Ordinance 76-2058 ORDINANCE NO. 76-2058 AN ORDINANCE REQUIRING FINANCIAL DISCLOSURE BY CANDIDATES AND ELECTED OFFICIALS OF THE CITY, THE CITY 'S DEPARTMENT HEADS AND DESIGNATED CITY BOARD MEMBERS, AND JUDGES , AND THE SPOUSES OF SAID OFFICERS , EFFECTIVE JULY 1, 1976. WHEREAS , the Florida State Legislature has enacted a new disclosure act covering public officials, which is known as Section §112. 3145, Florida Statutes, which became effective on the first day of July, 1974 ; and WHEREAS, it is the belief of the City Council of the City of Miami Beach that the aforementioned State law did not go far enough and, for that reason, the City Council of the City of Miami Beach has deemed it to be imperative that full financial disclosure be required of various officials in the City of Miami Beach, instead of a partial disclosure, as covered by the aforementioned State Statute; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1: That Chapter 2 , Article III , of the Code of the City of Miami Beach, Florida, be and the same is hereby amended by adding the following new sections, numbered and reading as follows: "Section 2-47 . 4 Candidates and elected officials of the City of Miami Beach, its City Manager, its City Attorney, City of Miami Beach Department Heads , Board Members of the following boards : Planning Board, Board of Adjustment, Housing Authority, Tourist Develop- ment Authority, and the Trustees of the Employees Retirement System, and the Municipal Judges , and the spouses of each of the foregoing, shall file with the Florida State Commission on Ethics their Federal Income Tax Return, and shall, in addition, file with the Florida State Commission on Ethics a complete net worth statement listing every asset and debt in excess of Two Thousand Dollars ($2, 000 . 00) as of January 1, 1976, within the same time limits required under Florida Statutes, Section 112 . 3145 . This filing requirement is in addition to the requirements contained in Chapter 112 of the Florida Statutes . The financial disclosure statements hereby required shall be filed with the Florida State Commission on Ethics and shall not be available for inspection by any other person except for use in proceedings and in investigations of the Attorney General, the State Attorney, and the Grand Jury. " "Section 2-47. 5 That in the event any individual of the City of Miami Beach who is convicted of willfully and knowingly violating this provision, by a court of competent jurisdiction, that court shall render that office vacant with termination of salary on date of conviction, and candidates shall be removed from ,the ballot. SECTION 3: This ordinance shall go into effect July 1, 1976 , after its passage and posting as required by law.
