AN EMERGENCY ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH INSTITUTING A BUILDING MORATORIUM
UPON PARKVIEW ISLAND, MIAMI BEACH, FLORIDA, FOR A
PERIOD UP TO AND INCLUDING NOVEMBER 21, 1979;
REPEALING ALL ORDINANCES IN CONFLICT; PROVIDING
AN IMMEDIATE EFFECTIVE DATE; AND DIRECTING THE CITY
CLERK TO PUBLISH THIS ORDINANCE.
WHEREAS, the City Commission of the City of Miami Beach,
Florida, has duly found and determined that an emergency exists
within the City affecting the present and future needs, the health,
safety, morals, order, convenience, prosperity and general welfare
of the citizens of the City of Miami Beach with respect to the
zoning of Parkview Island, Miami Beach, Florida, and
WHEREAS, the City Commission of the City of Miami Beach,
Florida, is greatly concerned that continued development of said
area will be seriously detrimental to the present and future needs,
the health, safety, morals, order, convenience, prosperity and
general welfare of the citizens of the City of Miami Beach, and
WHEREAS, the City of Miami Beach is taking steps for a
determination on whether the zoning now in effect on said area
should be reclassified, and
WHEREAS, in the formulation of such a determination,
numerous conferences and prolonged study will be required not only
by the City Commission and Planning Board, but also with and by
interested citizens representing Parkview Island and the community,
and
WHEREAS, the City Commission of the City of Miami Beach
declares a public emergency affecting life, health, property and
public safety,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA:
SECTION 1: The foregoing recitations are hereby incorporated and
adopted herein and made a part of this Ordinance.
SECTION 2: This is a building moratorium for the purpose of con-
sidering the formulation of an updated development plan
and zoning classification for Parkview Island, a subdivision in the
S.W. 1/4 of Section 2 and the S. E. 1/4 of Section 3, Township 53
South, Range 42 East, as recorded in Plat Book 60, Page 6 of the
Public Records of Dade County, Florida, and upon the adoption of
this Ordinance no permit shall be issued for the construction of any
building or improvement on Parkview Island, Miami Beach, Florida,
for a period extending up to and including November 21, 1979, from
the date hereof.

SECTION 3: All Ordinances in conflict herewith be and the same
are hereby repealed.
SECTION 4: This Ordinance is hereby adopted as an emergency
Ordinance under the provisions of applicable State
Law and Section 9 of the City Charter and shall be effective
immediately upon its passage.
SECTION 5: The City Clerk of the City of Miami Beach is hereby
directed to cause this Ordinance to be published in
full within ten (10) days of the effective date in a newspaper of
general circulation.
