A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING AMENDMENT NO.1
TO THE AGREEMENT BETWEEN THE CITY AND ZVSCOVICH, INC.
FOR SERVICES FOR THE 17TH STREET SITE SURFACE LOTS/CITY
CENTER UTILIZATION STUDY AND MASTER PLAN, TO INCLUDE IN
THE SCOPE OF SERVICES THE CAPITAL DEVELOPMENT
ACTIVITIES OF THE ADJACENT BA YSHORE CIVIC AREA, WHICH
INCLUDES, BUT IS NOT LIMITED TO, THE PUBLIC WORKS YARD;
FIRE STATION #2; THE PAR-3 GOLF COURSE; SCOTT RAKOW
YOUTH CENTER; AND THE 23RD STREET BRIDGE; AND, MORE
SPECIFICALLY, AUTHORIZING A SITE AND SEQUENCING
ANALYSIS AND MASTER PLAN TO BE FUNDED, IN THE AMOUNT OF
$45,000, FROM THE ARCHITECTURE AND ENGINEERING PORTION
OF THE PUBLIC WORKS YARD PROJECT BUDGET, FINANCED BY
1999 GENERAL OBLIGATION BOND FUNDS.
WHEREAS, on February 21, 2001, the Mayor and City Commission
authorized the Administration to enter into contract negotiations with Zyscovich, Inc,
(Zyscovich) the top ranked firm selected pursuant to RFQ No. 1-00101, to undertake a
site utilization analysis and to develop a concept plan for the 17th Street and
Washington Avenue surface parking lots and the City Center Redevelopment Area (City
Center); and
WHEREAS, on April 18, 2001, the Mayor and City Commission authorized
the execution of a contract with Zyscovich to undertake Phase I, a site utilization
analysis and community input effort and, on October 17, 2001, authorized Phase ",
further evaluations and a master plan effort; and
WHEREAS, the adjacent Bayshore Civic Area, which includes, but is not
limited to, the Public Works Yard; Fire Station #2; the Par-3 Golf Course; Scott Rakow
Youth Center; and the 23rd Street Bridge, influences development activities within the
City Center, particularly related to the City and the Convention Center's operation,
maintenance and safety; and
WHEREAS, a site and development sequencing analysis and master plan for
the Bayshore Civic Area is necessary to seamlessly integrate the construction of the
Public Works Yard with improvements in the City Center; to complement capital
improvements to Fire Station No, 2, Miami Beach Senior High School, and the
Bayshore Neighborhood and to incorporate the ability to maximize future development
options within City Center; and
WHEREAS, on April 1, 2002, the General Obligation Bond Oversight
Committee initially approved the allocation of 2% of the architecture and engineering
funds within the Public Works Yard construction budget, which is approximately
$45,000, to be used for additional master planning activities involving the relocation of
Property Management to the Public Works Yard; and
WHEREAS, the relocation of Property Management to the Public Works Yard
was not pursued because of insufficient space and so master planning funds remain
available,
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, that that the Mayor and City Commission
authorize Amendment One to the Agreement between the City and Zyscovich, Inc., for
Services for the 17t1l Street Site Surface Lots/City Center Utilization Study and Master
Plan, to include in the scope of services and consideration the capital development
activities of the adjacent Bayshore Civic Area, which includes, but is not limited to, the
Public Works Yard; Fire Station #2; the Par-3 Golf Course; Scott Rakow Youth Center;
the 23rd Street Bridge; and more specifically, authorizing a site and sequencing analysis
and master plan to be funded, in the amount of $45,000, from the architecture and
engineering portion of the Public Works Yard Project budget, financed by 1999 General
Obligation Bond Funds.

Condensed Title:
Amendment 1 to the Professional Services Agreement between the City and Zyscovich Inc., adding the
adjacent Bayshore Civic Area to the sites of consideration and specifically authorizing a site and
sequencing analysis and a master plan for the Public Works Yard.
Issue:
Should the City amend the Zyscovich 17th Street Site/Convention Center Contract to include City owned
facilities across Dade Boulevard to benefit from analysis and master plan efforts,
Item Summary/Recommendation:
In the next year, several facilities in proximity to the Convention Center will under go capital development,
including the City's Public Works Yard, Fire Station #2 and the 23rd Street Bridge. Additionally, Miami
Beach Senior High School will undergo a renovation. The resolution adds City owned facilities located
proximate to the Convention Center area, but technically within the Bayshore Golf Course subdivision, as
sites of analysis and master plan consideration under the Zyscovich agreement. This amendment
specifically commences with a Site and Sequencing Analysis and Master Plan for the Public Works Yard.
The amount is $45,000, which is similar to the amount previously appropriated for a master plan effort to
combine the Property Management and Public Works Yard. This plan was deemed unfeasible based on
prior studies and based on a lack of sufficient space at the site.

