98-22757 RESO RESOLUTION NO. 98-22757 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, CALLING A PUBLIC HEARING TO CONSIDER THE VACATION AND ABANDONMENT OF THE NORTH PORTION OF LINCOLN ROAD, EAST OF COLLINS AVENUE TO DI LIDO BEACH HOTEL CORPORATION, IN RETURN FOR THE LINCOLN ROAD ACCESS EASEMENT AND LINCOLN ROAD IMPROVEMENTS. WHEREAS, Di Lido Beach Hotel Corporation owns the Di Lido Property located at 1669 Collins Avenue; and WHEREAS, Di Lido Beach Hotel Corporation intends to redevelop the Di Lido Property and portions of the commercial building according to a Development Agreement with the City of Miami Beach as approved in Resolution No. 98-22750, adopted on May 20, 1998; and WHEREAS, the City desires to construct and extend the Beachwalk access through the Di Lido Property and construct the Improvements at Lincoln Road; and WHEREAS, Di Lido Beach Hotel has requested a vacation and abandonment of the north portion of Lincoln Road in return for the Lincoln Road access easement and Lincoln Road Improvements; and WHEREAS, the Mayor and City Commission, following guidelines set by the Land Use and Development Committee on July 19,1989 and preceding vacation requests, shall call for a public hearing to consider the vacation/abandonment of the aforementioned public right-of-way. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that a public hearing to consider the request by Di Lido Beach Hotel Corporation for the vacation/abandonment ofthe north portion of Lincoln Road in return for the Lincoln Road access easement and Lincoln Road improvements, is hereby called to be held before the Mayor and City Commission in their Chambers on the Third Floor of City Hall, 1700 Convention Center Drive, Miami Beach, Florida on June 17, 1998, beginning at 11 :00 a. m., and Greenberg, Traurig, as attorneys for Di Lido Beach Hotel Corporation, is hereby authorized and directed to publish appropriate Public Notice ofthe said Public Hearing in a newspaper of Miami Beach, at which time and place all interested parties will be heard. ADMINISTRA TION RECOMMENDATION: To adopt the Resolution. BACKGROUND: On July 26, 1989, the Land Use and Development Committee set the guidelines/criteria for considering right-of-way and easement vacation requests, and recommended a case-by-case consideration of these applications. As set forth in these criteria and requirements, DiLido Beach Hotel Corporation has submitted a request for the City's vacation and abandonment of the north half of Lincoln Road in return for the Lincoln Road access easement and the Lincoln Road Improvements. The vacation of Lincoln Road and the granting of an easement to the City is a requirement of the Development Agreement, which was approved by the City Commission on May 20, 1998 per Resolution #98-22750. ANAL YSIS: The applicant has submitted the application requirements together with a list of property owners within a radius of 375 feet who have to be notified of the scheduled public hearing.
