AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, AMENDING MIAMI BEACH CITY
CODE CHAPTER 2, ENTITLED "ADMINISTRATION", BY AMENDING
ARTICLE III THEREOF, ENTITLED "AGENCIES, BOARDS, AND
COMMITTEES", BY AMENDING DIVISION 6, ENTITLED "CULTURAL
ARTS COUNCIL", BY AMENDING SECTION 2-54, ENTITLED
"COMPOSITION" AND SECTION 2-55(c), ENTITLED "APPOINTMENT
AND TERM OF MEMBERS"; INCREASING THE NUMBER OF MEMBERS
ON THE COUNCIL FROM NINE TO ELEVEN VOTING MEMBERS;
PROVIDING FOR SEVERABILITY; CODIFICATION; REPEALER; AND
AN EFFECTIVE DATE.
WHEREAS, at its regular meeting on January 30, 2002, cor~mrrent with the filing of
vacancies on the City's Cultural Arts Council, the Mayor and City Commission deemed that it would
be in the best interest of the City to increase the membership of the Council from nine to eleven
voting members.
NOW, THEREFORE, BE IT DULY ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA:
SECTION 1. That Miami Beach City Code, Chapter 2, entitled "Administration", Article III,
entitled "Agencies, Boards, and Committees", be amended to read as follows:

See. 2-54 Composition
The Cultural Arts Council shall consist of nine eleven members to be appointed at-large by
a majority vote of the Mayor and City Commission.

(c) The members of the Council shall be appointed at-large by majority vote of the Mayor and
City Commission. The term of office for each member shall be three (3) years. Effectiv~

December 31, 2001, concurrent with the expiration of the tcls of six (6) members of the
Council, and the rcsulting vacmncics thereon, three (3) mcmbers shall bc appointed for threc

the onc ycar tex,-n cxviring on Deecmbcr 31, 2001, and threc (3) n~embcrs shall bc appointed
for two (2) ycar tch-ms cach. Additionally, effective December 31, 2002, no Council member
may serve more than six (6) consecutive years; this provision shall be measured retroaetively
from the date of the initial appointments to the Council. No Council member who serves the
maximum proscribed term limitations shall be appointed to the Council during the two (2)
year period following the expiration of his/her term.
SECTION 2. SEVERABILITY.
If any section, subsection, clause or provision of this Ordinance is held invalid, the remainder
shall not be affected by such invalidity.
SECTION 3. CODIFICATION.
It is the intention of the Mayor and City Commission of the City of Miami Beach, and it is
hereby ordained that the provisions of this ordinance shall become and be made a part of the Code
of the City of Miami Beach, Florida. The sections of this ordinance may he renumhered or relettered
to accomplish such intention, and the word "ordinance" may be changed to "section", "article," or
other appropriate word.
SECTION 4. REPEALER.
All other ordinances of the City of Miami Beach or any part of said ordinances, in conflict
herewith, be and the same are hereby repealed.
SECTION 5. EFFECTIVE DATE.

ADMINISTRATION RECOMMENDATION
The Administration recommends that the City Commission adopt the ordinance.
ANALYSIS
At the City Commission meeting of January 30, 2002 concurrent with the filling of
vacancies on the City's Cultural Arts Council, the Mayor and City Commission requested
that the legislation creating the Council be amended to increase the total membership
from 9 to 11 members.
Accordingly, the Director of the Cultural Arts Council and City Attorney's Office have
drafted the attached ordinance.
The City Commission approved the ordinance on first reading, February 20, 2002. The
Administration recommends that the City Commission adopt the ordinance on second
reading.
