A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA,
APPROPRIATING FUNDS, IN THE AMOUNT OF $3,382,069,
FROM THE GULF BREEZE LOAN POOL, FOR THE
BAYSHORE GOLF COURSE CLUBHOUSE AND RELATED
FACILITIES, IN PREPARATION FOR THE PROJECT BID,
AND FOR THE PROJECT CONTINGENCY, TESTING, ART IN
PUBLIC PLACES ALLOCATION, AND PROJECT
MANAGEMENT; ALLOCATING AND TRANSFERRING
$24,360 . FROM THE GULF BREEZE LOAN POOL
APPROPRIATION TO THE ART IN PUBLIC PLACES FUND.
WHEREAS, on May 7, 1998, the City issued Request for Qualifications No. 58-
97/98 for Architectural and Engineering Services for the Redesign andlor Renovation of
the Bayshore/Par 3 and Normandy Shores Golf Courses Clubhouses and Related
Facilities (the Project); and
WHEREAS, on June 8, 1998, an Evaluation Committee reviewed the submitted
proposals and recommended the selection of the firm of REG Architects, Inc. (REG) to
the City Manager; and
WHEREAS, on January 6, 1999, the Mayor and City Commission authorized the
execution of an Agreement with REG for a schematic design plan and for cost
estimates for both clubhouses, and services were to be completed by April 1999
(Agreement); and
WHEREAS, on October 9, 1999, the Mayor and City Commission adopted a
Resolution approving the overall plan for the renovation of the City's golf courses and
facilities, and authorized the Administration to provide the necessary financing to
implement the Project; and
WHEREAS, on February 9, 2000, the Mayor and City Commission approved the
financing strategy for the renovation of the Bayshore and Normandy Shores Golf
Courses and Clubhouses, and referred the plan to the Finance and Citywide Projects
Committee (Committee) for review of the projected costs; and
WHEREAS, the Committee met on February 24,2000, reviewed the information
provided and recommended that the Administration proceed with completion of the
design and construction documents for the projects as proposed; and
WHEREAS, on July 12, 2000, the Mayor and City Commission adopted a
Resolution authorizing additional services to REG, in the amount of $57,750, for the
design of the Bayshore Golf Course Maintenance Facility, and established the
construction budget for the additional work at $650,000; and
WHEREAS, REG has completed the permit process and obtained all necessary
signatures; and
WHEREAS, in view of the above, the City intends to issue an Invitation to Bid for
the construction of the Bayshore Golf Course Clubhouse and related facilities in late
May 2002; submit a recommendation for award at the second meeting in June 2002;
and begin construction in July 2002; and
WHEREAS, the Administration is seeking appropriation of the remaining
Bayshore Golf Course Clubhouse project budget allocation, in the amount of
$2,116,142, for the clubhouse construction, contingency, Art in Public Places, and
fixtures, furniture and equipment; the allocation for the Golf Course Maintenance Yard,
in the amount of $651,128, for the Maintenance Yard construction and contingency;
and the allocation for the CIP Project Management fee, the unappropriated balance of
the Program Management fee for URS, and the remaining funding, in the amount of
$614,799, for contingencies and other related project costs; for a total appropriation of
$3,382,069; and
WHEREAS, upon appropriation, the Art in Public Places allocation, in the
amount of $24,360, will be transferred to the Art in Public Places fund.
NOW THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission appropriate funds, in the amount of $3,382,069, from the Gulf Breeze
Loan Pool, for the Bayshore Golf Course Clubhouse and Related Facilities, in
preparation for the Project Bid, and for the Project Contingency, Testing, Art in Public
Places, and Project Management; and further transfer $24,360 of the Gulf Breeze Loan
Pool appropriation to the Art in Public Places Fund.

Item Summary/Recommendation:
The Administration intends to issue an Invitation to Bid for the Bayshore Golf Course Clubhouse and
related facilities in May 2002 and recommend for award to the Mayor and City Commission in June 2002.
In preparation for this Bid, the Administration is requesting appropriation of all funds allocated for the
construction, contingency. project management, Art in Public Places, testing and furniture, fixtures and
equipment for the project from the $10,000,000 available in the Gulf Breeze Loan Pool for the overall
Bayshore Golf Course project. The City Manager recommends the appropriation.

