A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, APPROVING THE ADDITION OF A
CONTINGENCY ALLOWANCE, IN THE AMOUNT OF $35,000, TO THE
PROJECT BUDGET FOR THE CONSTRUCTION OF THE
PORTECOCHERE AT THE JACKIE GLEASON THEATER OF THE
PERFORMING ARTS; AND APPROPRIATING $35,000 TO FUND THIS
CONTINGENCY AS FOLLOWS: $29,000 FROM THE CONVENTION
CENTER EXTERIOR SIGNAGE ACCOUNT, AND $6,000 FROM THE
CONVENTION CENTER/TOPA MISCELLANEOUS ACCOUNT.
WHEREAS, Invitation to Bid No. 13-00/01, for the construction of an extension to the
portecochere at the Jackie Gleason Theater of the Performing Arts, was issued on February 6,2001,
with an opening date of March 13, 2001; and
WHEREAS, pursuant to this Bid a construction contract was awarded to Capricorn
Construction Corporation, as the lowest and best bidder, in the amount of $137,777; and
WHEREAS, the referenced contract contains no allowance for contingency; and
WHEREAS, in order to add additional elements to the Project, the Administration is now
recommending the creation of a contingency allowance in the amount of $35,000; and
WHEREAS, funding is available to fund this contingency as follows: $29,000 from the
Convention Center Exterior Signage Account, and $6,000 from the Convention Center/TOP A.
Miscellaneous Account.
NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that a Contingency
Allowance, in the amount of $35,000, be approved for the Project budget for the construction of the
portecochere at the Jackie Gleason Theater of the Performing Arts; and appropriating $35,000 to
fund this contingency as follows: $29,000 from the Convention Center Exterior Signage Account,
and $6,000 from the Convention Center/TOP A Miscellaneous A ount.

Item SummarY/Recommendation:
The Administration recommends approval of the Resolution authorizing and approving
the creation of a Project Contingency allowance for the TOPA Portecochere project in
the amount of $35,000, and appropriating the funds for this purpose as follows: $29,000
from the Convention Center Exterior Signage Account (441.2200.069358), and $6,000
from the Convention CenterlTOPA FY-2001-02 Miscellaneous Account
(441.2369.069358).

ANALYSIS:
The Portecochere is designed as an extension of the existing canopy covering the
front entry and sidewalk at TOPA. The old canopy sheltered one vehicle, the new
larger canopy will cover the driveway sufficiently to shelter three vehicle lanes.
Invitation to Bid No. 13-00/01 for the Construction of a new Portecochere for the
Jackie Gleason Theater of the Performing Arts (TOPA), was issued on February 6,
2001, with an opening date of March 13, 2001. A contract in the amount of
$137,777 for the work was awarded on April 18, 2001, pursuant to Commission
Memorandum No. 194-01 to Capricorn Construction Corporation (Capricorn). The
contract included no contingency allowance.
A Notice to Proceed was issued to Capricorn on May 31,2001, with a starting date
of June 7, 2001. The starting date was delayed at the request of TOPA
management due to the pending Microsoft Show in July, and the Source Awards
event in August. The Contractor was issued an amended Notice to Proceed to
begin work on August 21, 2001. Work has proceeded according to contract, and
the project is now over 90% complete.
The Administration has recognized the need for the project budget to be increased
to permit several items to be incorporated into the project. To accomplish this, it is
proposed to establish a contingency allowance for the project. Examples of the use
to which the contingency will be applied, are the following:
. Adjust the contract of Capricom to incorporate the extra work of the removal
of the roofing on the old canopy, and re-roofing the older section (1,035 sq.
ft.) along with the newly constructed Portecochere (1,565 sq. ft.). This work
will increase the contract amount by $5,133.
. The old lettering on the canopy was damaged by a truck after award of the
contract. Convention Center Management has requested that the lettering
be replaced with backlighted letters to improve visibility. The contractor has
proposed to provide the replacement lettering, the required electrical
connections and to install neon lights behind the letters to illuminate them.
The cost of this contract change will be $24,237.
. The Architect on the project is Giller and Giller, Inc. The design of the
Portecochere was accomplished under a Service Order, issued pursuant to
the rotational consulting agreement between the City and Giller and Giller,
Inc., executed September 13,1995. In accordance with Section 2.9.8 of the
Agreement, the consultant is entitled to Additional Services for "Preparing
documents for change orders...initiated at the City's request and outside the
scope of the work..." (ellipsis added). The Consultant has requested an
additional fee of $2,640.00 for undertaking this extra work.
CONCLUSION
The Administration recommends approval of the Resolution authorizing and
approving the creation of a Project Contingency allowance for the TOPA
Portecochere project in the amount of $35,000, and appropriating the funds for this
purpose as follows: $29,000 from the Convention Center Exterior Signage Account
(441.2200.069358), and $6,000 from the Convention CenterlTOPA FY-2001-02
Miscellaneous Account (441.2369.069358).
