OF THE COMMITTEE, AND ITS DUTIES, FUNCTIONS,
POWERS, AND RESPONSIBILITIES, AND PROVIDING VOTING RIGHTS
TO THE NON-ADMINISTRATIVE PERSONNEL REPRESENTATIVE OF
THE POLICE DEPARTMENT.
WHEREAS, the Mayor and City Commission of the City of Miami Beach, Florida, has
determined that a Police/Public Safety Committee is desirable to serve the interests of the City in
order to improve the public's confidence in police community relations; and
WHEREAS, the Mayor and City Commission desire to establish this advisory Committee
and establish the Committee's mission as outlined below.
NOW, THEREFORE, be it Resolved by the Mayor and City Commission of the City of
Miami Beach, Florida, that:
1) The Police/Public Safety Committee is hereby created. The Committee shall consist of
twelve (12) voting members. The Mayor and City Commissioners, shall each make one (1)
individual appointment. Four (4) additional appointments shall be made by a majority vote
of the entire Commission.
One (1) additional voting member shall be the non-administrative personnel of the Police
Department selected by majority vote of the non-administrative personnel. Three (3)
additional non-voting members shall be the Police Chief (or a designee); one member
selected by the City Manager and the City Attorney respectively.
Recommendations for appointment to all voting and non-voting memberships selected by
the Mayor and Commission shall be encouraged to be obtained from the Spanish American
League Against Discrimination (S.AL.AD.); the League of United Latin American Citizens
(L.U.L.A.C.); the Anti-Defamation League (AD.L.); the Dade ActionPac; the National
Association for the Advancement of Colored People (N.AAC.P.); the League of Women's
Voters, and any other organizations deemed appropriate.
2) The voting members ofthe Committee shall be permanent residents of or have their principal
place of business in the City of Miami Beach and have knowledge of and interest in police
community relations and their impact on the City of Miami Beach.
3) All appointments of members shall be made for a one (1) year term. Appointments to fill
any vacancy on the Committee shall be for the remainder of the unexpired term of office.
A member may be removed without cause at any time at the sole discretion of the Mayor and
City Commission by a majority vote of the entire membership of the City Commission.
When any member of the Committee fails to attend three (3) regularly scheduled meetings
during the term of office, without due cause, the Chairperson shall certify the same to the
City Clerk. Such member shall then be deemed to have been removed and a vacancy
created.
4) On an annual basis, the members of the Committee shall elect a Chairperson and such other
officers as may be deemed necessary or desirable, who shall serve at the will of the
Committee. Seven (7) voting members of the Committee shall constitute a quorum. A
majority vote of a quorum of the Committee shall be necessary in order to take any action.
The Committee shall establish by-laws for the matters of business to be addressed by the
Committee, such by-laws to be approved by the Mayor and Commission. Members shall
serve without compensation. Committee meetings may be called by the Chairperson or by
written notice signed by five (5) members of the Committee.
Additionally, the committee, at any meeting, may call a meeting to be held on a future date.
All meetings shall be public, and subject to the Government in the Sunshine and Public
Records laws of Florida.
5) The Police/Public Safety Committee shall have the following duties, functions, powers, and
responsibilities:
a) To serve in an advisory capacity to the City Commission and the City
Administration of the City of Miami Beach, Florida with respect to matters
pertaining to police community relations and their impact on the community
of the City of Miami Beach.
b) To formulate and recommend plans and programs relating to community
relations, and to review and make recommendations regarding the Police
Department budget.
c) Members shall be encouraged to participate in the "Ride Along" program of
the Department.
d) It is the express purpose of this Committee to serve as a vehicle for
responsible persons to understand and resolve the concerns of the residents
of the City of Miami Beach with regard to police community relations, and
to make recommendations to the City Commission and City Administration
regarding such matters.
e) To perform such other duties as may from time to time be assigned to it by
the City Commission.
6) All Committee activities shall be in accord with all statutory and contractual guidelines and
requirements, including collective bargaining agreements and the "Police Bill of Rights".

ADMINISTRATION RECOMMENDATION:
That the City Commission pass and adopt the attached Resolution amending Resolution No. 93-20957.
BACKGROUND:
Chairman David Alschuler and Vice Chairman/Secretary Rem Cabrera, on behalf of the Miami Beach Police
Public Safety Committee, have requested that Resolution No. 93-20957 be amended to provide voting rights
to two additional members of the Police Public Safety Committee--the Police Chief (or designee) and the non-
administrative personnel representative of the Police Department--in order for the Committee to achieve its
fullest potential.
