AN ORDINANCE AMENDING CHAPTER 25 OF THE CODE
OF THE CITY OF MIAMI BEACH BY ADDING A NEW
SECTION TO BE NUMBERED SECTION 25-61. 2 AND
DECLARING PARKING OF MOTOR VEHICLES ON OUTLOTS
ON INDIAN CREEK, BETWEEN THE NORTHERLY LINE
OF 41ST STREET AND THE SOUTHERLY LINE OF 55TH
STREET, TO BE ILLEGAL AND A PUBLIC NUISANCE
AFFECTING THE SAFETY OF THE PUBLIC, AND
AUTHORIZING THE POLICE DEPARTMENT TO REMOVE
AND IMPOUND VEHICLES SO ILLEGALLY PARKED IN
THE MANNER PROVIDED BY ARTICLE V, CHAPTER 44 ,
OF THE CODE OF THE CITY OF MIAMI BEACH; PROVID-
ING FOR THE PASSAGE AS AN EMERGENCY MEASURE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1: That Chapter 25 of the Code of the City of Miami Beach
be and the same is hereby amended by adding a new
section thereto, to be numbered and to read as follows:
"Section 25-61. 2 .
(a) Parking of motor vehicles in that area
referred to as the outlots of Indian Creek,
the same being that area bounded on the east by
the westerly line of Collins Avenue, on the
west by the easterly bulkhead line of Indian
Creek, on the north by the southerly line of
55th Street, extended, and on the south by the
northerly line of 41st Street, shall be deemed
a nuisance detrimental to the convenience,
comfort and safety of the citizens of the city,
and the creation of such a nuisance is hereby
declared to be unlawful and hereby prohibited.
(b) That members of the police department of
the City of Miami Beach are hereby authorized
to remove and impound vehicles so illegally
parked in the manner provided by Article 'V,
Chapter 44 , of the Code of the City of
Miami Beach. "
SECTION 2 : That all ordinances or parts of ordinances in conflict
herewith be and the same are hereby repealed.
SECTION 3: That the City Council of the City of Miami Beach,
Florida, having found and determined that a public
emergency exists affecting life, health, property or public
safety, this Ordinance is hereby adopted as an emergency measure
and shall go into effect immediately upon its adoption.
