2002-24833 Reso RESOLUTION NO. 2002-24833 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND ADOPTING AN EXPANDED PROGRAM OF PRODUCTION INCENTIVES, ATTACHED AS EXHIBIT "A" TO THIS RESOLUTION, SAID PROGRAM TO BE ADMINISTERED THROUGH THE FILM & PRINT DIVISION OF THE CITY'S OFFICE OF ARTS CULTURE & ENTERTAINMENT; FURTHER REPEALING RESOLUTION NUMBER 2001-24627. WHEREAS, the City recognizes the great value and benefit the production industry brings to Miami Beach in relation to economic impact and cultural contribution; and WHEREAS, recognizing the value and benefit of continually improving the programs and incentives the City can offer its production community and designing the incentives package to be 'user-friendly'; and WHEREAS, to recognize and respond to the City's production and entertainment industries in facilitating production within Miami Beach, and providing an increased competitive advantage to attract the domestic and international entertainment community, the City's Film & Print Division, proposes an expanded program of production incentives, as attached and incorporated in Exhibit "A" to the Resolution, to strategically and competitively position the City to attract and support the production industry in the City. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission herein approve and adopt an expanded program of production incentives, as set forth in detail in the attached Exhibit "A"; said program to be administered through the Film & Print Division of the City's Office of Arts, Culture & Entertainment; further repealing Resolution No. 2001-24267. Following this summary is the detailed changes as compared between the current and proposed Incentive package. A major difference is the simplification of the language in order to make the Production Incentives more 'user-friendly' in nature. SUMMARY The Film & Video Program changes: . Expanded to include print . Minimum qualifiers eliminated to include more clients . 1 free beach access pass offered to permitted productions . Police administrative fees waived ~ This program will benefit a much larger client base! Convention Center Parking changes . Expanded to include all permitted productions . Includes usage of lot for base camp and crew parking . Program can be utilized by more clients, even including several clients on the same day ~ This program will benefit more of our clients by expanding the program and being able to accommodate several clients each day Beach Access program: . Expanded to include an additional month of half priced passes (Applicable to beach access passes in excess of the one free beach access pass offered under the Film, Video & Print Incentive program) PCRV program . Rates reduced ($75 reduced to $50, $175 reduced to $100) ~ This makes the program more attractive, more user friendly and emphasizes the ability of the vehicles to be able to load/unload at hotels. Rates reduced (from $75 to $25) Expanded Production Incentives - Exhibit A May 8. 2002 Page 1 of 5 DEATILED INCENTIVE PROGRAM CHANGES: FILM, VIDEO & STILL PHOTOGRAPHY PRODUCTION INCENTIVE PROCRJ\M These incentives are available to Film, Television and PhotoQraphy productions in Miami Beach: . One beach access pass for vehicles (per production/per day) at no cost. . All police administrative fees waived Designed to be applied to large television/feature film projects Miami Beach hosts each year, these productions can take o'.'er a month of coordination work and typically film locally for extended time periods. These projects have the highest budgets and economic impact, with a'lerage daily budgets that average bet\veen $150,000 and $500,000, per day. FQr a Film to Qualify: 1) It must meet or exceed two out of these three categories: . Size of (local) crew: 75 or more . Days in Production in Miami Beach: 5 or more . Total Budget: $1,000,000 or more 2) It must meet or exceed a minimum of 100 room nights total during the length of the production in Miami Beach Qualified Film v:Qwd receiv.e: . '.Naiver of vehicle beach access fees (per production), limited to 12 vehicles per day. . Elimination of Police administrative fees ($20 per officer) . Use of the Convention Center Parking Lot (P Lot) for no cost crew parking (only if available for use not to be in conflict with any City/Convention Centor event) Convention Center Parking When not in use for a Convention Center, The Gleason or other City event, the Convention Center Parking Lot can be made available to permitted productions at no charQe to productions, f.or base camp, crew parking or filming location at no charge under the following conditions: Expanded Production Incentives - Exhibit A May 8, 2002 Page 20f 5 . Permitted production companies may utilize the lot (not to exceed 200 spaces) to use as a base camp for a 24-hour period. A production may also utilize the lot for crew parking if available. There is no charge for either usage. For a fee of $250, production companies will receive 1.'<1 of the Lot (not to exceed 200 spaces) to use as a base camp for a 24 hour period. A production may also purchase a permit for crew parking for the same area and price. . Consideration for neighboring residents and businesses would be paramount in permitting the use of this Lot. Guidelines established for Residential Filming would be applied to Convention Center parking requests and will address hours of operation or other aspects of the production that may have impact on the surrounding residents. These guidelines require a percentage of affirmative "sign-offs" from affected neighbors for parking requests which exceed "normal" hours of operation and specifically address residential concerns in respect to productions. The Film & Print Division and the Parking Department would administer this aspect of the Program jointly. PRODUCTION COMPANY MOBILE UNIT (PCRV) PERMIT Parking of production mobile units is a top issue for our key fashion/print companies. These large vehicles, '....hich are converted mobile recreation vehicles, house wardrobe, hair, makeup, portable studios, dressing rooms, lounges and operate as offices. In response to the concerns