Ordinance 73-1977 ORDINANCE NO. 73-1977
A ORDINANCE AMENDING ORDINANCE NO. 73-1975;
REENACTING AND READOPTING THE SAME; AND
PROVIDING FOR THE ADOPTION HEREOF AS AN
EMERGENCY ORDINANCE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA, that:
SECTION 1. That Ordinance No. 73-1975 of the City of Miami Beach,
Florida,
be and the same is hereby amended to read as follows :
1) That Ordinance No. 73-1975 of the City of Miami
Beach, Florida be and the same is hereby amended
by adding the following words immediately after the title of
said Ordinance No. 73-1975 :
" Be it ordained by the City Council of the City
of Miami Beach, Florida: "
2) that paragraph "e" of Section 3 of Ordinance No. 73-1975 be and
the same is hereby amended to read as follows :
" Freeze Date Maximum Rent - The maximum lawful rent
for the use of housing accommodation, including any
rental increase which took effect on October 1, 1973
and the dwelling space and all essential services,
furniture, furnishings and equipment provided or
required to be provided on the first day of October,
1973, or, if never previously rented, on the date of
first renting after October 1, 1973 . If an accom-
modation was vacant on that date, the maximum rent
shall be the rent last collected. "
3) that paragraph "c 1 ii" of Section 4 be and the same is hereby
amended to read as follows :
" Where a lease had been entered into prior to
December 31, 1973, a landlord shall be permitted to
collect the guidelines increase, commencing October
1, 1974 and each succeeding October 1, until the
expiration of the lease at which time the provisions
of this paragraph shall prevail. "
4) that portion of Section 12, of Ordinance No. 73-1975 reading as
follows :
" and imprisonment for a
p period not to exceed sixty
(60) days"
be and the same is hereby amended to read as follows :
" and/or imprisonment for a period not to exceed
sixty (60) days . "
SECTION 2. That said Ordinance No. 73-1975 is hereby reenacted
and readopted.
SECTION 3 . This Ordinance shall go into effect January 1, 1974.
SECTION 4. All Ordinances in conflict herewith be and the same
are hereby repealed.
SECTION 5. That the City Council of the City of Miami Beach,
Florida, having found and determined that a public
emergency exists affecting life, health, property or public safety,
this Ordinance is hereby adopted as an emergency measure.
