AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA, AMENDING CITY OF MIAMI BEACH ORDINANCE
NO. 90-2701 WHICH CREATED CHAPTER 15A OF THE CODE OF THE
CITY OF MIAMI BEACH ENTITLED ',CITY OF MIAMI BEACH HEALTH
FACILITIES AUTHORITY', BY DELETING INVESTMENT BANKER FROM
MEMBERSHIP CATEGORY AND SUBSTITUTING THEREFORE AN
INDIVIDUAL MEMBER REPRESENTING GENERAL BUSINESS WHO SHALL
BE OF RESPONSIBLE STANDING IN THE COMMUNITY; REPEALING
ALL ORDINANCES IN CONFLICT THEREWITH; PROVIDING FOR
SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH,
FLORIDA.
SECTION 1.
City of Miami Beach Ordinance No. 90-2701 which created
Chapter 15A of the Miami Beach City Code, said Chapter being
entitled "City of Miami Beach Health Facilities Authority" , Section
3 (b) thereof entitled "Members; Terms of Office; Advisor" is hereby
amended to read as follows:
Section 3 "Creation of City of Miami Beach Health
Facilities Authority and Membership".

The Authority shall, unless otherwise provided by State
law, be composed of five (5) voting members consisting of two (2)
health providers, one (1) investment Banker, one (1) individual in
the field of general business who possesses good standing in the
community, one (1) accountant and one (1) attorney. Members shall
be residents of the City, appointed by the Commission for terms of
four (4) years; provided that of the first members appointed, the
Commission shall designate one (1) member to serve for one (1)
year, one (1) member to serve for two (2) years, one member to
serve for three (3) years and two (2) members to serve for four (4)
years. Thereafter all appointments by the Commission, except
appointments to fill vacancies, shall be for a term of four (4)
years. Vacancies during a term shall be filled for the unexpired
term by the Commission. A member of the Authority shall be
eligible for reappointment. Any member of the Authority may be
removed by the Commission for misfeasance, malfeasance, willful
neglect of duty or such other good cause as shall be determined by
the Commission. In addition, the Chairman of the City of Miami
Beach Health Advisory Board shall serve as a non-voting advisor to
the Authority.

SECTION 2 . REPEALER.
All ordinances or parts of ordinances in conflict herewith be and
the same are hereby repealed.
SECTION 3. SEVERABILITY
If any section, sentence, clause or phrase of this ordinance is
held to be invalid or unconstitutional by any court of competent
jurisdiction, then said holding shall in no way affect the validity
of the remaining portions of this ordinance.
SECTION 4. EFFECTIVE DATE
This ordinance shall take effect ten (10) days after its adoption,
on April 20 , 1991.

The attached Ordinance amends City of Miami Beach Ordinance No. 90-
2701 which created Chapter 15A of the Miami Beach City Code
entitled "City of Miami Beach Health Facilities Authority" ; the
purpose of the subject amendment is to delete the reference in
Section 3 (b) thereof concerning the membership category of
investment banker to general business individuals of good standing
in the community. The subject amendment has been drafted so as to
provide fora broader category of membership within the City' s
Health Facilities Authority.
