AN ORDINANCE AMENDING CHAPTER 25 OF THE CODE
OF THE CITY OF MIAMI BEACH BY ADDING A NEW
SECTION THERETO MAKING IT UNLAWFUL FOR ANY
PERSON TO DRINK ANY BEER, WINE OR ANY OTHER
ALCOHOLIC BEVERAGE ON ANY STREET, SIDEWALK,
PEDESTRIAN MALL, ALLEY, HIGHWAY, PLAYGROUND,
OR PARK; DEFINING ALCOHOLIC BEVERAGE; AND
PROVIDING PENALTIES FOR VIOLATIONS THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1: That Chapter 25 of the Code of the City of Miami Beach,
Florida, be and the same is hereby amended by adding a
new section thereto, to be numbered and to read as follows:
"Section 25-33. 1.
It shall be unlawful for any person to drink
any beer, wine or any other alcoholic beverage
on any street, sidewalk, pedestrian mall,
alley, highway, playground or park in the City.
The words "alcoholic beverage" are hereby
defined, for the purposes of this section, to
mean and include alcohol, spirits, liquor,
wine, beer and every liquid or solid containing
alcohol, spirits , wine or beer, and which
contain one-half of one percent or more of
alcohol by volume and which are fit for
beverage purposes either alone or when diluted,
mixed or combined with other substances.
Any person convicted of violating this section
shall be deemed guilty of the offense of
disorderly conduct, and upon conviction, shall
be punished as provided in Section 1-8 of
this Code. "
SECTION 2: That all ordinances or parts of ordinances in conflict
herewith be and the same are hereby repealed.
SECTION 3: That this ordinance shall become effective ten days
after passage.
