AN ORDINANCE AMENDING CHAPTER 45 OF THE CODE OF
THE CITY OF MIAMI BEACH, FLORIDA, BY INCREASING
THE SCHEDULE OF RATES FOR WATER SUPPLY SERVICE
TO NON-MUNICIPAL CONSUMERS OF WATER; INCREASING
THE RATES FOR OTHER WATER METER SERVICES;
INCREASING MINIMUM MONTHLY SERVICE CHARGES;
PROVIDING FOR AN EFFECTIVE DATE; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING
FOR ADOPTION AS AN EMERGENCY MEASURE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1: That Section 45.4 (a) of the Code of the City of Miami Beach, Florida, be and
the same is hereby amended to read as follows:
"(a) The meter rate to non-municipal consumers for water
supply service in the territory shall be 65 per thousand
gallons."
SECTION 2: That the water rate of 65 per 1,000 gallons for non-municipal consumers of
water as set forth in Section 1 of this Ordinance is to be applied to all water
billings based on meter readings taken on or after December 1, 1982.
SECTION 3: That that portion of Section 45.4 (a) of the Code of the City of Miami Beach
reading as follows:

SECTION 4: That Section 45-10 of the City Code of the City of Miami Beach, Florida, be
and the same is hereby amended to read as follows:
" Sec. 45-10. Metered water supply service.
(g) The owner of or consumer at every premises shall pay to the public
works department the sum of live dellaps twenty-five dollars for eachmeter
for each time the seal on any meter or its couplings on or for such premises is
found broken or removed, the public works department hereby reserving the
right to put on such seals in or for any premises at any time, and upon the
second occurrence of such offense, the public works department may, at its
option, shut off the supply and discontinue its service, and may further refuse
to again turn on the same and resume its service to such premise, so long as
the owner of or consumer at the premise at the time of the breaking or
removal of such seal shall continue to be the owner of or consumer at the
premise. (Code 1950, Sec. 38.10; Ord. No. 79-2185, Sec. Sec. 1,4.)
SECTION 5: That Section 45-12 of the City Code of the City of Miami Beach, Florida, be
and the same is hereby amended to read as follows:
Sec. 45-12. Delinquent accounts; creation of liens.
(b) All delinquent accounts, including metered water supply and sewer
service, may cause the, service of the public works department to be
discontinued and the water supply to be shut off from and to the premises of
the owner or consumer from whom such account is in arrears, in accordance
with the provisions contained in section 45-11 (g), regardless of the status of
the owners other accounts. A disconnect charge of ten dollars shall be
assessed against such consumer or customer and the water not turned on to
any premises until a twe deaF ten dollar for each meter turn on fee has been
paid. (Sec. 45-14(c)
(e) When water supply has been shut off from and to the premises of the
owner or consumer from whom such account is in arrears, and said water
supply is found to have been turned on by other than authorized public works
personnel, a twenty-five dollar charge shall be assessed against such owner or
consumer for the insertion of solid washers in subject meters and/or the
removal of the subject meters in order to prevent unauthorized usage of the
city water supply.
SECTION 6: That Section 45-13 of the City Code of the City of Miami Beach, Florida, be
and the same is hereby amended to read as follows:
Section 45-13. Turn-on and shut-off.
(b) A violation of subsection (a) of this section upon the part of the owner,
his employees or agents shall subject the owner or consumer to a penalty of
five de44aFs fifteen dollars for each meter for the first offense, and upon the
second offense the public works department may, at its option, discontinue
the service and shut off the water supply to the premises so long as the owner
or consumer continues to reside at the premises.
(c) There shall be no separate charge made for shutting off the water
supply to and for any premises, but in every instance, when such shut-off was
originally made for nonpayment of any delinquent account or any other
violation of any rule of the public works department, a twe dellaF ten dollar
turn-on charge shall be collected; also, in cases where the same person
requires a turn-on at a service where the last cut-off had been in his name, a
turn-on fee of two dollars shall be collected.

SECTION 8: That all ordinances or parts of ordinances in conflict herewith be and the
same are hereby repealed.
SECTION 9: That the City Commission of the City of Miami Beach having found and
determined that a public emergency exists affecting life, health, property or
public safety, this Ordinance is hereby adopted as an emergency measure and
shall go into effect as of December 1, 1982.
