RESOLUTION No. 98-22878
A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH,
FLORIDA, ADOPTING THE SECOND AMENDMENT TO THE BUDGET AND APPROPRIATING FUNDS FOR
THE POLICE SPECIAL REVENUE - CAPITAL ACCOUNT FOR FISCAL YEAR 97/98, IN THE AMOUNT
OF $7,936.00, SUCH ACCOUNT FUNDED BY UNCLAIMED EVIDENCE CURRENTLY HELD IN THE
POLICE SPECIAL REVENUE - CAPITAL ACCOUNT.
WHEREAS, Section 705.105, Florida Statutes, "Procedures for Unclaimed
Evidence", provides that title to unclaimed evidence in the custody of the court
from a criminal proceeding or seized as evidence by and in the custody of a law
enforcement agency, shall vest permanently in the law enforcement agency sixty
(60) days after the conclusion of the proceedings; and
WHEREAS, such funds have been in the custody of the Police Property
Management Unit past the sixty (60) day waiting period, and these funds have now
been placed in the Police Special Revenue - Capital Account Fund, as provided by
Resolution No. 90-19931, adopted on March 7, 1990.
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA, THAT $7,936.00 WHICH IS CURRENTLY BEING HELD IN THE
POLICE SPECIAL REVENUE - CAPITAL ACCOUNT BE APPROPRIATED FOR THE FUNDING OF THE
SECOND AMENDMENT TO THE OPERATING BUDGET FOR THE 1997/98 FISCAL YEAR FOR THE
PURCHASE OF ITEMS LISTED ON EXHIBIT "A";

INSTALLATION OF A PROXIMITY CARD READER in Room 370
of the Criminal Investigation Division where the
NCIC (National Crime Information Center) terminals are
located. State of Florida statutes requires these
terminals to be well secured.
LOCKERS FOR THE LADIES AND MENS REST ROOMS IN THE
PSCU AREA to replace the old lockers which had to
be removed to bring these facilities within the
guidelines of the American Disabilities Act (ADA).
SUPPLIES FOR THE ARSON INVESTIGATORS
INCLUDING protection boots, helmets, coveralls,
respirators and gloves.
TO FURNISH AND INSTALL A GLASS DOOR at the new
"Neighborhood Crime Watch Office in the Community
Room of the Police station
TWO (2) PICNIC TABLES for the Public Safety
Communication Unit (PSCU).
REPLACEMENT OF CARPET in the old Crime Scene and
Budget Units now housing the Off-Duty Staff and
the Court Liaison Sergeant

SECOND ENDMENT TO THE POLICE SPECIAL REVENUE - CAPITAL
ACCOUNT FOR FISCAL YEAR 1997/98.
ADMINISTRATION RECOMMENDATION
Adopt the Resolution.
BACKGROUND
Florida Statute 705.105 "Procedure for Unclaimed Evidence" provides
that unclaimed evidence in the custody of the court from a criminal
proceeding, or seized as evidence by and in the custody of a law
enforcement agency shall become the property of that law
enforcement agency 60 days after the conclusion of the proceedings.
In March 1990 a special account was established, titled "Police
Special Revenue - Capital Account" in the Special Revenue Fund.
Funds for this account are made available in the Police Property
Management Unit, as unclaimed evidence, in accordance with Florida
Statute 705.105, outlined aoove.
ANALYSIS
In accordance with Florida Statute 705.105, unclaimed evidence
totaling $7,936.00 has been in the custody of the Police Property
Management Unit past the sixty (60) day waiting period. These
funds have now been placed in the Police Special Revenues - Capital
Account Fund, as provided in Resolution 90-19931, passed on March
7, 1990.
CONCLUSION
The Administration recommends that the Mayor and City Commission
adopt the Second Amendment to the budget for the Police Special
Revenue- Capital Account, and appropriate the amount of $7,936.00
to provide funds for the purchase of miscellaneous items for the
Police Department (Exhibit "A").
