A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA AUTHORIZING THE
MAYOR AND CITY CLERK TO GRANT AN EASEMENT TO
FLORIDA POWER & LIGHT COMPANY (FP&L), SUBJECT TO
THE DIRECTOR OF PUBLIC WORKS PRIOR REVIEW AND
APPROVAL, FOR THE PROVISION OF UNDERGROUND
DISTRIBUTION FACILITIES AND A TRANSFORMER VAULT AT
THE SOUTH BEACH PARKING GARAGE, LOCATED AT 1041
COLLINS AVENUE, AND AUTHORIZING THE MAYOR AND
CITY CLERK TO EXECUTE AND RECORD THE EASEMENT
FOR THE REQUIRED UNDERGROUND FACILITIES AND
TRANSFORMER VAULT.
WHEREAS, on January 5, 1998, the City of Miami Beach issued RFP No. 20-
97/98, seeking proposals for the development of public-private parking facilities, and on
April 6, 1998, proposals from five (5) different development teams were submitted and
evaluated by an Evaluation Committee; and
WHEREAS, as a result of said negotiations, on October 20, 1999, the Mayor and
City Commission adopted Resolution No. 99-23372 approving the Agreement of Lease
and the Development Agreement between the City of Miami Beach and Pelican
Development LLC, for development of the site located at 1041 Collins Avenue, known
as the South Beach Parking Garage. (the Property); and
WHEREAS, the City, as a ground-lessor, retains ownership of the land upon
which the Property is to be developed; and
WHEREAS, construction of the new six (6) story, 320 space public parking
structure, with ground level retail, South Beach Parking Garage is nearing completion,
and electrical service is required for testing and other construction needs; and
WHEREAS, in order for Florida Power & Light to energize the building, the City
must grant, execute and record the attached Easement for the underground utilities and
the transformer vault.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission grant an easement to Florida Power & Light Company (FP&L), subject to
the Director of Public Works prior review and approval, for the provision of underground
distribution facilities and a transformer vault at the South Beach Parking Garage,
located at 1041 Collins Avenue, and authorizing the Mayor and City Clerk to execute
and record the easement for the required underground facilities and transformer vault.

Condensed Title:
A resolution authorizing the Mayor and City Clerk to execute a grant of easement to Florida Power & Light
(FP&L) at the 1041 Collins Avenue development, subject to the review and approval of the Director of
Public Works.
Issue:
Shall the City grant an easement to FP&L at the 1041 Collins Avenue property, which the City owns and
has ground leased to Pelican Development LLC for development?
Item Summary/Recommendation:
The property at 1041 Collins Avenue has been ground leased by Resolution No. 99-23372 to Pelican
Development LLC for development. To support the development FP&L has installed in the property, power
transmission lines and a transformer vault. FP&L requires an easement to ensure long-term access to their
improvements. The Administration has not yet received, nor reviewed any existing documents regarding
the easement request. However, since it is important for the Developer to energize the building as soon as
possible. the Administration recommends it be granted subject to the review and approval of the Director of
Public Works.

BACKGROUND
On January 5, 1998, the City of Miami Beach issued RFP 20-97/98, seeking proposals for
the development of Public-Private Parking facilities. On April 6, 1998, proposals from five
(5) different development teams were submitted and evaluated by an Evaluation
Committee and on July 15, 1998, the City Commission authorized negotiations with four (4)
of the proposed development projects.
As a result of said negotiations, on October 20, 1999, the Mayor and City Commission
adopted Resolution No. 99-23372 approving the Agreement of Lease and the
Development Agreement between the City of Miami Beach and Pelican Development LLC,
for development of the site located at Collins Avenue and 10th Street.
In January 2000, plans for a six (6) story 320 space public parking structure, with ground
level retail were submitted to Design Review/Historic Preservation Board. On May 15,
2001, final plans were submitted, a foundation permit issued and construction commenced.
To support the development, FP&L installed transmission power lines and a transformer
vault. The building is in its final stages of completion. To energize the building, FP& L
requires an easement for the area occupied by their power transmission lines and
transformer vault.
ANALYSIS
Due to the recent submission of this request and in an effort to expedite the completion of
the project, said request for approval of grant of easement will be subject to the Public
Works Director's review of existing City records and final approval recommendation to
grant a non-exclusive easement. If recommended by the Director, the non-exclusive
easement shall be granted to FP&L for the installation and maintenance of an underground
transmission system and for the transformer vault area, in that portion of the leased site as
determined acceptable by the Public Works Director. The easement will be valid for the
duration of said structure and facilities being in service and will revert to the property owner
in case of removal of such electrical services.
If approved, the Public Works Department will review and maintain records of the
underground utilities within this easement area to avoid any conflicts.
CONCLUSION
The Administration recommends the granting of the easement by the Mayor and City
Commission to Florida Power & Light, subject to the Director of Public Works prior review
and approval, for the underground utilities and the transformer vault, and the execution and
recording of said easement by the Mayor and City Clerk to allow energizing the South
Beach Parking Garage at 1041 Collins Avenue.
