A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE MAYOR
AND CITY CLERK TO EXECUTE A CHANGE ORDER (NO.2), IN THE
AMOUNT OF $42,826.38, TO CARIVON CONSTRUCTION COMPANY,
PURSUANT TO BID NO. 35-00/01, FOR ADDITIONAL WORK
REQIDRED TO COMPLETE THE PAINTING AND WATERPROOFING
CAPITAL PROJECTS AT THE MIAMI BEACH CONVENTION CENTER
AND JACKIE GLEASON THEATER.
WHEREAS, pursuant to Invitation to Bid No 35-00101, the City Commission awarded a contract
to Carivon Construction Company on July 18,2001, for the painting and waterproofing of the Miami
Beach Convention Center and Jackie Gleason Theater of Performing Arts (TaPA); and
WHEREAS, in the process of hanging the sculpture, relocated from the Police Station,
additional manpower was required to dismantle the scaffolding and re-erect as needed to
accommodate connection to the hang points, at a cost of $6,386.38; and
WHEREAS, the North exit stairwell at the TaPA requires repair of the steel fascia and concrete
"spalling", and an additional coat of paint is required based on the color change from light beige and
orange to aqua, at a cost of$12,650.00; and
WHEREAS, water intrusion was discovered in the beams above the Convention Center's planter
beds on Convention Center Drive; therefore, requiring the installation of flashing in the amount of
$12,279.00; and
WHEREAS, additional paint and sundries are required to paint the East side walls, which
received cosmetic damage prior to the roof replacement, at a cost of$II,511.00; and
WHEREAS, funding for the painting and waterproofing of the Miami Beach Convention Center
and TaPA was allocated by the City Commission in 2000-2001, in the amount of $765,000, and
Carivon Construction Company was awarded the contract for $529,000, and
WHEREAS, one change order was previously processed, in the amount of $24,766.14 (for repair
of drywall and painting of the walls in the East Atrium); therefore, funding is available to
accommodate the aforementioned change orders, collectively, Change Order No.2, in the amount of
$42,826.38, to complete this project under the allocated budget.
NOW THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and City
Commission herein approve the Change Order No.2 in the amount of $42,826.38, to Carivon
Construction Company, pursuant to Bid No. 35-00101, for additional work required to complete the
painting and waterproofing capital projects at the Miami Be ch Convention Center and Jackie
Gleason Theater of the Performing Arts.

Item Summary/Recommendation:
This project entails multiple components including, dismantling and re-erecting of scaffolding in the East
atrium to accommodate the hanging of the Art and Culture sculpture, repair of the steel fascia and concrete
"spalling" on the North stairwell at the Jackie Gleason Theater, additional paint due to color change from
beige/orange to aqua, installation of flashing on the West planter beds at the Convention Center to avoid
water intrusion, and additional paint and sundries required to complete painting of the Convention Center's
East side walls, which sustained water damage prior to the completion of the roof. Carivon Construction
Company, as the General Contractor, is to provide oversight of the aforementioned projects. The required
permits have been obtained.
THE ADMINISTRATION'S RECOMMENDATION IS TO APPROVE THE RECOMMENDATION

ADMINISTRATION RECOMMENDATION:
Adopt the Resolution.
ANALYSIS:
Total funding in the amount of $32,603,642 has been appropriated in Fiscal Years 97/98
through 01/02, for the Convention Center and Jackie Gleason Theater of Performing Arts
(TOPA) Capital Projects. Pursuant to the City Commission request for balance updates to
be presented with Convention Center capital project requests, current preliminary figures
through January 31, 2002 show $17,328,326.80 disbursed, with an additional
$1,966,075.97 encumbered for projects in progress. The total funding available was
$35,000,000 with $10,000,000 pledged for interest generation to fund the Cultural Arts
Council.
The City Commission allocated funding (1999-2000) for painting and waterproofing of the
Jackie Gleason Theater and the Miami Beach Convention Center in the amount of
$765,000. The Administration recommended the project be put on hold until the completion
of the roof for both facilities. On July 18, 2001 the Commission approved the award of a
contract to Carivon Construction Company in the amount of $529,000.
To date, one change order has been processed in the amount of $24,766.14 for the repair
of dry wall and painting of the walls in the East atrium at the Convention Center.

This change order also required additional scaffolding. Currently the administration is
requesting change order approval in the amount of $42,826.38, which includes the
following:
The dismantling and re-erecting of scaffolding in the East atrium was to accommodate The
Arts, Culture and Entertainment (ACE) Department by hanging their sculpture, which was
relocated to the Convention Center from the Police station lobby. The original design for
hang points was changed by the artist and architect, which required constant repositioning
of the scaffolding around the sculpture as it was being hung and supported. Additional
labor was also required to expedite the removal of the scaffolding when hurricane warnings
were issued. ($6,386.38).
The North exterior exit stairwell at the Jackie Gleason Theater of Performing Arts requires
repair of the steel fascia and concrete "spalling". This was discovered in the process of
scraping and pressure spraying the facility. Also, an additional coat of paint is required
based on the required color change from light beigelorange to Aqua. The original scope of
work specified the existing colors ($12,650).
Water intrusion was discovered in the concrete beams above the Convention Center's
planter beds on Convention Center Drive; therefore, requiring the installation of flashing
($11,511.00).
Additional paint and sundries are required to paint the East side walls at the Convention
Center, which received extensive damage from water intrusion prior to the roof being
completed ($11,511.00).
Carivon Construction as the General Contractor is to provide oversight of the
aforementioned Projects.
The Miami Beach Convention Center Capital Oversight Committee approved the project on
April 24, 2001, and the project is under budget allocation. The City Administration
recommends that the City Commission approve the resolution.
