A RESOLUTION OF THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH,
FLORIDA, APPROVING AND AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE
AMENDMENT NO. 1 TO THE AGREEMENT
BETWEEN THE CITY OF MIAMI BEACH AND
GLATTING JACKSON KERCHER ANGLIN LOPEZ
RINEHART, PURSUANT TO REQUEST FOR
QUALIFICATIONS (RFQ) 7-00101, TO PROVIDE
PROFESSIONAL SERVICES FOR THE WEST
AVENUE 1 BAY ROAD NEIGHBORHOOD
STREETSCAPE PROJECT FOR URBAN DESIGN,

FUND.
WHEREAS, the Administration issued a Request for Qualifications NO.7 -00/01 to
provide professional services for the planning, design, permitting, bid/award, and
construction administration, for improvements to the West Avenue / Bay Road
Neighborhood; and
WHEREAS, on May 16, 2001, the Mayor and City Commission authorized the
execution of an Agreement with Glatting Jackson Kercher Anglin Lopez Rinehart, Inc.,
(Consultant) (Agreement), as the top ranked firm, for improvements on the West Avenue I
Bay Road Right-of-Way Infrastructure Improvements Program, Neighborhood 11 (Project);
WHEREAS, said Agreement, in the amount of $231,444, was executed on May 16,
2001; and
WHEREAS, the Administration has negotiated Amendment No. 1 for landscape
architectural and engineering services associated with additional planning for the Project;
and
WHEREAS, the Consultant agrees to perform professional landscape architectural
and engineering services associated with additional planning for the Project; and
WHEREAS, the cost for performing this work is in an amount not to exceed
$86,959; and
WHEREAS, funding, in the amount of $86,959 is available from the Series 2000
General Obligation Bonds and Series 2000 Stormwater Revenue Bond funds; and
WHEREAS, the Administration now requests that the Mayor and City Commission
approve Amendment No.1 to the Agreement.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby approve and authorize the attached Amendment 1 to the Professional
Services Agreement between the City and Glatting Jackson Kercher Anglin Lopez
Rinehart, Inc. for Professional Landscape Architectural and Engineering Services for the
West Avenue / Bay Road Right-of-Way Infrastructure Improvements Program,
Neighborhood 11, in an amount not-to-exceed $86,959; and appropriating $27,290 from
the Series 2000 General Obligation Bond Fund and $59,669 from the Series 2000
Stormwater Bond Fund for said Project.

Dear Mr. Hemstreet:
Negotiations have been completed for subject project. It is my professional recommendation
that the City of Miami Beacb amend the current contract with the AlE finn ofGlatting Jaclcson
Kerscher Anglin Lopez Rhinehart, Inc. as follows:
Addendum No. I. inoludes providing additional Task 1 Planning Services for 10111 Street.. 14m
Street, and 16th Street. The limits of each street shall extend from Alton Road on the east to
Biscayne Bay on the west. These streets are not in the current scope for the current contract,
dated May 16,200. This additional planning effort is being made at the request of the CIP
office, and is within the study area corridors.
The reeommeaded additional sum of money is for TIME AND MATERIALS, THE SUM
NOT TO EXCEED SI7,890.00. Included in this sum is an estimated SI5~'1 for
Tuk 1 Planning Services and an estilDated amount of S1012 for Task 6 Reimbunablet
for Reproduction Services.
Addendum No.2 includes additional Task 1 Plo.iag Serviees foJ'storm water design for
Bay Road, preparation for and attendance at a Pre-CDW meeting and a second CDW meeting
and additional Task 2 Design Servi", for storm water infrastructure on Bay Road. These
additional PluDing and Design Services are not in the current scope for the contract dated
May 16, 2002, and the request for additional services is being made by the CIP office, and is
within the study area corridors.

Condensed Title:
Resolution approving and authorizing additional services for the firm of Glatting Jackson Kercher Anglin
Lopez Rinehart, Inc. in the amount of $86,959 for the provision of required items which were not included
in the oriainallv contracted scope of services.
Issue:
Should the City amend its Agreement with Glatting Jackson Kercher Anglin Lopez Rinehart, Inc. for the
planning and design of West Avenue neighborhood improvements to include three additional deliverables
not originally contemplated or included in the current professional services contract?
Item Summary/Recommendation:
Planning undertaken to date for West Avenue Neighborhood Improvements has demonstrated a need to
include three additional deliverables that were not originally contemplated or included in the current
professional services contract:(1) planning services for 10th, 14th, and 16th Streets; (2) stormwater
planning and design services for Bay Road; and (3) the holding of a second Community Design Workshop.
These items were not included in the original scope of work because of an assumption that limited project
funding meant that improvements would be confined to West Avenue and would be small enough in scope
so as to require only one Community Design Workshop. The planning process to date has recommended
the inclusion of several street ends which are outside the current geographic scope of the project. In
addition, a private developer has contributed a minimum of $300,000 for improvements to Bay Road that
will include drainage enhancements that require planning and design that are not part of the existing scope
of services. Finally, there is a clear need to hold a second and final Community Design Workshop to
achieve community consensus on the proposed improvements program. Funding is available from the
General Obligation Bonds and Storm Water Bonds. THE ADMINISTRATION RECOMMENDS ADOPTING
THE RESOLUTION.