ADMINISTRATION RECOMMENDATION
Adopt the Resolution.
ANALYSIS
On October 18, 2000, the Mayor and City Commission authorized negotiations with
architectural and engineering firms to conduct a site analysis and develop a concept plan
for the 17th Street and Washington Avenue Site, incorporating the proposed expansion of
the New World Symphony (NWS). The scope of services was envisioned as a two-phase
conceptual development project, which focused on the City owned 17th Street and
Washington Avenue surface parking lots as developmental hubs for the City
Center/Historic Convention Village Redevelopment Area. This area includes City Hall, the
Convention Center, Jackie Gleason Theater ofthe Performing Arts, Botanical Gardens and
Holocaust Memorial, as well as pedestrian linkages to Lincoln Road and the Collins Park
Cultural Center.
On February 21 , 2001, the City Commission authorized negotiations with Zyscovich, Inc.
and, on April 18, 2001, the City Commission authorized the execution of a contract

with Zyscovich, Inc. to undertake Phase I. This involves a site study, utilization analysis
and development of preliminary concept designs. On October 17, 2001 the City
Commission authorized the initiation of Phase II. The work performed in Phase II will result
in preliminary schematics and drawings, and will identify complementary uses for the 17th
Street site and other City owned properties and facilities within the City Center area. The
goal is to set forth a development schedule and identify funding and respective
construction obligations.
Proximate to City Center is the Bayshore Civic Area, which includes the Public Works Yard
and Fire Station #2. These facilities are critical to the maintenance and safety of the City's
residents, business owners and visitors. Planned capital Improvements to these facilities,
as well as future improvements to the 23rd Street Bridge, Par-3 Golf Course and Miami
Beach High School, need to be considered in the overall site analysis of City Center.
Moreover, a site analysis and sequencing plan that addresses or builds in flexibility for
future development options will maximize the success of the Public Works Yard
improvement and mitigate potential conflicts prior to construction as well as resolve space
and construction staging constraints. One such issue is the location of the water storage
tanks, which must be completed prior to the Public Works Yard and Fire Station #2
improvements.
An amendment to the Zyscovich agreement will allow the City to master plan and
sequence the construction of the Public Works Yard, which effects other City projects that
will be constructed in that area in the near future. The Administration has negotiated with
Zyscovich, Inc. for a fee, in the amount of $45,000, of which $1,000 is reimbursable
expenses, to conduct such a master planning effort. This amount is available from funds
previously appropriated for a similar purpose at the Public Works Facility that was never
conducted.
The previous project involved the relocation of Property Management to the Public Works
Yard. Based on previous studies, it was determined that insufficient space exists at the
Public Works Yard to relocate Property Management and so the project was not pursued.
However, the funds remain available for this purpose.

This Amendment No.1, dated as of April 10th, 2002, to that certain Agreement, dated
April 18th, 2001, and captioned: "Professional Services Agreement Between the City of
Miami Beach, Florida and Zyscovich, Inc. for Professional Services to Conduct a Site
Utilization Analysis and Development of A Concept Plan for the 17th Street Surface
Parking Lots;" by and between the City and Zyscovich, Inc. (Consultant), is intended to
amend the Scope of Services to include consideration of the adjacent Bayshore Civic
Area, which is comprised of, but is not limited to, the Public Works Yard: Fire Station
No.2; Par Three Golf Course; Miami Beach High School; and the 23rd Street Bridge,
more specifically to amend the scope of services to include a Site and Sequencing
Analysis and Master Plan for the Public Works Yard.
RECITALS
WHEREAS, the Agreement provides for a site analysis in Phase I and a Master
Plan effort in Phase II for the 17th Street Surface Lots and the City Center
Redevelopment Area (City Center); and
WHEREAS, professional services for a Site and Sequencing Analysis and
Master Plan for the Bayshore Civic Area will complement the City Center Master Plan
efforts;

The above recitals are true and correct and are incorporated as a part of this
Amendment No.1.

2. MODIFICATIONS
The Agreement is amended as follows:
A. Schedule "A", entitled "Scope of Services," is amended as follows:
ADD to "OBJECTIVE" the following:
"The City also seeks to conduct a Site and Sequencing Analysis and
Master Plan for the Public Works Yard and to include therein in the overall
scope the capital development activities of the Bayshore Civic Area."
B. Schedule "A", entitled "Scope of Services," is amended as follows:
ADD the following to Phase II: Community Consensus, Master Plan
Development and Implementation, Task 1:
"Evaluate current and proposed unique capital development needs for the
Public Works Yard and the adjacent Bayshore Civic Area."
D. Schedule "A", entitled "Scope of Services," is amended as follows:
ADD the following to Phase II: Community Consensus, Master Plan
Development and Implementation, Task 5:
"Also identify said opportunities for the Public Works Yard."
E. Schedule "A", entitled "Scope of Services," is amended as follows:

G. Schedule "B" entitled, "Consultant Compensation," is amended as follows:
ADD the following:
"The fee for the Public Works Yard Site and Sequencing Analysis and
Master Plan will total $45,000, comprised of $44,000 for Basic Services
and $1,000 for Reimbursable Expenses. Any Additional Services will
require advance written authorization, prior to commencement of same, by
the City Manager and will follow the fees delineated in Schedule "C."
3. OTHER PROVISIONS
All other provisions of the Agreement, as amended, are unchanged.
4. RATIFICATION
The City and Consultant ratify the terms of the Agreement. as amended, as
modified by this Amendment
