Resolution 1280 04101 MOM RESOLUTION NO. 1280 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: 1. That that land located in Dade County, Florida, and within the City of :Miami Beach, Florida, described as follows, to-wit: Bounded on the Nast by the Atlantic sicean, on the North by the Richard Carney Tract, on the West by Ocean Drive and on the South by the Ed- mund Wilson Tract, together with all common law riparian rights vested in said City, and which was heretofore by deed dated December 4, 1927 , conveyed by The Southern bank & Trust Company, as Trustee , to the City of Miami beach of rade County, Florida, has continuously since the date of said deed of conveyance been used exclusively for park purposes and as a city park, and has heretofore , by a resolution of said City Council, been named and designated Lummus Park; that Ocean Drive , a highway bounding said land on the West, as it is dedicated upon plats, is a narrow street or highway wholly inadequate to accommodate traffic thereon; that large numbers of persons park in said highway adjacent to said iiummus Park with automobiles and thereby lessen the space in said street for use by vehicles and pedestrians so as to congest it ; that it has heretofore become necessary, in order to relieve such con- gestion on said Ocean Drive , and in order to make the said Lummus Park, the land above described, more accessible to citizens and visitors of said City for use as a park, and the better to enable them to conven- iently and fully enjoy said park, to widen said Ocean Drive and that to accomplish such widening it became necessary to widen that part of said drive used for vehicular traffic by removing the entire sidewalk heretofore constructed on the East side of said drive and immediately adjacent to said park and to provide a walkway over a ten foot strip of said ;dark five feet bast of said Ocean Drive, and by widening said Ocean give driveway for vehicles so that it embraces a strip of said park five feet wide to enable citizens and visitors of said City to more conveniently and fully enjoy said park and that widening and side- k have been done and constructs that the surface of said park is of heavy sand, inconvenient and unpleasant to walk in, to obviate which said sidewalk may be used; that said park has been improved and beautified by the installation and cultivation of trees, shrub- bery and various plants and the installation and maintenance of tennis courts, seats and playgound apparatus; that said park nor any part thereof has ever been abandoned by said City nor has it , or any part thereof been used for commercial or residential purposes, and that to make said park, where large numbers of persons congregate to and do bathe in the Atlantic Ocean immediately adjacent to said pare, safe and convenient for such persons , it is deemed expedient to erect and maintain in said park comfort stations, and watch towers fr life guards, who are to be provided to rescue persons in danger in said Atlantic Ocean; and that said confort stations and said watch towers shall never be used by anyone for commercial or residential purposes.
