AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA, AMENDING MIAMI BEACH CITY CODE CHAPTER 8
ENTITLED ',BUILDING REGULATIONS, BY ADDING SECTION 8-11
ENTITLED ',CRANES, HOISTS AND OTHER MECHANICAL LOAD-
LIFTING APPARATUS REGULATED"; REPEALING ALL ORDINANCES IN
CONFLICT THEREWITH; PROVIDING FOR SEVERABILITY; PROVIDING
FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH,
FLORIDA.
SECTION 1.
That Chapter 8 of the Miami Beach City Code, said Chapter entitled
"Building Regulations" , is hereby amended by the addition of the
following section:
Sec. 8-11 Cranes, hoists and other mechanical load-lifting
apparatus regulated.
The use of cranes, hoists and other mechanical load-lifting
apparatus shall be subject to the following conditions and
restrictions:
(1) No mobile crane shall be permitted to operate or be
maintained in the city right-of-way in excess of one
hundred and twenty (120) hours.
(2) No full-tracked vehicles shall be allowed to be off-
loaded, on-loaded, walked or operated within the city
right-of-way.
(3) Fixed tower cranes shall be permitted to erect and work
within the city right-of-way only after the following
conditions have been met:
la) The building official has been satisfied that no
suitable on-site alternative exists.
(b) Suitable and adequate bonding and insurance is in
effect to relieve the city of any damages and
liability.
(c) Sufficient plans and specifications that both the
crane and its foundation are adequate will be
submitted and approved prior to erection.

(4) Penalties for failure to comply with this Section shall
be in accordance with Section 205 of the South Florida
Building Code entitled "Violations and Penalties" .
(5) The building official of the City of Miami Beach shall be
responsible for ensuring compliance with all of the
restrictions as set forth hereinabove.
SECTION 3. REPEALER.
All ordinances or parts of ordinances in conflict herewith be and
the same are hereby repealed.
SECTION 4. SEVERABILITY
If any section, sentence, clause or phrase of this ordinance is
held to be invalid or unconstitutional by any court of competent
jurisdiction, then said holding shall in no way affect the validity
of the remaining portions of this ordinance.
SECTION 5. EFFECTIVE DATE
This ordinance shall take effect ten (10) days after its adoption,
on December 15 , 1990.
