A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA, APPROVING AMENDMENT NO.1 TO THE AGREEMENT WITH
THE ARCHITECTS PARTNERSHIP OF BROWN & BROWN IN THE AMOUNT OF
$70,000, FOR ADDITIONAL SERVICES ON THE ROOF REPAIRlREPLACEMENT
PROJECT AT THE MIAMI BEACH CONVENTION CENTER AND THE JACKIE
GLEASON THEATER OF THE PERFORMING ARTS, AND FURTHER APPROPRIATING
THE FUNDING IN SAID AMOUNT.
WHEREAS, on July 8, 1996, a Professional Services Agreement (the Agreement) was executed between the
City and The Architects Partnership of Brown & Brown (Brown & Brown), to develop construction documents for the
repair/replacement of the roofs at the Miami Beach Convention Center and the Jackie Gleason Theater for the
Performing Arts (the Project); and
WHEREAS, on October 28, 1998, a Blue Ribbon Committee, convened by the Administration, as directed
by the Mayor and City Commission, recommended award of the Project, as designed by Brown & Brown, and also
recommended that a full time inspector be assigned to oversee the construction of the Project, in addition to the
construction administration responsibilities of Brown & Brown; and
WHEREAS, the Administration was directed by the Mayor and City Commission, at the recommendation of
the Blue Ribbon Committee, to retain a full time Certified Roofing inspector; and
WHEREAS, the Administration is herein requesting approval of the appropriation of the funding required
for the full time Project inspector, in the amount of $70,000, and would accordingly recommend that the Mayor and City
Commission approve the attached Amendment No. I and the Agreement.
NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission herein authorize the appropriation of funding
necessary for the full time Project inspector, in the amount of $70,000, for the replacement of the roofs at the Miami
Beach Convention Center and the Jackie Gleason Theater of the Performing Arts, and further approve and authorize
the Mayor and City Clerk to execute the attached Amendment No. I to the Agreement between the City and The
Architects Partnership of Brown & Brown for the completion of the Roof Repair/Replacement Project at the Miami
Beach Convention Center and the Jackie Gleason Theater of the Performing Arts.

APPROPRIATING THE FUNDING FROM THE GENERAL FUND
RESERVE FOR CAPITAL IMPROVEMENTS.
RECOMMENDATION:
Adopt the Resolution.
FUNDING:
Funds are available in the General Fund Reserve for Capital Improvements ($35 million County
Interlocal Agreement) and will be transferred to a work order established in the Convention Center
Enterprise Fund.
BACKGROUND:
On July 8, 1996 an agreement for professional services was executed between the City and The
Architects Partnership of Brown & Brown (Brown & Brown), to develop construction documents
for the repairs/replacement of the roofs at the Miami Beach Convention Center and The Jackie
Gleason Theater of the Performing Arts.
At the November 4, 1998, Commission meeting, the Mayor and City Commission awarded a
contract to Weiss and Woolrich Southern Enterprises, Inc. (Weiss & Woolrich), in the amount of
$7,245,000, pursuant to bid no. 44-97/98, for the replacement of the roofs at the Miami Beach
Convention Center and the Jackie Gleason Theater of the Performing Arts. In addition, the Blue
Ribbon Committee recommended that the City retain the services of a full time inspector to oversee
the construction.

ANALYSIS:
The Administration is now requesting approval of Amendment No. 1 to the agreement with Brown
& Brown in the amount of $70,000 for the hiring of a full time inspector as recommended by the
Blue Ribbon Committee (Attachment No.1).
CONCLUSION:
The Mayor and the City Commission should approve Amendment No. 1 to the agreement with The
Architects Partnership of Brown & Brown, for additional professional services for the replacement
of the roofs at the Miami Beach Convention Center and the Jackie Gleason Theater of the
Performing Arts and further appropriate the necessary funding in the amount of $70,000.

Mr. Chartrand;
As a follow up to our letter of March 11- t 999, and based on the Blue Ribbon
Committee's recommendations, we are hereby submitting our finn's proposal for the now
requested Construction Monitoring.
We have interviewed qualified personnel in the field and have been able to locate an
extremely qualified person who is presently available. He is a licensed roofer with field
inspection experience fOr a large membrane manufacturer and with a degree in
Construction Management. He would be employed and report directly to us and be full
time in the: field.
B&B's Alberto Llorente our Roofing Projects Coordinator will directly supervise his
work to guarantee the construction methods as per our design and specifications. Having
our regular construction administration with this full time field monitoring under OUI
direct supervision will go a long way in protecting the owner with regards to the actual
installation of the new roof as well as with the ext~iv~ coordination which will be
required in phasing the construction with the operation of the facilities.
Our fee proposal for the required Construction Monitoring service is as follows:
-Full time 40 hOurs/week for the contract construction period- $10,000.00
-Additional overtime monitoring, evenings and week ends at $45/hour (this
additional time would be approved by your office prior to the work been
performed).

Since time is of the essence for the project and the contractor has begun his preliminary
work and our monitor is presently available please advise as soon as you can regarding
this proposal in order that we may make the necessary commitments and begin the
monitoring and coordination effort.

This AmendmentNo. 1, dated as of Ytft t~ ,1999, to that certain Agreement, dated
July 8, 1996, by and between the City of iami Beach, Flonda (CIty) and The ArchItects
Partnership of Brown & Brown (Consultant).
WHEREAS, the Agreement provides for the preparation of a Phase I, Evaluation and Scope
of Work Definition for the Roof Repairs/Replacement at the MBCC and TOPA; and
WHEREAS, the Agreement also provides for a Phase II, preparation of Construction
Documents, Specifications, Bidding and Construction Administration upon completion of Phase I;
and
\-VHEREAS, Phase I and Phase II have been completed, the Project was bid and awarded,
and it is now in construction; and
WHEREAS, the Administration was directed by the Mayor and City Commission, at the
recommendation of the Blue Ribbon Committee, to retain a full time Project inspector; and
1. ABOVE RECITALS
The above recitals are true and correct and are incorporated as a part of this First
Amendment.
2. MODIFICATIONS
The Agreement is amended to add the following additional services:
a. Exhibit "A-I," entitled Scope of Services/Compensation for Additional
Services relative to additional fees for the hiring of the Project Inspector
recommended by the Blue Ribbon Committee.
3. OTHER PROVISIONS.
All other provisions of the Agreement, as amended, are unchanged.
4. RATIFICATION.
The City and Consultant ratify the terms of the Agreement, as amended, as modified by this
First Amendment.
IN WITNESS WHEREOF, the parties hereto have caused this First Amendment to be
executed in their names by their duly authorized officials as of the date first set forth above.