expressed by this industry, it is proposed that a PCR'! decal/pass be developed that would allow these production units to park (legally) 'Nithout having to 'Norry about feeding meters. This Program will not be in effect for Residential Parking Zones. The permit would be made available for the following fees: A PCRV pass allows production units (RVs) to park leQally at meters, at commercialloadinQ zones (within posted limits) and limited 10adinQ and unloadinQ at businesses and hotels The permit would be made available for the followinQ fees: . $50 for a one month city wide PCRV pass $75 per month one month at a time City wide . $100 for a three month city wide PCRV pass $175 for three months all three months bought at once City wide $25 discounted incentive rate for one month North Beach (north of 63"' street) Expanded Production Incentives - Exhibit A May 8, 2002 Page 30f 5 The Film & Print Division and the Parking Department would administer this aspect of the Program jointly. BEACH ACCESS When a production requires more than one beach access pass each day - the costs shall be reduced by 50% between June and October. To encour3ge production during Miami Beach's off season, it is proposed to offer Beach Access Permits at a reduced rate. This program would not be promoted to incre3se the amount of vehicles on the beach, but rather we hope that this incentive will be used to help attr3ct productions during slower production months. . During the months of June through September, we 'Nould reduce vehicle beach access by 50% to $75.00 (per vehicle/per day) . This Vehicle administered in policies. Beach Access Program is currently accordance .....ith the City's beach uS3ge NOTE: Beach access for production vehicles requires an off-duty officer to be on site with a production. This would be coordinated between the Film & Print Division and the Police Department, with the Film & Print Division assuming all administrative duties. SCOUTING PERMITS Temporary scoutinQ permits shall enable cars to park at leQal metered parkinQ at no cost and within commercialloadinQ zones (within posted maximum times). ScoutinQ permits are limited in time (typically not for more than one day), and are $25.00 per day. ScoutinQ Permits shall be issued at the direction of the Film & Print Office. Identified as a priority issue by production professionals, scouting permits will 3ssist production scouts with ease of access. Scouting is when a producer or director travels to soveral "potential" filming sites to assess their suitability to a particular project. The permit will allO'.\I cars to park at legal metered parking at no cost and within all residential zones. It would also allow 3 max of 20 minutes in (marked) loading zones. . The scouting permits would be limited in time (typically not for more than one day). . A $50 per day charge will apply. . This program would utilize a hang tag system similar to the hang tag system currently used by the Parking Department for Residential Guest Parking in 'J:hich passes are numerically tracked and are limited in time by usage of a "scratch off' date. The Film & Print Division and the Parking Department would administer this aspect of the Program jointly. Issue: Expansion of Production Incentives, originally adopted in April 2001 by the City Commission, will benefit more productions. Qualifiers were eliminated to open the program to more productions, some fees were reduced and the program was made simpler to participate in. The expanded incentives will make the benefits of this program available to all permitted productions, including still photography productions, through the elimination of the qualifiers established in the original incentives program. The estimated impact of the elimination of off-duty administrative fees for productions is $15,000. Item Summary/Recommendation: I Approve the item. ANALYSIS In April of 2001, the City Commission adopted a program of Production Incentives that were enacted to facilitate, support and attract the production industry in Miami Beach. Since adoption, the Film & Print Division has met and collaborated with clients, community and industry groups to refine and expand the program in order to improve the services offered to productions. The expanded incentives will make the benefits of this program available to all permitted productions, including still photography productions, through the elimination of the qualifiers established in the original incentives program. The incentives facilitate the use of under utilized parking for crew and base camp, which will reduce the parking crunch in the City's impacted areas. The prices for the Scouting Passes and the Mobile Production Vehicle or PCRV Program have also been reduced to make the program more user- friendly and accessible. An aspect of the expanded incentives will eliminate administrative fees associated with the hiring of off-duty officers by productions. Police off-duty administrative charges are currently assessed at a rate of $3.00 per officer/per hour (4 hour minimum). This administrative fee, over all, yielded $270,000 in 2001 to the General Fund. It is estimated that approximately 5% of the total amount generated by off-duty administrative fees is specifically from productions, and the estimated impact to eliminating this fee will be $15,000. Through meetings with industry groups, community leaders and production industry professionals, expansion of the Incentive Program has garnered unanimous support. To serve this industry, the Office of Arts, Culture & Entertainment consistently re-examines the services offered in an effort to position the City as attractive and user friendly. Expanding the Incentive Program demonstrates the City's commitment to serve our clients and nurture our key Beach industries. This expanded Incentive Program has been presented to, and has received the endorsement of, all related City Departments, in addition to, the Miami Beach Production Industry Council, the Mayor's Blue Ribbon Task Force of Tourism and Travel, Miami Beach Chamber of (~?mmerce, the State Film Office, and the Miami-Dade County Film Office.
