AN ORDINANCE AMENDING SECTION 25-92. 2 OF THE
MIAMI BEACH CITY CODE AUTHORIZING THE CITY TO
ORDER COMPLIANCE BY OWNERS OF VACANT,
UNOCCUPIED, CLOSED OR UNFINISHED STRUCTURES OR
CONSTRUCTION SITES OR ANY OTHER VACANT LOTS WITH
SPECIFIC MAINTENANCE PROCEDURES; PROVIDING FOR
SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA:
SECTION 1.
Section 25-92 . 2 of the Miami Beach City Code is hereby amended to
read as follows:
Sec. 25-92.2. Unfinished, Vacant, Unoccupied, or Closed
Structures, Construction Sites, or Vacant Lots--Maintenance
Procedures Required of Owners.
A. All owners of unfinished, vacant, unoccupied, closed or
unfinished structures or buildings, construction sites, or any
other vacant lots, shall comply with rules and regulations
relating to such structures or buildings , construction sites,
or vacant lots as promulgated by the Building Official. These
rules and regulations shall specify those actions and time
limits within which owners shall beautify, secure and/or patrol
their structures or buildings.
B . Noncompliance with the a€efesa4d tales and feguIat4ens
this section shall be punishable in a manner as provided in §1-
8 of the Miami Beach City Code. Noncompliance with the tales
and regnIatHens this section may result in the City taking such
action as it deems appropriate under the circumstances, and a
lien shall be imposed against the structure or building for
recovery of all costs involved.
SECTION 2. OTHER ORDINANCES .
All ordinances or parts of ordinances in conflict herewith be and
the same are hereby repealed.
SECTION 3 . SEVERABILITY.
If any article, section subsection, sentence, clause, phrase or
portion of this Ordinance is , for any reason, held invalid or
unconstitutional by any court of competent jurisidiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions of this Ordinance.
SECTION 4 . EFFECTIVE DATE.
This ordinance shall take effect ten (10) days after adoption, in
accordance with law, on March 26 , 1983 .

SUBJECT: PROPOSED AMENDMENT TQ/S`ECTION 25-92.2 OF THE CITY CODE
REGARDING MAINTENANCE PROCEDURES REQUIRED
OF OWNERS OF CONSTRUCTION SITES OR VACANT LOTS
Section 25-92 .2 of the Miami Beach City Code regarding maintenance
procedures required of owners of unfinished, vacant, unoccupied or
closed structures and buildings has been amended to include owners
of construction sites and other vacant lots. The purpose of this
amendment is to uniformly impose maintenance responsibilities on
all owners of vacant or unoccupied property.
Another amendment to this section has been made to provide that
an owner shall be punished pursuant to Section 1-8 of the City
Code if he fails to comply with this section.
With the above amendments, the Legal Department is prepared to
present this matter before the City Commission for its approval.
