Ordinance 80-2224 ORDINANCE NO. 80-2224 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING SECTIONS OF THE CODE OF THE CITY OF MIAMI BEACH, FLORIDA, BY PROVIDING FOR REVISED MUNICIPAL OCCUPATIONAL LICENSE FEE SCHEDULE; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE OF THE ORDINANCE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1 : That Section 7-63 of the Code of the City of Miami Beach, Florida, is hereby amended to read as follows : "Sec. 7-63. License to operate docks , etc. , for mooring boats , etc. - Required. It shall be unlawful for any person to maintain or operate any wharf , dock , bulkhead, mooring or other means of securing a boat to the shoreline in the city for the mooring or other means of securing any boat unless the owner or operator of such wharf, dock , bulkhead, mooring or place of securing such boats has first secured a license for the operating thereof , as provided by Section 7-64, and has paid to the Finance Director a license fee of eee-4e41a-F-€4€ty-eeets two dollars per lineal foot of bulkhead and tweety- ie-414e.1.1a-Fs thirty- seven dollars per boat slip. No license shall be issued except as provided by Section 7-64. But nothing herein shall be construed so as to require the owner or lessee of a single- family residence to secure a license in order to dock, moor or otherwise secure a boat owned by him or a member of his immed- iate family to a wharf, dock, bulkhead, mooring or other means of securing a boat, which is located on the owned or leased premises . " SECTION 2: That Section 7-71 of the Code of the City of Miami Beach, Florida, is hereby amended to read as follows : 4tce ??4es Lace7)41.4 ems, irsi ;e= "Sec. 7-71. Application for. p ml-tis ; granting permit-s . Any person desiring to moor or dock a housebarge shall file an application for an annual license to do so with the Finance Director and shall submit a fee in the amount of e4eety della.ps one hundred thirty-five dollars. Such application must be accompanied by a sketch or drawing of the proposed location of the housebarge. The Finance Director shall issue such license if the following conditions are met: (1) The applicant owns or has an agreement on the land or water over which the housebarge is proposed to be moored or docked. (2) The housebarge is in a zoning district where it is not prohibited. " SECTION 3: That Section 16-52. 3 of the Code of the City of Miami Beach, Florida, is hereby amended to read as follows : "Section 16-52. 3. Same-License-Generally. It shall be unlawful for any person to engage in the business of selling or offering to sell any food, food products, bev- erages or merchandise held out to be kosher unless he shall have procured from the city, in addition to the occupational license required under the provisions of Chapter 20, an annual OFFICE OF THE CITY ATTORNEY - 1700 CONVENTION CENTER DRIVE -MIAMI BEACH, FLORIDA 33139 special license, licensing his place of business as a Kosher" establishment. Any person violating the terms of this section shall be subject to the penalties provided by Chapter 20. " SECTION 4: That Section 27-12. 1 of the Code of the City of Miami Beach, Florida, is hereby amended to read as follows : "Section 27-12.1 . License and inspection fees . The following schedule of license fees shall be charged by the Finance Director for each license issued under the provisions of this chapter, or any renewal of such license: (a) Ferny-€4ve-Dollars Sixty-seven Dollars parking lots up to 7, 500 square feet. (b) Si-xty-five-Deilars Ninety-seven Dollars for parking lots of 7, 501 to 15, 000 square feet. (c) Ele}hty-€lve-Sellars One Hundred Twenty-seven Dollars for parking lots of over 15, 000 square feet ; provided, however, that nothing herein shall be applicable to any condominium building.
