RESOLUTION NO. 2002-24718
A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA,
REAFFIRMING SUPPORT FOR THE MIAMI-DADE
COUNTY HUMAN RIGHTS ORDINANCE ENACTED
DECEMBER 1, 1998 AND URGING THE MIAMI-DADE
COUNTY COMMISSION TO STAND FIRMLY BEHIND THE
MIAMI-DADE COUNTY HUMAN RIGHTS ORDINANCE.
WHEREAS, on December 2, 1992, the Miami Beach City Commission unanimously passed
Ordinance No. 92-2824 which created the Miami Beach Human Rights Ordinance which prohibited
discrimination in employment, housing, and public accommodations on the basis of sexual
orientation; and
WHEREAS, on October 7, 1998, the Mayor and City Commission of the City of Miami
Beach passed Resolution No. 98-22935 which urged the Miami-Dade County Commission to adopt
provisions in the Miami-Dade County Human Rights Ordinance to prohibit discrimination in the
County on the basis of sexual orientation in housing, credit and finance, public accommodations, and
employment; and
WHEREAS, on December 1, 1998, the Miami-Dade County Commission enacted
Ordinance No. 98-170 amending its Human Rights Ordinance to prohibit discrimination based on
sexual orientation in housing, credit and finance, public accommodations, and employment; and
WHEREAS, by virtue of a Special Election held on November 6, 2001, the citizens of
Miami Beach expressed their support for domestic partner benefits by the passage of two ballot
questions approving amendments to the City Code to provide health plan benefits for domestic
partners of City employees and to provide beneficiary and survivor benefits for domestic partners
of members of the City's Police and Fire Pension Fund; and
WHEREAS, in the Special Election held on November 6, 2001 in the City of Miami Beach,
the voters passed a ballot question approving the amendment of Section 27 of the City's Related
Special Acts to provide health plan benefits for domestic partners of City employees; and
WHEREAS, in the Special Election held on November 6, 2001 in the City of Miami Beach,
the voters passed a ballot question approving the amendment of the City's Police and Fire Pension
Fund contained in Article IX of the City's Related Special Acts to include beneficiary and survivor
benefits for domestic partners; and
WHEREAS, on December 19, 2001, the City Commission of the City of Miami Beach
unanimously passed Ordinance No. 2001-3337 amending the City's Police and Fire Pension Fund
contained in Article IX of the City's Related Special Acts to provide beneficiary and survivor
benefits for domestic partners of City employees; and
WHEREAS, on December 19, 2001, the City Commission of the City of Miami Beach also
unanimously passed Ordinance Nos. 2001-3338 and 2001-3339 which amended Chapters 62 and 78
of the City Code to provide for a definition of and health plan benefits for domestic partners of City
employees; and
WHEREAS, the Mayor and City Commission of the City of Miami Beach wish to reaffirm
their continued strong support for the Miami-Dade County Human Rights Ordinance and their desire
for the Miami-Dade County Commission to stand firmly behind the Miami-Dade County Human
Rights Ordinance.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that their support for the Miami-
Dade County Human Rights Ordinance is hereby reaffirmed and that the Miami-Dade County

Commission is hereby urged to stand firmly behind the Miami-Dade County Human Rights
Ordinance.
