2002-24756 Reso RESOLUTION NO. 2002-247 S6 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROPRIATING $10,857.25 FROM THE $92 MILLION GENERAL OBLIGATION BONDS (GOB), SERIES 2000, FUND NO. 383 (NORMANDY ISLE/SUD NEIGHBORHOOD IMPROVEMENTS), AS RECOMMENDED BY THE GOB OVERSIGHT COMMITTEE, AT ITS MEETING OF FEBRUARY 4, 2002; FURTHER APPROVING A FIRST AMENDMENT TO AN EXISTING PROFESSIONAL SERVICES AGREEMENT WITH MARLIN ENGINEERING, INC., DATED FEBRUARY 21, 2001, FOR THE PERFORMANCE OF TRAFFIC COUNT DATA COLLECTION SERVICES; SAID AMENDMENT TO COMPLETE THE TRAFFIC IMPACT STUDY NEEDED FOR THE IMPLEMENTATION OF A NORMANDY SUD STREET CLOSURE/GUARD GATE PROJECT AND COMPLY WITH REQUIREMENTS OF THE FLORIDA DEPARTMENT OF TRANSPORTATION (FDOT). WHEREAS, Resolution No. 2000-24092, dated September 27, 2000, awarded a contract to Civil Works, Inc. (CWI), in the amount of $4,790, to perform a traffic impact study for a street closure/guard gate project, that had been requested by the Normandy Sud Neighborhood Association, a GOB project (the Project); and WHEREAS, it soon became apparent that the draft-final study submitted to the Florida Department of Transportation (FDOT) for review, was under-funded and not comprehensive enough to satisfy FDOT requirements for the Project; and WHEREAS, proper responses to the issues raised by FDOT are essential if the Normandy Sud Neighborhood is to move forward with a proposed special taxing assessment district, which would fund the Project; and WHEREAS, the Administration recommends that the required Normandy Sud street closure/guard gate project impact study be completed as a First Amendment to an existing Agreement with Marlin Engineering, Inc., dated February 21,2001., for the Performance of Traffic Count Data Collection Services; said amendment in the amount of $10,857.25; and WHEREAS, $10,857.25 in GOB funds are available for the purpose, with a determination that the study be completed within sixty (60) days of receiving a notice to proceed from the City. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby appropriate $10,857.25 from the $92 million General Obligation Bonds (GOB), Series 2000, Fund No. 373 (Normandy Isle/Sud Neighborhood Improvements), as recommended by the GOB Oversight Committee, at its meeting of February 4, 2002; further approving a First Amendment to an existing Professional Services Agreement with Marlin Engineering, Inc., dated February 21, 2001, for the Performance of Traffic Count Data Collection Services; said Amendment to complete a traffic impact study for a proposed Normandy Sud street closure/guard gate project and comply with requirements of the Florida Department of Transportation (FDOT). Issue: Shall General Obligation Bond (GOB) funds be appropriated for the purposes of completing a traffic impact study and securing endorsement by FOOT, so that the Normandy Sud Neighborhood is able to move forward with the required special taxing assessment district, which would fund the desired street closurelguard gate project? Item Summary/Recommendation: The previous engineering consultant, Civil Works, made an effort to perform a study which was found to be under-funded and not comprehensive enough to satisfy and comply with requirements and issues raised by FDOT in a letter dated November 6, 2001. A more extensive and intensive traffic impact study is required if the proposed neighborhood project is to become reality. City staff recommends that Marlin Engineering, Inc., a firm with years of experience working with FDOT requirements, conduct the additional study, at a cost of $10,857.25. The Administration recommends the GOB fund appropriation so that the study can be completed for FDOT endorsement, which, subsequently, will allow for the implementation of the Normandy Sud Neighborhood street closure/guard gate project, desired by the area residents/property owners. Advisory Board Recommendation: The GOB Oversight Committee, at its meeting of February 4, 2002, recommended the appropriation of $10,857.25 in General Obligation Bonds, Series 2000, Fund No. 373 (Normandy Sud Neighborhood Improvements), with a determination that the Study be completed by Marlin Engineering within sixty (60) days of receiving a Notice to Proceed from the City. ADMINISTRATION RECOMMENDATION Subject: Adopt the Resolution. ANALYSIS Resolution No. 2000-24092, dated September 27,2000, awarded a contract to Civil Works, Inc. (CWI), in the amount of $4,790, to perform a traffic impact study for a street closure/guard gate project, that had been requested by the Normandy Sud Neighborhood Association, a GOB project In March 2001, CWI submitted draft copies to the City and the Florida Department of Transportation (FDOT) for review. After two sets of reviews by FDOT and subsequent responses by CWI, the continued scope and reach of the FDOT comments and questions made it evident that $4,790 had been a wholly inadequate amount of funds for the study, which was not comprehensive enough to satisfy all FDOT requirements. Proper responses to the issues raised by FDOT are essential if the City is to move forward with the special taxing assessment district, which would fund the desired street closure/guard gate project. The FDOT letter, dated November 6, 2001, is hereto attached as Exhibit A. AGENDA ITEM DATE February 20, 2002 Commission Memorandum Normandy Sud Project Page 2 The Administration recommends that Marlin Engineering, Inc., instead of CWI, complete the Normandy Sud Street Closure/Guard Gate Project Impact Study for the following reasons: CJ The firm and its employees have a long history working with FOOT, and FDOT-related projects; CJ The firm is the City's current traffic consultant for GOB projects; and Cl Civil Works has been non-responsive to repeated demands to complete the traffic study. Attached hereto, as Exhibit B, is a cost estimate submitted by Marlin Engineering to produce the additional data and comprehensive study requested by FDOT, at $10,857.25. The appropriation of $10,857.25 from the $92 million GOB, Series 2000, Fund No. 373, Normandy Isle/Sud Neighborhood Improvements was recommended by the GOB Oversight Committee, at its meeting of February 4, 2002, with the determination that the Study be completed by Marlin Engineering within sixty (60) days of receiving a Notice to Proceed from the City. Due to the numerous requests made by the Sud Neighborhood and the need to complete this traffic impact study, the Administration recommends approval of the Resolution.
