A RESOLUTION VACATING A CERT :IP TEN FO( T
ALLEY IMMEDIATELY SOUTH OF LOTS 1 TO 5,IN-
CLUSIVE, BLOCK C, of the RE-SUBDIVISION OF
PART OF BLOCKS 48, 56, AND 75, OF OCEAN BEACH,
FW IDA ADDITION PTO. 3,ACCORDING TO THE PLAT
OF SAID RE-SUBDIVISION,RECORDED IN PLAT BOOK
PTO. 21, PAGE "g6, OF THE PUBLIC RdCORDS OF DADE
COUNTY.
WHEREAS, TATUM BUSINESS PROPERTIES, INC., caused to be platted
a Re-Subdivision of part of Blocks 48, 56 and 75 of Ocean Beach,Florida,
Addition No. 3, and said Plat has been recorded in the Public Records of
Dade County, in Plat Book 21, Page 26, and Block C of said Plat shows a
ten foot alley immediately to the South of this Block, and immediately
to the South of Lots 1 to 5 inclusive, thereof,
AND,WHEREAS, the said Tatum Business Properties,Inc. are the owners
of the fee of said Block C, and it is represented that they have agreed to
convey all of said Block C, including the ten foot alley herein described,
uhich Block C was heretofore described as Lot 1 and 2 of Block 75, of Ocean
Beach,Florida, Addition No.3, and that said agreement was made long prior
to the recording of said Plat, and it is represented by the said Tatum Business
Properties, Inc., that because of said agreement to sell said property,they
did not have the legal right to cause to be deducted the said ten foot al-
ley.
APTD,TdMRI AS, it has been represented to the City Council of the
City of Miami Beach, Florida, that the vacating of said alley will not be
detrimental to the rights or interests of any of the property holders of the
City of Miami Beach, because of the fact that said city has never entered any
right, title or interest in and to said property.
NOW,THEREFORE, BE IT RESOLVED by the City Council of the City of
Miami Beach, as follows:
Section 1. That a certain ten foot alley lying immediately to the
south of Lots 1 to 5 inclusive, Block C, of the Re-Subdivision of part of
Blocks 48, 56 and 75 of Ocean Beach,Florida, Addition No. 3, according to the-
Plat of said Re-subdivision, recorded in Plat Book 21, Page 26, of the Public
Records of Dade County, Florida, said alley extending from Meridian Avenue,

Westerly, to the vest line of lot 5 of said Block C, be and the same,
from the beginning of said alley to 'Uhe end thereof, is hereby va-
cated, and the Mayor of the City of Miami Beach,and the City Clerk of
this City are hereby authorized and directed to make, execute and de-
liver such instrument or insturments as will vest in said Tatum Busi-
ness Propertios,Inc.
usi-ness`Propertios,Inc. the title to said premises,so far as the City of
Miami Beach has the right to vest said title.
PASSED AND ADOPTED this 1st day of September, A.D. , 1926.
