AN ORDINANCE OF THE CITY OF MIAMI BEACH,
FLORIDA, REPEALING CHAPTER 8, SECTION 8-4
OF THE MIAMI BEACH CODE WHICH IMPOSED A
MORATORIUM ON PARKVIEW ISLAND PENDING AN
UPDATED DEVELOPMENT PLAN.
BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA:
Section 1. Chapter 8 is hereby amended by repealing
section 8-4 as follows:

Section 2. This ordinance shall go into effect upon its
passage in accordance with law.

SUBJECT: Parkview Island Building moratorium, prior to adoption of
ordinance rezoning Parkview Island on March 5, 1980, and
placing Block 1 and Tract B in the RM 24 Multiple -Family
District

The City Commission, prior to the adoption of the Zoning ordinance rezoning
Block 1 and Tract B, on Parkview Island, in the RM -24 Multiple Family
Low Density District, enacted a series of ordinances imposing a moratorium
on Parkview Island until the zoning ordinance could be finally enacted and
be in force.
This moratorium is reflected in the Code of the City as Section 8.4.
It is the recommendation of the City Manager,- concurred in by the City Attorney,
that Section 8.4 should be repealed and decodified, because
1) The City Commission adopted new zoning regulations for Parkview Island by
Ordinance No. 80-2204, adopted March 5, 1980, and
2) The moratorium ordinances adopted prior to March 5, 1980, expired by
reason of the zoning ordinance adoption.
The attached ordinance which has been prepared by the City Attorney, accomplishes
this purpose.
It is a housekeeping item and in no way affects the zoning ordinance which
has reclassified Parkview Island, and is an item brought to the Administration's
attention by the City Clerk in relating to keeping the City Code current.

This office concurs with your view that since:
(1) The City Commission adopted new zoning
regulations for Parkview Island, and (2)
The moratorium ordinance expired by reason of
the provisions contained therein, Section 8-4
of the City Code should be officially repealed
and decodified.
Hence, the attached ordinance has been prepared
for your review and submittal to the City Com-
mission.