ANALYSIS:
Pursuant to a Resolution adopted by the Mayor and City Commission, the Administration
issued a Request for Qualifications (RFQ) NO.7 -00/01 to provide Professional Services for
the planning, design development, and construction documents for the West Avenue 1 Bay
Road Neighborhood Streetscape and Utility Improvement Project.
The Administration established an Evaluation Committee for the purpose of reviewing the
proposals received and to make a recommendation to the City Manager on the ranking of
the proposals. The firms made oral presentations to the Evaluation Committee. The
Committee evaluated and ranked the firms based on the criteria identified in the RFQ.
Glatting Jackson Kercher Anglin Lopez Rinehart, Inc., (uGlatting Jackson") was selected as
the top ranked firm. The recommendation was issued to the City Manager, who reviewed
and concurred with the Committee's evaluation.
On February 21,2001, the Commission adopted Resolution No. 2001-24277 accepting
the ranking recommended by the Evaluation Committee and authorizing the Administration
to enter into negotiations with the top ranked firm. On May 16, 2001, the Commission
adopted Resolution No. 2001-24388 authorizing the City to execute a Professional
Services agreement with the top ranked firm of Glatting Jackson Kercher Anglin Lopez
Rinehart, Inc., for Professional Landscape Architectural and Engineering Services for the
planning, design, bidding 1 award and construction administration in the amount of
$231,444. The project budget for West Avenue 1 Bay Road is $3,184,839.
During initial negotiations with the AlE firm, the cross streets between Alton Road and
Biscayne Bay were not included in the project scope due to the limited project construction
budget. During the Planning preparation stage, City staff identified this as an issue that
should be addressed, since all other neighborhoods within the ROW program have a more
comprehensive Planning effort. As a result, staff negotiated a Planning Phase fee with
Glatting Jackson to incorporate the east-west streets from 5th Street to Lincoln Road. The
additional scope was presented to the G.O. Bond Oversight Committee at their November
and January meetings where the G.O. Bond Committee recommended aQainst approval.
Subsequently, staff presented the request to the City Commission at the January 30,2002
Commission Meeting but the item was not approved.
At the March 4,2002 G.O. Bond Oversight Committee Meeting, the item was re-introduced
by a Committee Member and a proposal was made to include at least three east-west
streets that terminate at Biscayne Bay. As a result, three streets were chosen, 10th, 14th,
16th, since the G.O. Bond Committee determined that these streets had the highest
likelihood of construction occurring with this program.

Also during the original scope negotiation, Bay Road drainage improvements were not
included because no funding was identified at the time. Since then, the developer of the
adjacent Grand Flamingo property has made available funding for comprehensive
improvements including drainage for Bay Road between 14th and 16th Streets. The City
now needs to obtain planning and construction design services for drainage improvements
for this segment of Bay Road. In addition, the original scope of services did not include a
second Community Design Workshop, which has been determined to be required in order
to obtain community consensus on planned improvements.
The Administration retained the services of Pappas & Associates to assist in fee
negotiations for this additional work. The negotiated fees for this work total a not-to-exceed
amount of $86,959. Ofthis amount, $17,890 is for planning services associated with 10th,
14th, and 16th Streets, which total approximately 3,000 linear feet. This is approximately a
30% increase over the 9,200 linear feet covered by the original agreement while the fee
increase of $17,890 represents a 35% increase over the original planning fee of$50,715.
By comparison, the initial Amendment for additional services brought to the City
Commission for consideration at their January 30th meeting included all of the
neighborhood side streets, totaling 7,300 linear feet - an 80% increase over the original
9200 linear feet in the scope - at a fee of $39,727 which represented a 78%increase over
the original fee. Glatting Jackson has indicated that it will honor this previous proposal
should the City decide to include all east-west streets in the Planning effort.
With the approval of Amendment No.1, the total AlE consultant fee for this neighborhood
will total a not-to-exceed fee of $318,403.
This item was presented to the G.O. Bond Oversight Committee on April 8, 2002.
The Administration recommends the adoption of the attached Resolution.

Description of Work:
Glatting Jackson is providing Planning Services and Construction Documents for improvements to

Deliverables:
As a result of the work outlined above, Glatting Jackson shall provide one (1) Conceptual Plan /
Image for each of the streets illustrating potential improvements consistent with the deliverables as
outlined in the master agreement. A cost estimate of each shall also be submitted and shall be
consistent with the general cost estimate format as outlined in the master agreement.

Beach, and will complete the above items in conjunction with an agreed-upon schedule for
completion.

Glatting Jackson will begin work on this scope upon written authorization from the City of Miami
Beach, and will complete the above items in conjunction with an agreed-upon schedule for
completion.
