98-22865 RESO RESOLUTION NO. 98-22865 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ADOPTING THE DADE COUNTY CANVASSING BOARD'S CERTIFICATION OF THE RESUL TS OF THE CITY OF MIAMI BEACH SPECIAL ELECTION HELD ON SEPTEMBER 1, 1998 AND DECLARING RESULTS THEREOF. WHEREAS, by Resolution No. 98-22813, adopted on July 1. 1998, Dade County Elect;')n Officials were authorized to conduct the Special Election of the City of Miami Beach to be held on September 1, 1998; and WHEREAS, on September 1, 1998, Metropolitan Dade County conducted a First Primary Election, at which time the City of Miami Beach authorized the holding of a Special Election; and WHEREAS, the Certification of the results of the City of Miami Beach Special Election as submitted by the Metropolitan Dade County Canvassing Board, said certification being dated September ~, 1998, has been received and is made a part of this resolution; and WHEREAS, said Certification reflects that the Special Election Ballot Question was Defeated by the electorate of the City of Miami Beach. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that said Certification be and the same is hereby adopted, which reflects the following result upon the question: GENERAL EMPLOYEES RETIREMENT SYSTEM PENSION BOARD: DELETING SPECIFIC RESTRICTIONS ON BOARD'S ALLOCA TION/INVESTMENT OF FUNDS. SHALL ARTICLE VI, SECTION 31 OF THE RELATED SPECIAL ACTS OF THE CITY OF MIAMI BEACH, FLORIDA, BE AMENDED TO DELETE SPECIFIC RESTRICTIONS CONCERNING PENSION BOARD INVESTMENT AND ALLOCATION, AND TO SUBSTITUTE THEREFOR LANGUAGE AUTHORIZING THE PENSION BOARD TO EXERCISE (IN A PRUDENT MANNER) INDEPENDENT JUDGMENT IN ALLOCATING AND INVESTING FUNDS; AUTHORIZING THE MIAMI BEACH CITY COMMISSION TO ESTABLISH BY ORDINANCE PENSION BOARD INVESTMENT GUIDELINES AND RESTRICTIONS. ADMINISTRATION RECOMMENDATION Adopt the Resolution. BACKGROUND: Pursuant to Resolution No. 98-22813 approved at the July 1, 1998 Commission Meeting, a Special Election was held on September 1, 1998 for the purpose of submitting to the electorate of the City of Miami Beach for their approval or disapproval, an amendment to Article VI, Section 31 of the Related Special Acts of the City of Miami Beach, Florida, to delete specific restrictions concerning Pension Board Investment and Allocation, to substitute therefor language authorizing the Pension Board to exercise (in a prudent manner) independent judgement in allocating and investing funds, and additionally, to authorize the Miami Beach City Commission to establish by ordinance Pension Board investment guidelines and restrictions.
