A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE AN AMENDMENT TO THE AGREEMENT BETWEEN THE CITY AND
BELLSOUTH, DATED DECEMBER 17,1996, TO PROVIDE AN EXTENSION OF
THE BELLSOUTH SERVICE AGREEMENT FOR THE FRAME RELAY CIRCUIT
USED BY THE CITY OF MIAMI BEACH POLICE DEPARTMENT, 1100
WASHINGTON A VENUE, TO ACCESS METRO-DADE'S FINGERPRINT
SERVICE (PRINTTRAC), IN AN AMOUNT NOT TO EXCEED $11,327.76, FOR
A TWO (2) YEAR TERM, COMMENCING ON DECEMBER 18, 1998, AND
ENDING ON DECEMBER 17, 2000.
WHEREAS, the City's Agreement with BellSouth for provision of the Frame Relay
Service expired as of December 17, 1998; and
WHEREAS, the City, in order to maintain current service, and obtain reduced pricing has
to extend the Agreement for another two year (2) term; and
WHEREAS, BellSouth has agreed to extend the Agreement at the sixty (60) month
reduced rate of $471.99 per month, at a savings of $57.15 per month; and
WHEREAS, the attached Agreement, in an amount not to exceed $11,327.76, for a two
(2) year term, commencing on December 18, 1998, and ending on December 17, 2000, was
agreed upon by BellSouth and the City; and
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Clerk are authorized to execute the attached Agreement with BellSouth for Frame Relay Circuit
Service for the Police Department, 1100 Washington Avenue, in an amount not to exceed
$11,327.76, for a two (2) year term, commencing on December 18, 1998, and ending on
December 17, 2000.

Dear Julia:
It was a pleasure to spend time with you on Monday at our Enterprise Seminar. I hope that your time spent
with us was meaningful.
I want to take this opportunity to bring to our attention a contract for service which expires in January. It is
the Frame Relay Circuit that the Police Department uses to access the Metro-Dade County's Fingerprint
service (PrintTrac). The billing number for this account is W81-5037. The original contract was for 24
months. You presently pay $529.14 a month for the service.
Under the Florida Tariff, I can offer you what is called "recognition of prior service." In essence what this
means is that I can offer you 60-month rates for extending the service for another 24-36 months. The new
rate is $471.99 per month, or a saving to the City of $57.15 per month. I am enclosing a copy of the
original contract, as well as a new contract.
Since I don't know how long it will take you to process this, I am giving you ample lead time. Please feel

CONTRACT AMOUNT AND FUNDING
The total for the twenty-four (24) month contract is $11,327.76 with a monthly rate of$471.99.
Funding is available from the Information Technology Internal Services Fund 550.1750.000316.
BACKGROUND
The Frame Relay Circuit Service required by the Police Department, 11 00 Washington Avenue, for
access to the Miami-Dade County's Fingerprint Service (PrintTrac) is a local service between the
City of Miami Beach and Miami-Dade County. As such, the local service provider is BellSouth
Business Systems, Inc., as a sole source under the Florida General Subscriber Services Tariff
(GSST). The BellSouth Business Systems, Inc., and the City of Miami Beach negotiated a two (2)
year agreement on December 17, 1996. This agreement expired on December 16, 1998. BellSouth
has offered to extend the service for an additional two (2) years under the Florida General Subscriber
Services Tariff (GSST) "recognition of prior service" provision. This permits BellSouth to provide
their service to the City on a reduced sixty (60) month basis. In order to maintain our current level
of service and take advantage of the reduced pricing, the extension of this agreement has to be
approved.

In recognition of prior service with Bell South, the City of Miami Beach is being allowed to recast
their prior two (2) year contract for another twenty-four (24) months based on the sixty (60) month
rate.
The City's present cost of $529.14 per month will be significantly reduced to $471.99 per month
utilizing the sixty (60) month rate. The new contract extension will therefore result in a savings of
$57.15 per month to the City during the term of the contract.
CONCLUSION
The Mayor and City Commission should adopt the attached resolution allowing for the provision
of Frame Relay Service by BellSouth for another two (2) years, commencing on December 17, 1998,

FRAME RELAY SERVICE
AGREEMENT
The undersigned Subscriber requests BellSouth Telecommunications, Inc,
("Company") to provide Frame Relay Service and Broadband Exchange Line
Service at the following subscriber's location(s): 1100 Washington
Avenue, Miami Beach.
Important tariff provisions relating to Frame Relay Service and
Broadband Exchange Line Service are set forth herein:
1. The Company will furnish, install, maintain and provide
maintenance for Frame Relay service (" Service") and Broadband
Exchange Line Service ( "Service" ) in accordance wi th the
Company's lawfully filed tariffs. The tariffs provide the basis
for this Agreement with the Subscriber. The Agreement period
shall begin the day Frame Relay Service is installed,
2. The Subscriber agrees to pay the Company for the. provision of the
Frame Relay Service ("Service") and Broadband Exchange Line
Service (" Service") The Service shall be offered for variable
rate periods of 12 months to 60 months. This monthly rate will
continue for the elected service period and will not be subject
to Company initiated change during such period.
The monthly rates for Frame Relay Service and Broadband Exchange Line
Service in effect at the time the Service is installed and/or as of
the service order application date will be in effect until the
expiration of the service period chosen by the Subscriber, Other
rates applicable to other services provided by the Company, including
but not limited to, feature charges and private line channel services,
that are connected to Frame Relay Service, may be increased during
this period.
3. The service period for this Agreement shall be 24/36 months.
The rates and charges, per month, for items under this Agreement
are:

4. In the event that any item of the Service is terminated prior to
the expiration of the service period, the Subscriber shall pay a
Termination Liability Charge as specified in the tariff. The
Termination Liability Charge is determined by multiplying the
number of months remaining in the contract paYment period by the
contracted monthly rate by 90 percent.
5. At the expiration of the service period, the

currently in effect for month-to-month rates. Service periods

6. Suspension of service is not permitted for Frame Relay Service or
Broadband Exchange Line Service.
7. The Subscriber agrees to pay any added costs incurred by the
Company due to a Subscriber initiated change in the location of
the Frame Relay Service prior to the time it is placed in
service.
8. In the event the Service requested by the Subscriber is canceled
prior to the establishment of Service, but after the date or
ordering reflected herein, the Subscriber is required to
reimburse the Company for all expenses incurred in handling the
request before the notice of cancellation is received. Such
charge however, is not to exceed the sum of all charges which
would apply if the work involved in complying with the request
had been completed.
9. Subj ect to the current provisions of applicable tariffs, the
Subscriber may arrange to have existing Service under this
Agreement moved within the same premises. Subscriber agrees to
pay a non-recurring charge based upon the estimated cost of such
rearrangement without interruption or change in the monthly
rates.
10. Service may be transferred to another Subscriber at the same
location upon prior written concurrence of the Company. The new
Subscriber to whom the Service is transferred will be subject to
all tariff provisions and equipment configurations currentl~ in
effect for the present Subscriber.
This Agreement is effective when executed by the Subscriber and
accepted by the Company, and is subj ect to and controlled by the
provisions of the Company I s lawfully filed tariffs, including any
changes therein as may be made from time to time.
