2002-24787 Reso RESOLUTION NO. 2002-24787 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, RETROACTIVELY AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO SUBMIT A GRANT APPLICATION TO THE FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION, LAND AND .WATER CONSERVATION FUND PROGRAM (LWCF), FOR STATE FUNDS IN AN AMOUNT NOT TO EXCEED $100,000, TO BE MATCHED WITH $100,000 OF CITY FUNDING FROM THE MIAMI-DADE COUNTY SAFE NEIGHBORHOODS BOND PROGRAM FOR THE RENOVATION OF NORTH SHORE OPEN SPACE PARK, PHASE III; FURTHER APPROPRIATING THE GRANT IF APPROVED AND ACCEPTED BY THE CITY; AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE ALL NECESSARY DOCUMENTS RELATED TO THIS APPLICATION. WHEREAS, the Land and Water Conservation Fund (LWCF) was established by the U.S. Congress upon enactment of the Land and Water Conservation Fund Act of 1965 and is incorporated in Chapter 620-5, Part VII of the Rules of the Florida Department of Environmental Protection; and, WHEREAS, the program provides matching grants to the State of Florida and, through the State, to governmental entities for the acquisition and development of outdoor recreation purposes; and, WHEREAS, LWCF grants are awarded to grantees for projects that are for the sole purpose of providing outdoor recreation opportunities to the public and applicants may request funds for the acquisition of real property or for the construction, expansion renovation/repair of facilities; and, WHEREAS, the grant requires matching funds and the City has $100,000 in Miami-Dade County Safe Neighborhoods Bonds Funds for the match; and, WHEREAS, the City has a shortfall in funds to complete Phase III of the North Shore Open Space Park Project; and, WHEREAS, the application deadline for the grant was March 12, 2002, and therefore retroactive approval for the submittal is required. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission retroactively authorizing the City Manager or his designee to submit an application for grant funds from the Land and Water Conserfation Fund for the renovation of North Shore Open Space Park - Phase III, in an amount not to exceed $100,000 to be matched with $100,000, of City funding from the Miami-Dade County Safe Neighborhoods Bonds Program; further appropriating the grant if approved and accepted by the City; and authorizing the Mayor and City Clerk to execute all necessary documents related to this application. ADMINISTRATION RECOMMENDATION Adopt the Resolution. ANALYSIS The Land and Water Conservation Fund (LWCF) was established by the U.S. Congress upon enactment of the Land and Water Conservation Fund Act of 1965 and is incorporated in Chapter 620-5, Part VII of the Rules of the Florida Department of Environmental Protection. The program provides matching grants to the State of Florida, and through the State, to governmental entities for the acquisition and development of outdoor recreation purposes. The National Park Service (NPS) and the Florida Department of Environmental Protection (FDEP) administer the program on behalf of the State. LWCF grants are awarded to grantees for projects that are for the sole purpose of providing outdoor recreation opportunities to the public. Applicants may request funds for the acquisition of real property or for the construction, expansion renovationlrepair of facilities. Eligible facilities include beach access improvements, boat ramps, boardwalks, baseball and softball fields, tennis and basketball courts, playgrounds and bicycle trails. Parking lots, restrooms lighting and fencing attached to the facility are also eligible. Grant funds shall only be awarded to grantees for projects that are for the sole purpose of providing outdoor recreational opportunities to the public. The grantee shall have up to I I 'I I, three years from the effective date of the project to complete the project unless extended by Department staff. Land owned by the City, which is developed with LWCF funds, shall be dedicated in perpetuity as an outdoor recreation site for the use and benefit of the public. The City shall be responsible for maintenance of the site. The City has submitted an application for LWCF funds to complete Phase III of the North Shore Open Space Park Project. North Shore Open Space Park, at 34.61 acres is the largest linear park in Miami Beach. The park has a coastal dune system, native vegetation and accessibility to the beach. The scope of work for renovation includes restroom renovations, renovation of 3 existing shade pavilions, concession restoration, vita course replacement/restoration and signage. The grant requires matching funds. The City has $100,000 in Miami-Dade County Safe Neighborhoods Bonds Funds for the match. An applicant may submit only one application during each announced application submission period. The application may contain no more than one project site. The grant criteria states that the project shall be considered in the City's public participation process either through presentation at an advertised meeting, a community organization or neighborhood meeting or at a regularly scheduled advisory board meeting. The City held a public hearing to discuss the grant application for North Shore Open Space Park - Phase III at 5:00 p.m. on Monday March 11, 2002 at North Shore Park Recreation Center. In conclusion, the Administration recommends approval ofthis Resolution of the Mayor and City Commission of the City of Miami Beach, Florida, authorizing the City Manager or His Designee to retroactively submit an application for grant funds from the Land and Water Conservation Fund for the renovation of North Shore Open Space Park - Phase III in an amount not to exceed $100,000 to be matched with $100,000 of City funding from the Miami-Dade County Safe Neighborhoods Bonds Program; further appropriating the grant if approved and accepted by the City; and authorizing the Mayor and City Clerk to execute all necessary documents related to this application.
