AN ORDINANCE OF THE CITY OF MIAMI BEACH FLORIDA
REGULATING THE DISPOSITION OF WEAPONS, FIREARMS,
AND CONTRABAND SEIZED BY POLICE; PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1: DECLARATION OF PURPOSE: This measure is adopted by the
City Commission in response to the enactment of Chapter
80-68, Laws of Florida by the Florida Legislature, and Sections 943.
41-44 Florida Statutes, known as the Florida Contraband Forfeiture
Act, which defines contraband articles or property, and permits the
seizure thereof, and subsequent acquisition of title by a law enforce-
ment agency.
SECTION 2: Chapter 25-107 of the City Code of the City of Miami Beach,
Florida, be and the same is hereby amended by deleting
former Section 25-107 and adding a new section to be so designated
and which shall read as follows:
"SECTION 25-107:
(1) The Florida Contraband Forfeiture Act, adopted by
the Florida Legislature as amended up to and including July 1, 1980,
three copies of which are on file in the office of the City Clerk,
and may be found at Chapter 80-68, Laws of Florida, and Sections
943.41-44 Florida Statutes, is hereby adopted as the Contraband
Forfeiture Act of the City.
(2) It shall be the duty of every police officer, upon
making any arrest and taking any contraband article under any
provision of this chapter, to deliver such to the officer in charge
of the property management unit of the City's Police Department, to
be held until the final determination of the prosecution by the court
and thereafter until the final determination of forfeiture proceedings
under Section 943.44 Florida Statutes.
(3) As referred to in Section 943.44 Florida Statutes (1950),
the phrase "such attorney as may be employed by the seizing agency"
shall mean the Municipal Prosecutor, City Attorney, or his designated
assistants. It shall be the duty of the Police Department to promptly
notify in writing, the Municipal Prosecutor, City Attorney, of any
contraband article or property, acquired or seized by the Police
Department, in order for forfeiture proceedings to be considered
and, if appropriate, commence.
(4) As referred to in Section 943.44(3)(b) Florida Statutes,
there is hereby established a Law Enforcement Trust Fund to be main-
tained and administered by the Office of the City Manager."
SECTION 3: EFFECT ON OTHER LAWS. The provisions of this Ordinance
shall be cumulative and additional to any and all State,
County, and Miami Beach laws governing the possession and use of
contraband articles or property; the provisions of this Ordinance
shall repeal those Miami Beach Code provisions inconsistent herewith.

SECTION 4: SEVERABILITY. If any section, subsection, sentence,
clause, phrase, or portion of this Ordinance is, for
any reason, held invalid or unconstitutional by and court of com-
petent jurisdiction, such portion shall be deemed a separate, distinct
and independent provision and such holding shall not affect the
validity of the remaining portions of this Ordinance.
SECTION 5: EFFECTIVE DATE AND DURATION. This Ordinance shall
take effect immediately upon enactment in accordance
with law.

Section 2. Subsection (4) -is added to. section 943.42, Florida
Statutes, to read:

(4) To conceal or possess any contraband article.
Section 3. Section 943.43, Florida Statutes, is amended to read:
943.43 Forfeiture of vessel, motor vehicle, 'er aircraft, other
personal pronerty„ or contraband articler exceptions.--

(3)(a) Whenever. the head of the law enforcement agency effecting the
forfeiture deems it•necessary or expedient to sell the property forfeited ?-
rather- than retain it for the use of the law enforcement agency, or if y

involved in effecting the forfeiture, the court having 'rise=ction over
the forfeiture proceeding shall equitably distribute t. -.e property among
the seizing agencies. Any forfeited .money or currency. or any proceeds
remaining after the •saie of the property shall be eceitabl_y distributed'
to the Board of County Commissioners or the coverning body of the
municipality having budgetary control over the seizine law enforcement
agencies for deposit into the Law Enforcement Trust Fund established
pursuant to s. 943.44(3)(a) of this act. In the event the seizing law
enforcement aaency is a state agency, the court shall direct that all
