AN ORDINANCE AMENDING SECTION 18-45 OF THE
CODE OF THE CITY OF MIAMI BEACH, FLORIDA,
PROVIDING FOR THE MANNER OF SALE OF
ALCOHOLIC BEVERAGES IN THE "D" LIQUOR
DISTRICT BY AUTHORIZING THE SALE OF LIQUOR
FROM SERVICE BARS IN RESTAURANT FACILITIES
LOCATED IN APARTMENT BUILDINGS HAVING 400
OR MORE DWELLING UNITS AND WHICH RESTAURANT
FACILITIES HAVE 4, 800 SQUARE FEET AND SEAT-
ING CAPACITY FOR 480 PATRONS, AND LOCATED
IN SAID "D" LIQUOR ZONING DISTRICT.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1. That Section 18-45 of the Code of the City of Miami
Beach, Florida, reading as follows :
"In any "D" district, the sale of liquor
is prohibited, except in "clubs" and in
hotels having one hundred or more
sleeping rooms; provided, that each of
the hotel sleeping rooms shall meet the
requirements of section 1305. 2 of the
South Florida Building Code; provided
further, that the exterior of the
hotel in which the business is carried
on shall not contain a store front in
connection with such business and the
business so licensed shall only be
entered from within the building. " ,
be and the same is hereby amended to read as follows :
"In any "D" District, the sale of liquor
is prohibited, except in clubs and
hotels having one hundred (100) or more
sleeping rooms, which sleeping rooms shall
meet the requirements of Section 13.05. 2
of the South Florida Building Code, and
except in restaurant facilities located
in apartment buildings having four hundred
(400) or more dwelling units and which
restaurant facilities have 4 , 800 square
feet and have seating capacity for 480
patrons; provided further, that the
exterior of the hotel or apartment facility
in which the business is carried on shall
not contain a store front in connection
with such business and the business so
licensed shall only be entered from within
the building. Further provided that the
sale of liquor from restaurant facilities
located in apartment facilities as herein-
above described, shall be limited to sale
of said liquor from a "service bar" as
defined in Section 18 . 2 of this Chapter. "

SECTION 2. All ordinances or parts of ordinances in conflict
herewith be and the same are hereby repealed.
SECTION 3. This Ordinance shall go into effect immediately upon
passage and posting as required by law.

having been passed and adopted by the City Council of the City of
Miami Beach, Florida, has been posted by me at the door of the City Hall
in said City on the 17th day of May , 1974,
and that said Ordinance remained posted for a period of at least thirty
days in accordance with the requirements of the City Charter of the said
City of Miami Beach.
