AN ORDINANCE REQUIRING DISCLOSURE OF GALLON PRICE ON EACH
GASOLINE PUMP WITHIN THE CITY OF MIAMI BEACH ,FLORIDA.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA:
SECTION 1: COMMISSION INTENT.
The City Commission of the City of Miami Beach has observed that gasoline stations
in the City do not uniformly disclose fuel prices in gallon units, leading to wide-
spread confusion by motorists. In addition, the Commission has observed that price
disclosures through roadway signs, pursuant to §8A-4 of the Dade County Code, often
do not correspond to prices actually charged at individual fuel pumps.
Accordingly, this Ordinance is intended to require gas stations to disclose on each.
fuel pump the actual retail price, in Lallon units, of the fuel dispensed by each
such pump. Pumps which already disclose such information by meters or by mechanical
or electric displays, shall not be affected by this Ordinance. However, pumps which
disclose fuel price in liter units, or which disclose a percentage of the total retail
price shall require the attachment of conspicuous signs legibly disclosing the total
per -gallon price of each fuel.
SECTION 2: PRICE DISCLOSURE REQUIREMENTS.
Every person, firm, corporation or other legal entity operating a gas station in the
City of Miami Beach which sells or offers to sell motor vehicle fuel, including gasoline,
gasohol and diesel motor fuel, shall display on each fuel pump the gallon price of
fuel dispensed therein. Said gallon -price disclosure shall be by legible signs, no
smaller than ten inches by five inches, to be conspiciously posted on the face of each
fuel pump. Each sign shall disclose the retail price per gallon, inclusive of all
taxes, of the motor vehicle fuel dispensed by the pump upon which it is posted.
SECTION 3: EXEMPTIONS.
This ordinance shall not apply to any gasoline pump which is designed to disclose, by
mechanical or electric means, the actual price of fuel dispensed by the pump, provided
the price disclosed by such a pump is in gallon units and is the actual price thereof
rather than a portion or percentage of said actual price.
SECTION 4: OTHER LAWS & CODIFICATION.
This ordinance shall be in addition to the requirements of §8A-4 of the Dade County
Code. This ordinance shall repeal any other Miami Beach ordinances or parts of
ordinances in conflict therewith, and shall be codified as deemed suitable by the
City Clerk.
SECTION 5: EFFECTIVE DATE.
This ordinance shall take effect (30) days after adoption on December 18 , 1981.
