RESOLUTION NO. 1772
WHEREAS, a resolution was passed and adopted by the
. City Council of the City of Miami Beach, Florida, on May 2,
1928, requiring the owners of the storm wrecked building
on the East 70' of Lots 9 and 10, Block 57, Ocean Beach
Addition #3 , to clear the same of and destroy weeds, under-
growth, rubbish , debris, trash and unsightly and unsanitary
matter on or before May 16, 1928, and,
WHEREAS, due notice was given to such property owners
by publication on May 4th in the "Miami Beach Sun" , a news-
paper published in said City, in accordance with the provi-
sions of the aforementioned resolution of the said City
Council, and
WHEREAS, the premises heretofore described are encum-
bered with a large amount of weeds, undergrowth, rubbish,
debris, trash and unsightly and unsanitary matter , and it is
hereby declared that the condition of said premises consti-
tutes a menace to the health, convenience and welfare of the
citizens of said City , and
WHEREAS, the owner of said above described premises
has failed to comply with the terms and requirements of said
resolution, and said premises have continued and now remain
in the same unsightly, unsanitary and harmful condition, and
WHEREAS, it appears to this City Council from a com-
munication received by it from the head of the Fire Depart-
ment of this City, that said premises are a dangerous menace
to the City of Miami Beach, because of certain rubbish, debris
g'. and a certain building situated thereon, which has not been re-
paired since the 1926 storm; and from two communications from
the Health Officer and the Sanitary Inspector of said City,
respectively, that said premises, due to their unrepaired con-
dition, constitute a public nuisance and a menace to public
health, because of their present condition, and particularly
because of the unsanitary condition existing in said open store
building; and this City Council having received complaints from
owners of property adjacent to and situated near said premises,
to the effect that their health, morals and safety are impaired
and endangered, and their property endangered because of said
condition of said premises.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MIAMI BEACH, FLORIDA:
Section 1. That the City Manager of the City of Miami
Beach, Florida, is hereby directed and authorized to proceed
and cause such work to be done as may be reasonably necessary
to remove from said premises the unsightly and unsanitary con-
dition thereof ,and to clear the same of all rubbish and debris,
and to make the same reasonably safe from fire , and cease to be
a health menace to the community; to keep an account of such
work and report the same to the Council, whereupon the costs
thereof shall be made a charge and lien against the property so
cleared and preserved, of the same extent and character as liens
for special assessments provided for in the Charter of this City.
