A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING
THE MAYOR AND CITY CLERK TO EXECUTE THE
ATTACHED RELEASE AND SATISFACTION OF SUBSIDY
AGREEMENTS FOR THE FOllOWING PROPERTIES: 629
LENOX AVENUE, 221 COLLINS AVENUE, 1220
MARSEillES DRIVE, 1946 MARSEILLES DRIVE, 1244
PENNSYLVANIA AVENUE, AND 345 COLLINS AVENUE.
WHEREAS, on February 8, 1994, the City entered into a Multi-Family Housing
Rehabilitation Matching Grant Agreement (Subsidy Agreement) with Douglas Gardens
Community Mental Health Center of Miami Beach, Inc. for the building located at 629
Lenox Avenue, Miami Beach; and
WHEREAS, on August 31,1994, the City entered into a Subsidy Agreement with
The 221, Inc. for the building located at 221 Collins Avenue, Miami Beach; and
WHEREAS, on January 16, 1996, the City entered into a Subsidy Agreement with
Iche's Corporation, Inc., for the building located at 1220 Marseilles Drive, Miami Beach;
and
WHEREAS, on April 19, 1996, the City entered into a Subsidy Agreement with
L.V.S. Investments, Inc. for the building located at 1946-1956 Marseille Drive, Miami
Beach; and
WHEREAS, on August 13, 1996, the City entered into a Subsidy Agreement with
1244 Penn Associates, LTD. for the Dorann Apartments located at 1244 Pennsylvania
Avenues, Miami Beach; and
WHEREAS, on August 19, 1996, the City entered into a Subsidy Agreement with
Joaquin Perez and Sonia Sosa Perez for the building located at 345 Collins Avenue, Miami
Beach; and
WHEREAS, the Subsidy Agreements provided that the City would commit funds to
make available a subsidy to encourage the rehabilitation of the Properties, in return for
which assistance the Owners agreed to offer a certain number of units at reduced rental
rates for a period of years; and

WHEREAS, the Owners of the properties have complied in all material respects with
the terms and conditions of the Subsidy Agreements, and the required term of years for
reduced rental rates has now elapsed; and
WHEREAS, the Administration requests that the attached Release and Satisfaction
of the Subsidy Agreements be executed by the Mayor and City Clerk.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby authorize the Mayor and City Clerk to execute the attached Release
and Satisfaction of Subsidy Agreements for the following properties: 629 Lenox Avenue,
221 Collins Avenue, 1220 Marseilles Drive, 1946 Marseilles Drive, 1244 Pennsylvania
Avenue, and 345 Collins Avenue.

Condensed Title:
A resolution to execute the attached Release and Satisfaction of Subsidy Agreements for the following
properties: 629 Lenox avenue, 221 Collins Avenue, 1220 Marseilles Drive, 1946 Marseilles Drive, 1244
Pennsylvania Avenue, and 345 Collins Avenue.
Issue:
Shall the City of Miami Beach execute the attached Release and Satisfaction of Subsidy Agreements for
the following properties: 629 Lenox avenue, 221 Collins Avenue, 1220 Marseilles Drive, 1946 Marseilles
Drive, 1244 Pennsylvania Avenue, and 345 Collins Avenue.
Item Summary/Recommendation:
The City administers the Multi-Family Housing Rehabilitation Program through the Housing Division of the
Neighborhood Services Department. Since 1981, the City has provided financial assistance to property
owners through this program resulting in the successful renovation of over 1,250 units of rental housing.
The issuance of Release and Satisfaction of Subsidy Agreements is standard practice under the Multi-
Family Housing Rehabilitation Program when a participant has complied with the requirements of the
Program.
The Owners of the properties have complied with the requirements of the Multi-Family Housing
Rehabilitation Program Guidelines and have made available at least fifty-one percent (51%) of the
apartment units for rent at HUD-specified Fair Market Rents for a period of Five (5) years after completion
of the rehabilitation. The Administration recommends execution of the attached Release and Satisfaction
of Subsidy Agreements for the following properties: 629 Lenox Avenue, 221 Collins Avenue, 1220
Marseilles Drive, 1946 Marseilles Drive, 1244 Pennsylvania Avenue, and 345 Collins Avenue.

Adopt the Resolution.
ANALYSIS
The City administers the Multi-Family Housing Rehabilitation Program through the Housing
Division of the Neighborhood Services Department. Since 1981, the City has provided
financial assistance to property owners through this Program resulting in the successful
renovation of over 1,250 units of rental housing. The Multi-Family Housing Rehabilitation
Program operates with federal funds from the U.S. Department of Housing and Urban
Development (HUD) through the Community Development Block Grant (CDBG) Program.
The issuance of Release and Satisfaction of Subsidy Agreements is standard practice
under the Multi-Family Housing Rehabilitation Program once a participant has complied
with the requirements of the Program.
The following buildings have successfully participated in the City's Multi-Family Housing
Rehabilitation Program: 629 Lenox Avenue, containing six (6) apartment units, 221 Collins
Avenue, containing eleven (11) apartment units, 1220 Marseilles Drive, containing eight
(8) apartment units, 1946 Marseilles Drive, containing 16 apartment units, 1244
Pennsylvania Avenue, containing twenty one (21) apartment units, and 345 Collins
Avenue, containing eight (8) apartment units. Under the terms of the agreements to
rehabilitate these properties, a total of $694,865 of federal funds and a match of
$1 ,177 ,206 of private fu nds were invested to rehabilitate the properties.
The Owners of the properties have complied with the requirements of the Multi-Family
Housing Rehabilitation Program Guidelines and have made available at least fifty-one

percent (51 %) of the apartment units for rent at HUD-specified Fair Market Rents for a
period of five (5) years after completion of the rehabilitation.
A review of city records indicates that there are no city code enforcement liens outstanding,
and no unpaid water bills on the properties. Property taxes are reported paid through
2001.
The Administration recommends that the Mayor and City Commission adopt the attached
Resolution, authorizing the Mayor And City Clerk to execute the attached Release and
Satisfaction of Subsidy Agreements for the following properties: 629 Lenox Avenue, 221
Collins Avenue, 1220 Marseilles Drive, 1946 Marseilles Drive, 1244 Pennsylvania Avenue,
and 345 Collins Avenue.

instrument affects the following described real property:
Lot 7, Block 9, of the Second Revised Plat of Portions of Ocean Side Section and Trouvllle
Section of Isle of Normandy, according to the plat thereof as recorded in Plat Book 40, Page
35, ofthe Public Records of Miami-Dade County, Florida, at 1220 Marseilles Drive.
And satisfies any and all obligations under the terms of such instrument and does hereby direct the Clerk of
the Circuit Court, Miami-Dade County, Florida to cancel such instrument of record.