ANALYSIS
On May 7, 1998, the City issued Request for Qualifications 58-97/98 for architectural
engineering services for the redesign andlor renovation of the BayshorelPar 3 and
Normandy Shores golf courses clubhouses and related facilities.
On June 8, 1998, an evaluation committee reviewed the submitted proposals. After
presentations were made, the committee recommended the selection of the firm of REG
Architects, Inc. (REG) to the City Manager. On October 7, 1998, the Mayor and City
Commission, following the Manager's recommendation, authorized the Administration to
negotiate an Agreement with REG.
On October 9, 1999, the Mayor and City Commission adopted a resolution approving the
overall plan for the renovation of the City's golf courses and facilities and authorized the
Administration to provide the necessary financing to implement the project.

On February 9, 2000, the Mayor and City Commission approved the financing strategy for
the renovation of the Bayshore and Normandy Shores golf courses and clubhouses and
referred the plan to the Finance and Citywide Projects Committee for review of the
projected costs. The Committee met on February 24, 2000, reviewed the information
provided and recommended that the Administration proceed with completion of the design
and construction documents as proposed. The Mayor and City Commission accepted the
recommendation at the March 15, 2000 meeting.
On October 17,2001, the Mayor and City Commission adopted a resolution approving the
award of a construction contract to TDI International, Inc., for the renovation of the
Bayshore Golf Course. Construction on the project began on December 3, 2001, with a
projected completion of October 2002, when the course will be re-opened.
On November 16, 2001, the City issued a letter to REG notifying them that under the
conditions of the Agreement with the City, they would be considered in default unless a
written plan of action was received within seven days of receipt of the letter. REG
responded by the established deadline by retaining the firm of ONM on November 26,
2001 to perform the structural services and by providing a plan of action. The plan
required delivery of all permit review approvals, on all portions of the project, by December
21, 2001. If the documents were not ready for permitting at that time, the City would
consider Termination for Cause, pursuant to Article 4.11.1, in accordance with the
conditions of the Agreement with REG.
In view of the failure by REG to provide a set of documents ready for permitting and to
obtain the necessary signatures from the structural reviewer of the Building Department,
the Administration recommended, on January 9, 2002, that the Mayor and City
Commission authorize the Termination-for-Cause of the Agreement with REG Architects,
Inc., for architectural and engineering services for the design and construction documents
for the Bayshore and Normandy Shores golf courses clubhouses and related facilities.
At the request of REG, this recommendation was modified by an Amendment to their
Agreement with the City, which stated that REG would: 1) comply with additional deadlines
and a new timeline on the permitting process; 2) relinquish some of the fees on the Project
by the deletion of the Normandy Shores Clubhouse component of the original Agreement;
3) agree to be paid for the Construction Administration fees atthe end ofthe project; and 4)
provide an additional bond on the project in a form to be determined by the City.
The City Commission approved the amendment to the Agreement and directed the
Administration and the City Attorney to finalize the documents and allow REG to complete
the Project under the new conditions.
REG has complied with the permitting, reduction of scope and fees components of the
amendment to the Agreement.

In view of the above, the City intends to issue an Invitation to Bid for the construction ofthe
Bayshore Golf Course Clubhouse and related facilities in late May 2002, submit a
recommendation for award at the second meeting in June 2002 Commission meeting and
begin construction in July 2002.
The completion of the Clubhouse and Maintenance Facility at Bayshore Golf Course is now
expected for early 2003. The golf course renovation portion will be completed in October
2002 and temporary facilities will be provided while construction of the new clubhouse is in
progress. A new schedule will be provided with the recommendation for award in response
to the Invitation to Bid for the Bayshore Golf Course Clubhouse and Maintenance Facility
construction.
The Administration is seeking appropriation of the remaining Bayshore Golf Course
Clubhouse project budget allocation, in the amount of $2,116,142, for the clubhouse
construction, contingency, Art in Public Places, and fixtures, furniture and equipment; the
allocation for the Golf Course Maintenance Yard, in the amount of $651,128, for the
Maintenance Yard construction and contingency; and the allocation for the CIP Project
Management fee, the unappropriated balance of the Program Management fee for URS,
and the remaining funding, in the amount of $614,799, for contingencies and other related
project costs; for a total appropriation of $3,382,069. Upon appropriation, the Art in Public

