AN ORDINANCE AMENDING ORDINANCE NO. 76-2083,
SO AS TO PROVIDE THAT THE LANDLORD-TENANT
CONTROL BOARD SHALL CONSIST OF SEVEN MEMBERS;
THE APPOINTMENT BY THE CITY COUNCIL OF AN
IMPARTIAL CHAIRMAN FROM THE MEMBERSHIP
THEREOF, WHO SHALL VOTE ONLY IN CASE OF A
TIE; AND PROVIDING THAT FOUR MEMBERS THEREOF
SHALL BE DEEMED TO BE A QUORUM; PROVIDING FOR PASSAGE
AS AN EMERGENCY MEASURE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1: That that portion of Ordinance No. 76-2083 reading
as follows:
"A Landlord-Tenant Control Board is hereby created
and shall consist of six (6) members appointed by
the City Council, who shall serve for a term of one
(1) year . There shall also be appointed by the City
Council two (2) alternate members, who shall serve
in the event of disqualification or absence of any
regular member of said Board. Said alternate member
or members shall have substantially the same exper-
ience, background and special field of activity as
the member who has been disqualified by interest,
or by reason of absence. "
be and the same is hereby amended to read as follows:
"A Landlord-Tenant Control Board is hereby created
and shall consist of seven (7) members, to be
appointed by the City Council, one of whom shall
be designated by the Council as an impartial
Chairman, said Chairman will vote only in case
of a tie. All members shall serve for a term of
one (1) year. There shall also be appointed by
the City Council two (2) alternate members, who
shall serve in the event of disqualification or
absence of any regular member of said Board.
Said alternate member or members shall have
substantially the same experience, background and
special field of activity as the member who has
been disqualified by interest, or by reason of
absence. Four (4) members shall be deemed to be -
a quorum for the transaction of any business . "
SECTION 2 : All ordinances or parts of ordinances in conflict here-
with be and the same are hereby repealed.
SECTION 3 : The City Council of the City of Miami Beach, Florida,
having found and determined that a public emergency
exists affecting life, health, property or public safety, this
Ordinance is hereby adopted as an emergency measure and shall go
into effect immediately upon its adoption.
