AN ORDINANCE AMENDING SECTION 42-5 AND
SECTION 42-9 OF THE CODE OF THE CITY OF
MIAMI BEACH, WHICH PERTAINS TO TAXICABS AND
OTHER VEHICLES FOR HIRE; DELETING THE PRO-
HIBITION AGAINST ISSUANCE OF PERMITS TO
TAXICABS MORE THAN FIVE (5) CALENDAR YEARS
OLD; REPEALING ARTICLE II, Section 42-9,
REGARDING REGULATIONS GOVERNING OPERATION
OF TAXICABS; CREATING A NEW SECTION 42.9;
PROVIDING FOR THE AUTHORITY OF THE CHIEF
OF POLICE TO PROMULGATE REASONABLE RULES
AND REGULATIONS AS MAY BE NECESSARY TO
GOVERN THE OPERATION OF TAXICABS PURSUANT
TO THE PROVISIONS OF ARTICLE II OF
CHAPTER 42 OF THE CODE OF THE CITY OF
MIAMI BEACH, AND SUBJECT TO THE APPROVAL
OF THE CITY MANAGER; REPEALING ALL ORDI-
NANCES IN CONFLICT HEREWITH; AND PROVIDING
FOR AN EFFECTIVE DATE OF THE ORDINANCE.

BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA:
SECTION 1: That Section 42-5 of the Code of the City of Miami Beach,
Florida, is hereby amended to read as follows:
"Sec. 42-5. Vehicles for which permits may not be issued.
No permit shall be issued, and it shall be unlawful for
any motor vehicle to be operated as a taxicab within the
city, if
(1) It has ever been used as a taxicab in another state.
(2) It has ever been used as a police car.

In addition, no permit shall be issued for any motor vehicle
to be operated as a taxicab within the city unless such vehicle
is equipped with an operational and mechanically sound auto
air -conditioner."
SECTION 2: That Chapter 42, Article II, Section 42-9 of the Miami
Beach Code be and is hereby repealed.
SECTION 3: That Chapter 42, Article II, is hereby amended by the
addition of a new Section 42-9 to read as follows:
Sec. 42-9. Regulations governing operation.
The Chief of Police shall have the power and authority
to promulgate reasonable rules and regulations as may be
necessary to govern the operation of taxicabs pursuant to
the provisions of this article and subject to the approval
of the City Manager. Such rules and regulations shall be
known as the Administrative Rules and Regulations for
Taxicabs, and violation of any such rules and regulations
will subject the driver or certificate -holder, or both,
to penalties, as provided for by provisions of this article.
Each applicant shall receive a copy of all existing rules
and regulations.
The Administrative Rules and Regulations for Taxicabs
shall include, but not be limited to: standards of conduct
for taxicab drivers, standards for physical and safety con-
ditions of taxicabs, prohibitions against modification of

taxicabs after a permit for same has been granted,
method for identifying certificate -holders on each
vehicle licensed as a taxicab, standards for advertis-
ing on licensed taxicabs, requirement that identification
of each licensee be displayed in licensed taxicab, and
any other regulations consistent with this subsection
as may be deemed necessary for operations under this
article.
SECTION 4: REPEALER. That all ordinances or parts of ordinances
in conflict herewith be and the same are hereby repealed.
SECTION 5: This Ordinance shall become effective upon its passage
in accordance with law.
