AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA, AMENDING SECTION 4-6. 12, MIAMI BEACH CITY
CODE, ',ANIMALS PROHIBITED IN PUBLIC PARKS AND ON BEACHES"
ADDING "DOMESTICATED AND DIAPERED PRIMATES" TO LIST OF
ANIMALS EXCLUDED THEREFROM; PROVIDING FOR SEVERABILITY;
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND
PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA.
SECTION 1.
That Section 4-6. 12 of the Miami Beach City Code entitled
"Animals Prohibited in Public Parks and on Beaches" is hereby
amended to read as follows:
SECTION 4-6. 12 ANIMALS PROHIBITED IN PUBLIC PARKS AND ON
BEACHES
It shall be prohibited for any person to take any animal into, or
to keep any animal in or upon, any public park or public beach in
the City, except for areas reasonably designated by the City
Manager. Animals which are under the custody and control of a law
enforcement officer and, "seeing-eye" dogs accompanying a blind
person and domesticated and diapered primates are excluded from
this section.
SECTION 2 . REPEALER
That all ordinances or parts of ordinances in conflict be and the
same are hereby repealed.
SECTION 3. SEVERABILITY
If any section, sub-section, sentence, clause, phrase or portion
of this ordinance is for any reason, held invalid or
unconstitutional by a court of competent jurisdiction, such portion
shall be deemed a separate, distinct and independent provision and
such holding shall not affect the validity of the remaining
portions of this ordinance.
SECTION 4. EFFECTIVE DATE
That this ordinance shall take effect ten (10) days after its
adoption, on July 21 , 1990.
