AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, AMENDING
ORDINANCE NO. 88-2603 "RETIREMENT SYSTEM FOR
UNCLASSIFIED EMPLOYEES AND ELECTED OFFICIALS"
BY EXPANDING THE DEFINITION OF EMPLOYEE
NOW THEREFORE BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA:
SECTION 1: That Article 2 . 05 he amended to read as follows:
"Employee means any person employed by the City, or
by the Miami Beach Redevelopment Agency on or
before April 1988, on a regular basis, who is
receiving compensation from the City or the Miami
Beach Redevelopment Agency for personal services,
and who is within a group or classification of
employees designated by the Board of Trustees as
eligible for membership in the Unclassified System.
SECTION 2 : SEVERABILITY:
If any section, sentence, clause or phrase of this
Ordinance is held invalid, or unconstitutional by
any court of competent jurisdiction, then said
holding shall in no way affect the validity of the
remaining portions of this Ordinance.
SECTION 3 : REPEALER:
That all Ordinances or parts of Ordinances in
conflict herewith be and the same are hereby
repealed.
SECTION 4 : EFFECTIVE DATE:
This Ordinance shall take effect (10) days after
its adoption on March 30, 1991.
PASSED and ADOPTED this 20th day of March 1991.

SUBJECT: AN AMENDMENT TO THE DEFINITION OF EMPLOYEE IN THE UNCLASSIFIED
EMPLOYEES AND ELECTED OFFICIALS, RETIREMENT SYSTEM
When the Unclassified Employees and Elected Officials Retirement
System was created April 1988, certain employees working for the
City under its alter ego, the Miami Beach Redevelopment Agency
were not eligible for membership in the System. This Amendment
to the Ordinance allows employees employed by the Redevelopment
Agency at the time of the System' s creation, and who are still
employed by either the City or the Redevelopment Agency to become
members. This change will add a minimum amount of liabilities
to the System and is being done as an equity measure for those
people meeting the definitial change.
Administration Recommendation:
The Administration recommends that the City Commission adopt this
Ordinance on first reading and schedule a Public Hearing for its
March 15, 1991 meeting.