BAYSHORE GO F COURSE WALKING PATH

As requested by the City Commission, I have directed staff to consider the feasibility of
creating a pedestrian walkway around the perimeter of the Bayshore Golf Course. Staff
has advised that discussions have taken place with representatives of Arthur Hills, the Golf
Course designer, on this issue. Staff last met with Arthur Hills on Wednesday, March 20,
2002 to continue this discussion.
The designer has verbally expressed reservations to the idea of a pedestrian walkway
around the entire golf course perimeter on the basis that it may create an unsafe condition.
Staff has previously requested the designer to explore possibilities for a perimeter walkway
and/or a partial walkway in areas where it may be safe for pedestrian traffic. Staff also
requested that the designer provide its recommendations in writing once this process is
complete. Attached is the designer's written recommendation indicating their reservations
to any pedestrian walkway for safety reasons. These reservations based on safety are
also shared by URS, the City's Program Manager for the project, and CIP staff.
Essentially, the golf course is a contained site in the sense that there is relatively little
space around the fairways to safely allow pedestrian traffic. In considering the issue,
several locations were examined. Regardless of where a potential pathway is located, it is
within a zone that will place pedestrians, potential joggers, bicycle riders, etc., in an area
that is open to errant golf balls. There is insufficient space on the golf course to place a
pedestrian path without putting anyone using the path in danger of being hit by golf balls.
In addition to the reservations provided by the designer based on safety, there are also
operational issues that must be considered. The City has made the decision to invest $1 0
million in the renovation of the Bayshore Golf Course into a championship facility. The City
has hired a premier golf course management firm, Professional Course Management
(UPCMU), to manage the facility and to keep it properly maintained. Projected greens fees
during season are expected to be in the range of $120 to $150 per round for the visiting
tourist. At these rates, which are necessary in order to fund the debt service for the
improvements, and given that this will be a high-end golf course, it would be customary to
limit public access to the golf course as an expectation of the client.
It should also be noted that prior to the City making the commitment to proceed with the
comprehensive redesign and reconstruction of the Bayshore Golf Course, a consultant was
retained by the City to complete an analysis of our golf courses and develop future

alternatives and evaluate the future market and financial potential of the options. The
selected firm, ERA (Economics Research Associates) completed the analysis including a
review of the use of Bayshore Golf Course by the non-golfing public and the impact this
activity has had and will continue to have if permitted.
Specifically, the analysis noted,
"Most homes are set back far enough to not intrude on play. However, at
present, there is no fence or other barrier to prevent local area residents
from using the golf course for other purposes, such as biking, walking, and
playing catch. Use by non-golfers is reportedly a very serious issue, with
golfers regularly being forced to play through or around other non-permitted
activities. If Bayshore is extensively renovated and repositioned to serve a
more upscale market niche, it will be absolutely critical to rectify this problem
by erecting a fence or other barrier to effectively limit trespassing".
This finding was noted in several sections of the final analysis and clearly indicated that if
the access to the course by non-golfers is not restricted it will substantially impact the
revenue potential of the golf course and negatively impact the City's ability to cover
operational and debt service related costs.
It should further be noted that, as the golf course will be operated under a management
agreement with PCM the City will be responsible for all costs of operations, including the
payment of insurances that PCM will be required to maintain. The City will pay the cost of
the policy, and any claim made against the insurance as a result of a non-golf related
incident, may result in an increased premium or potentially a cancellation of the policy. In
any case the risk and cost of permitting the non-golfing public on the course is directly the
City's.
While Bayshore is likely to be problematic for walking path development, there is clearly
value to the community for such a facility. As an alternative, the Commission may wish to
have the administration entertain such a use around the perimeter ofthe Par 3 golf course.
Such an analysis would fit well within a review of facilities that is anticipated as a
recommendation of the Parks Blue Ribbon Committee.
