2017-30083 Resolution RESOLUTION NO. 2017-30083 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH,FLORIDA,APPROVING, PURSUANT TO RESOLUTION NO. 2016-29506, A TEMPORARY LANE CLOSURE FOR PACIFIC 2.1 ENTERTAINMENT GROUP,INC.,TO CLOSE THE SOUTHBOUND LANES ON COLLINS AVENUE, A MAJOR ROADWAY,BETWEEN 52ND STREET AND 53RD STREET, AND REROUTE SOUTHBOUND TRAFFIC TO A SINGLE LANE ON THE WESTERN PORTION OF THE NORTHBOUND LANES ON COLLINS AVENUE, CONTINUOUSLY FROM WEDNESDAY, NOVEMBER 15, 2017, AT 10:00 A.M., THROUGH FRIDAY, NOVEMBER 17, 2017, AT 7:00 A.M. (WITH ALTERNATIVE WEATHER DATES FROM FRIDAY, NOVEMBER 17, 2017, AT 10:00 A.M., THROUGH SATURDAY, NOVEMBER 18, 2017, AT 7:00 A.M.), EXCLUDING RESTRICTED RUSH HOUR PERIODS FROM 7:00 A.M. TO 10:00 A.M. AND FROM 3:30 P.M. TO 7:00 P.M., TO ALLOW THE FILMING OF "AMERICAN CRIME STORY: VERSACE," BY RECREATING THE TRUE LOCATION OF THE HOUSEBOAT CONCLUSION SCENE AND SUBSEQUENT POLICE INVESTIGATION OF THE 1997 ANDREW CUNANAN CASE. WHEREAS, Pacific 2.1 Entertainment Group, Inc., a division of 20th Century Fox Studios, is currently in production for Season 2 of the Emmy-winning FX Network series "American Crime Story," focusing this season on the true crime story of the 1997 murder of Italian fashion designer Gianni Versace on Ocean Drive in Miami Beach, by the serial killer Andrew Cunanan, and the subsequent investigation and manhunt led by local police; and WHEREAS,the production team filmed several sequences on Ocean Drive in May of 2017, before moving the team to Los Angeles, California, for the majority of the production work, due to available film incentives not currently offered in the state of Florida; and WHEREAS,the production team is returning to Miami Beach to film additional scenes for the show, including the infamous conclusion scene that saw Cunanan take his life aboard a re-creation of the houseboat docked off of Collins Avenue and 52nd Street; and WHEREAS, in order to ensure period accuracy, the production team is requesting the subject road closure and traffic reroute around the filming area; and WHEREAS, the request is to close the southbound lanes on Collins Avenue, between 52nd Street and 53rd Street, and to reroute southbound traffic onto the westernmost lane of northbound Collins Avenue, between 52nd Street and 53rd Street, with the closure to take effect continuously from Wednesday, November 15, 2017, at 10:00 a.m. through Friday, November 17, 2017 at 7:00 a.m., excluding restricted rush hour periods from 7:00 a.m.to 10:00 a.m., and from 3:30 p.m.to 7:00 p.m., during which time the production team will remove the barricades, and traffic will flow normally on all lanes of Collins Avenue; and WHEREAS,the production team has further requested alternative dates, if necessary due to inclement weather, of Friday, November 17, 2017, at 10:00 a.m., through Saturday, November 18, 2017 at 7:00 a.m., also excluding restricted rush hour periods; and WHEREAS, Pacific 2.1 Entertainment Group, Inc., has provided the City with a Maintenance of Traffic plan (attached hereto as Exhibit"A"),which has been reviewed by the City's Transportation Department; and WHEREAS, pursuant to the Maintenance of Traffic plan, Pacific 2.1 Entertainment Group, Inc., will (i) hire off-duty Miami Beach Police officers to coordinate the proposed road closure, (ii) notify all affected parties from 41st Street to 63rd Street of the closure, and (iii) further provide Variable Message Signs (VMS) no less than a week in advance of the closure; and WHEREAS, pursuant to Resolution No. 2016-29506,the City has adopted a policy requiring that all future special events requiring lane closures along major thoroughfares in the City of Miami Beach must obtain prior approval from the Miami Beach City Commission; and WHEREAS, film permit applicants, such as Pacific 2.1 Entertainment Group, Inc., are not required by Resolution No. 2016-29506 to seek prior approval from the Miami Beach City Commission for a road closure; however, because of the potential traffic impacts of this closure,the Administration has sought City Commission approval. NOW THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby approve, pursuant to Resolution No. 2016-29506, a temporary lane closure for Pacific 2.1 Entertainment Group, Inc., to close the southbound lanes on Collins Avenue, a major roadway, between 52nd Street and 53rd Street, and reroute southbound traffic to a single lane on the western portion of the northbound lanes on Collins Avenue, continuously from Wednesday, November 15, 2017, at 10:00 a.m., through Friday, November 17, 2017, at 7:00 a.m. (with alternative weather dates from Friday, November 17, 2017, at 10:00 a.m., through Saturday, November 18, 2017, at 7:00 a.m.), excluding restricted rush hour periods from 7:00 a.m. to 10:00 a.m. and from 3:30 p.m. to 7:00 p.m., to allow the filming of"American Crime Story: Versace," by recreating the true location of the houseboat conclusion scene and subsequent police investigation of the 1997 Andrew Cunanan case. The production will recreate the houseboat on a barge docked in the original location and is requesting closure and reroute of the filming area to ensure period accuracy. The specific request is to close southbound Collins Avenue from 52nd Street to 53rd Street, rerouting southbound traffic onto the single westernmost lane of northbound Collins Avenue, from 52nd Street to 53rd Street, per the attached Maintenance of Traffic (MOT) plan, as approved by the Transportation Department. The closure would be in effect from Wednesday, November 15, 2017 at 10:00 am until Friday, November 17, 2017 at 7:00 am, not including restricted rush hour periods from 7:00 am to 10:00 am and 3:30 pm to 7:00 pm, during which time the production will remove the MOT and all lanes of Collins Avenue will flow openly. The production has further requested a weather date if necessary, of Friday, November 17, 2017 at 10:00 am through Saturday, November 18, 2017 at 7:00 am, also not Page 282 of 376 including rush hour restricted periods. The closure will be managed by Off-duty Miami Beach Police at all times. The production will install Variable Message Boards (VMS), alerting motorists of the coming disruption for a week prior to this impact. The production will notice all buildings from 41st Street to 63rd Street, and obtain signature consent of the properties within the closure. At the July 13, 2016 meeting of the Miami Beach Commission, Resolution 2016-29506 was adopted, henceforth requiring any new special event applicant seeking to close a road or lane of a major thoroughfare in the City of Miami Beach to seek approval from the Miami Beach Commission. Although film production permitting is exempted from requiring Commission approval via the Resolution, the Administration is seeking direction regarding this impactful production. CONCLUSION The Administration seeks direction from the Commission.
