A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA ACCEPTING THE RECOMMENDA-
TION OF THE MIAMI BEACH CITY MANAGER CONCERNING REAP-
POINTMENT OF JUDGE SAM I. SILVER TO SERVE AS CHIEF SPECIAL
MASTER WHO SHALL BE AUTHORIZED TO HOLD HEARINGS AND
IMPOSE FINES, LIENS AND OTHER NON-CRIMINAL PENALTIES
AGAINST VIOLATORS OF CITY CODES AND ORDINANCES, AND
SHALL ALSO BE AUTHORIZED TO APPOINT SUCH OTHER SPECIAL
MASTERS AS MAY REASONABLY BE REQUIRED TO CONDUCT THE
SUBJECT HEARINGS; INCORPORATING ALL OTHER MATTERS SET
FORTH WITHIN CITY OF MIAMI BEACH RESOLUTION NO. 92-20436
CONCERNING COMPENSATION OF JUDGE SILVER AS WELL AS
OTHER DUTIES OF JUDGE SILVER SERVING AS SPECIAL MASTER
BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY
MIAMI BEACH:
WHEREAS, in City of Miami Beach Ordinance No. 90-2709, Miami Beach City Coce
Chapter 9B goveming "Code Enforcement" was amended to provide for an alternative ,:oc e
enforcement system wherein Special Masters and Code Enforcement boards or both were autho~ iz{ d
to hold hearings and impose fines, liens and other non-criminal penalties against violators of Ci'y
Codes and ordinances; and
WHEREAS, in City of Miami Beach Ordinance 90-2723, City Code Chapter 9B, Sectk n
9B-4 entitled "Special Masters; appointment; duties", provision was made for the appointment, ~f
a Chief Special Master to fulfill the above referenced duties, with the authority to appoint such oth
Special Masters as reasonable required to conduct said hearings; appointment of the chief Sp...'ci fi
Master is established upon the Miami Beach City Commission's acceptance by a majority vote ~f
the Miami Beach City Manager's recommendation for appointment; and
WHEREAS, Judge Sam I. Silver has been serving as Chief Special Master for the City >f
Miami Beach in accordance with the above referenced procedures; and
WHEREAS, the City Manager of the City of Miami Beach hereby recommend.;
reappointment of Judge Sam I. Silver to fill the position of Chief Special Master for the City c. [
Miami Beach; and
WHEREAS, all other matters set forth within City of Miami Beach Resolution No. 92-
20436 with regards to limitation on compensation to be paid to Judge Silver as well as other dutie'5
of Judge Silver shall remain in effect.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CIT'' ~
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and Cit f
Commission hereby accept the recommendation of the Miami Beach City Manager concernin;
reappointment of Judge Sam I. Silver to serve as Chief Special Master pursuant to Miami Beach Cit 7
Code Chapter 9B entitled "Code Enforcement", said Chief Special Master to be authorized to holt
hearings and impose fines, liens and other non-criminal penalties against violators of City Codes an t
Ordinances and further authorized to appoint such other Special Masters as may be reasonabl 7
required to conduct the subject hearings; and that all other matters set forth within City of Miarr i-
Beach Resolution No. 92-20436 conceming compensation of Sam Silver as well as other duties c f
Judge Silver serving as Special Master are incorporated herein and shall remain in effect.

Per Chapter 9B of the City Code, the term oftlie Chief Special Master is six (6) months.
Chief Special Master's current term expires December 19, 1996.
The attached two Resolutions provide for the'reappointment by the Miami Beach City
Commission of Judge Sam I. Silver based upon the recommendation of the City Manager. C ne
Resolution deals with the reappointment of Judge Silver as Chief Special Master for Cc de
Enforcement violations under Chapter 9B of the City Code, whereas the other Resolution concel ns
reappointment of Judge Silver as Chief Special Master for appeals from citations and violations of
City Code Chapters on denials, suspensions and revocations of occupational licenses and certificates
of use pursuant to Chapter 20 of the Miami Beach City Code.
Administration Recommendation:
The City Manager recommends the reappointment of Judge Silver as Chief Special Mas':er
in accordance with the attached two Resolutions.
